Book Who Decides

    Book Details:
  • Author : Jeffrey S. Sutton
  • Publisher : Oxford University Press
  • Release : 2021-10-04
  • ISBN : 0197582206
  • Pages : 497 pages

Download or read book Who Decides written by Jeffrey S. Sutton and published by Oxford University Press. This book was released on 2021-10-04 with total page 497 pages. Available in PDF, EPUB and Kindle. Book excerpt: A unique defense of Federalism, making the case that constitutional law in America--encompassing the systems of all 51 governments--should have a role in assessing the right balance of power among all branches of our state and federal governments. Everything in law and politics, including individual rights, comes back to divisions of power and the evergreen question: Who decides? Who wins the disputes of the day often turns on who decides them. And our acceptance of the resolution of those disputes often turns on who the decision maker is-because it reveals who governs us. In Who Decides, the influential US Appellate Court Judge Jeffrey S. Sutton focuses on the constitutional structure of the American states to answer the question of who should decide the key questions of public policy today. By concentrating on the role of governmental structure in shaping power across the 50 American states, Sutton develops a powerful explanation of American constitutional law, in all of its variety, as opposed to just federal constitutional law. As in his earlier book, 51 Imperfect Solutions, which looked at how American federalism allowed the states to serve as laboratories of innovation for protecting individual liberty and property rights, Sutton compares state-level governments with the federal government and draws numerous insights from the comparisons. Instead of focusing on individual rights, however, he focuses on structure, while continuing to develop some of the core themes of his previous book. An illuminating and essential sequel to his earlier work on the nature of American federalism, Who Decides makes the case that American Constitutional Law should account for the role of the state courts and state constitutions, together with the federal courts and the federal constitution, in assessing the right balance of power among all branches of government. Taken together, both books reveal a remarkably complex, nuanced, ever-changing federalist system, one that ought to make lawyers and litigants pause before reflexively assuming that the United States Supreme Court alone has the answers to our vexing constitutional questions.

Book Structural Analysis

Download or read book Structural Analysis written by O. A. Bauchau and published by Springer Science & Business Media. This book was released on 2009-08-03 with total page 943 pages. Available in PDF, EPUB and Kindle. Book excerpt: The authors and their colleagues developed this text over many years, teaching undergraduate and graduate courses in structural analysis courses at the Daniel Guggenheim School of Aerospace Engineering of the Georgia Institute of Technology. The emphasis is on clarity and unity in the presentation of basic structural analysis concepts and methods. The equations of linear elasticity and basic constitutive behaviour of isotropic and composite materials are reviewed. The text focuses on the analysis of practical structural components including bars, beams and plates. Particular attention is devoted to the analysis of thin-walled beams under bending shearing and torsion. Advanced topics such as warping, non-uniform torsion, shear deformations, thermal effect and plastic deformations are addressed. A unified treatment of work and energy principles is provided that naturally leads to an examination of approximate analysis methods including an introduction to matrix and finite element methods. This teaching tool based on practical situations and thorough methodology should prove valuable to both lecturers and students of structural analysis in engineering worldwide. This is a textbook for teaching structural analysis of aerospace structures. It can be used for 3rd and 4th year students in aerospace engineering, as well as for 1st and 2nd year graduate students in aerospace and mechanical engineering.

Book Restraint

    Book Details:
  • Author : Barry R. Posen
  • Publisher : Cornell University Press
  • Release : 2014-06-03
  • ISBN : 0801470862
  • Pages : 181 pages

Download or read book Restraint written by Barry R. Posen and published by Cornell University Press. This book was released on 2014-06-03 with total page 181 pages. Available in PDF, EPUB and Kindle. Book excerpt: The United States, Barry R. Posen argues in Restraint, has grown incapable of moderating its ambitions in international politics. Since the collapse of Soviet power, it has pursued a grand strategy that he calls "liberal hegemony," one that Posen sees as unnecessary, counterproductive, costly, and wasteful. Written for policymakers and observers alike, Restraint explains precisely why this grand strategy works poorly and then provides a carefully designed alternative grand strategy and an associated military strategy and force structure. In contrast to the failures and unexpected problems that have stemmed from America’s consistent overreaching, Posen makes an urgent argument for restraint in the future use of U.S. military strength. After setting out the political implications of restraint as a guiding principle, Posen sketches the appropriate military forces and posture that would support such a strategy. He works with a deliberately constrained notion of grand strategy and, even more important, of national security (which he defines as including sovereignty, territorial integrity, power position, and safety). His alternative for military strategy, which Posen calls "command of the commons," focuses on protecting U.S. global access through naval, air, and space power, while freeing the United States from most of the relationships that require the permanent stationing of U.S. forces overseas.

Book Burma s Mass Lay Meditation Movement

Download or read book Burma s Mass Lay Meditation Movement written by Ingrid Jordt and published by Ohio University Press. This book was released on 2014-07-31 with total page 302 pages. Available in PDF, EPUB and Kindle. Book excerpt: Burma’s Mass Lay Meditation Movement: Buddhism and the Cultural Construction of Power describes a transformation in Buddhist practice in contemporary Burma. This revitalization movement has had real consequences for how the oppressive military junta, in power since the early 1960s, governs the country. Drawing on more than ten years of extensive fieldwork in Burma, Ingrid Jordt explains how vipassanā meditation has brought about a change of worldview for millions of individuals, enabling them to think and act independently of the totalitarian regime. She addresses human rights as well as the relationship between politics and religion in a country in which neither the government nor the people clearly separates the two. Jordt explains how the movement has been successful in its challenge to the Burmese military dictatorship where democratically inspired resistance movements have failed. Jordt’s unsurpassed access to the centers of political and religious power in Burma becomes the reader’s opportunity to witness the political workings of one of the world’s most secretive and tyrannically ruled countries. Burma’s Mass Lay Meditation Movement is a valuable contribution to Buddhist studies as well as anthropology, religious studies, and political science.

Book Restraining Rage

Download or read book Restraining Rage written by William V. Harris and published by Harvard University Press. This book was released on 2009-07 with total page 492 pages. Available in PDF, EPUB and Kindle. Book excerpt: The angry emotions, and the problems they presented, were an ancient Greek preoccupation from Homer to late antiquity. From the first lines of the Iliad to the church fathers of the fourth century A.D., the control or elimination of rage was an obsessive concern. From the Greek world it passed to the Romans. Drawing on a wide range of ancient texts, and on recent work in anthropology and psychology, Restraining Rage explains the rise and persistence of this concern. W. V. Harris shows that the discourse of anger-control was of crucial importance in several different spheres, in politics--both republican and monarchical--in the family, and in the slave economy. He suggests that it played a special role in maintaining male domination over women. He explores the working out of these themes in Attic tragedy, in the great Greek historians, in Aristotle and the Hellenistic philosophers, and in many other kinds of texts. From the time of Plato onward, educated Greeks developed a strong conscious interest in their own psychic health. Emotional control was part of this. Harris offers a new theory to explain this interest, and a history of the anger-therapy that derived from it. He ends by suggesting some contemporary lessons that can be drawn from the Greek and Roman experience.
