Book New Frontiers in Asia Pacific International Arbitration and Dispute Resolution

Download or read book New Frontiers in Asia Pacific International Arbitration and Dispute Resolution written by Shahla Ali and published by Kluwer Law International B.V.. This book was released on 2020-12-10 with total page 313 pages. Available in PDF, EPUB and Kindle. Book excerpt: International Arbitration Law Library Volume 59 The eastward shift in international dispute resolution has already involved initiatives not only to improve support for international commercial arbitration (ICA) and investor-state dispute settlement (ISDS) but also to develop alternatives such as international commercial courts and mediation. Focusing on these initiatives and their accompanying case law and trends in the Asia-Pacific region, this invaluable book challenges existing procedures and frameworks for cross-border dispute resolution in both commercial and treaty arbitration. Specially assembled for this project, an outstanding team of experienced and insightful arbitrators and scholars describes pertinent developments including: ICA and ISDS in the context of China’s Belt and Road Initiative; the Singapore Convention on Mediation; the shift to virtual hearings and other challenges from the COVID-19 pandemic; mistrust of the application of the rule of law in certain East Asian jurisdictions; growing public concern over ISDS arbitration; tensions between confidentiality and transparency; and potential regional harmonisation of the public policy exception to arbitral enforcement. The contributors chart evolving practices and high-profile cases to make informed observations about where changes are needed, as well as educated guesses about the chances of reforms being successful and the consequences if they are not. The main jurisdictions covered are China, Hong Kong, Japan, Malaysia, India, Australia and Singapore. The first in-depth study of recent trends in dispute resolution practice related to business in the Asia-Pacific region, the book’s practical analysis of new resources for dealing with the increasing competition among countries to become credible regional dispute resolution hubs will prove to be of great value to specialists in the international business law sector. Lawyers will be enabled to make informed decisions on which venue and dispute resolution methods are the most suitable for any specific dispute in the region, and policymakers will confidently assess emerging trends in international dispute resolution policy development and treaty-making.

Book Philanthropy and Law in Asia

Download or read book Philanthropy and Law in Asia written by Thomas Silk and published by Jossey-Bass. This book was released on 1999-02-12 with total page 424 pages. Available in PDF, EPUB and Kindle. Book excerpt: A Publication of the Asia Pacific Philanthropy Consortium This collection of reports written by local experts from ten Asian nations (Australia, China, Indonesia, Japan, Korea, The Philippines, Singapore, Taiwan, Thailand, and Vietnam) compares the laws and public policy that regulate and influence the nonprofit sectors in these countries. As international organizations play an increasingly central role in world development and change, their success becomes contingent upon understanding the complex legal disparities between nonprofit sectors of varying societies. Philanthropy and Law in Asia provides international audiences with timely insights into these legal incongruities as well as the regulations affecting the nonprofit sector in Asia. The essays in this comprehensive volume are the culmination of extensive legal research and analysis inspired by the Asia Pacific Philanthropy Consortium's Comparative Nonprofit Law Project. Each essay shares a common analytic framework, helping both practitioners and scholars to understand the ways in which nonprofit legal systems are regulated and structured throughout Asia. With this knowledge, international legislators, government officers, policy makers, nonprofit leaders, and legal counselors will be able to develop better intergovernmental cooperation and legal synergism. Philanthropy and Law in Asia is the up-to-date resource for those who wish to strengthen and improve the nonprofit sector in this significant region of the world. The Asia Foundation is part of the Asia Pacific Philanthropy Consortium and one of the driving forces behind Philanthropy and Law in Asia. It is a private, nonprofit, non-governmental organization dedicated to building leadership, improving policies, and strengthening institutions to foster greater openness and shared prosperity in the Asia Pacific region. The Asia Foundation has provided substantial assistance for the development of legislative systems in 16 countries and has supported more than 800 public interest, non-governmental organizations in the region.

Book Mediation in Contemporary Chinese Civil Justice

Download or read book Mediation in Contemporary Chinese Civil Justice written by Peter C.H. Chan and published by Martinus Nijhoff Publishers. This book was released on 2017-09-18 with total page 339 pages. Available in PDF, EPUB and Kindle. Book excerpt: In Mediation in Contemporary Chinese Civil Justice, Peter Chan offers one of the most comprehensive analyses of the system of mediation of civil and commercial disputes in contemporary China. Based on extensive interviews with judges and a survey on in-court mediation covering 24 courts in China, the author seeks to answer a question that interests many legal scholars: Is it practically feasible for the mediation of civil disputes in China to take the shape of genuine alternative dispute resolution, rather than being used by the courts as a means to preserve social stability? The book looks beyond procedural rules and examines how judicial culture and beliefs shape the landscape of civil dispute resolution in China.

Book International Economic Law

Download or read book International Economic Law written by Won-mog Choi and published by Cambridge Scholars Publishing. This book was released on 2015-09-10 with total page 405 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book assesses the past 20 years of development of international economic law in time for the WTO’s 20th Anniversary, and forecasts the future of international economic law. This edited volume brings together experts in the Asia-Pacific region, from a range of backgrounds, to provide perspectives on many issues that arise from the international economic law experience, focusing on its legal significance and likely impact on multilateralism. The past two decades have seen a significant proliferation of regional trade agreements and a lack of multilateral governance of finance around the world. How to respond to these challenges and how to reform the WTO jurisprudence and process to co-ordinate global and regional mechanisms have become compelling questions for large-scale discussions and systemic analysis. This book provides vital insights into just how to improve multilateral trading governance and to recalibrate international economic law in the twenty-first century.

Book Trade Policy in the Asia Pacific

Download or read book Trade Policy in the Asia Pacific written by Vinod K. Aggarwal and published by Springer Science & Business Media. This book was released on 2010-11-03 with total page 167 pages. Available in PDF, EPUB and Kindle. Book excerpt: East Asian countries are now pursuing greater formal economic institutionalization, weaving a web of bilateral and minilateral preferential trade agreements. Scholarly analysis of “formal” East Asian regionalism focuses on international political and economic factors such as the end of the Cold War, the Asian financial crisis, or the rising Sino-Japanese rivalry. Yet this work pays inadequate attention to the strategies of individual government agencies, business groups, labor unions, and NGOs across the region. Moreover, most studies also fail to adequately characterize different types of trade arrangements, often lumping together bilateral accords with minilateral ones, and transregional agreements with those within the region. To fully understand this cross-national variance, this book argues that researchers must give greater attention to the domestic politics within East Asian countries and the U.S., involving the interplay of these subnational players. With contributions from leading country and regional trade specialists, this book examines East Asian and American trade strategies through the lens of a domestic bargaining game approach with a focus on the interplay of interests, ideas, and domestic institutions within the context of broader international shifts. With respect to domestic politics, the chapters show how subnational actors engage in lobbying, both of their own governments and through their links to others in the region. They also trace the evolution of interests and ideas over time, helping us to generate a better understanding of historical trends in the region. In addition to scholars of East Asian and comparative regionalism, this book will be of interest to policy-makers concerned with international trade and U.S.-Asia relations, and those interested in understanding the rich trade institutional landscape that we see emerging in the Asia-Pacific.
