Book excerpt: The Homeland Security Act of 2002 (P.L. 107-296, 116 Stat. 2135) contains provisions to arm pilots of passenger aircraft and gives deputized pilots the authority to use force, including lethal force, to defend the flight deck against criminal and terrorist threats. Participation in the Federal Flight Deck Officer Program, established under the Arming Pilots Against Terrorism Act contained in P.L. 107296, was initially limited to pilots of passenger aircraft. However, a provision in the FAA reauthorization act (Vision 100; P.L. 108-176, 117 Stat. 2490) expanded the program to include flight engineers as well as flight crews of all-cargo aircraft. During debate over legislation to arm pilots, proponents argued that the potential benefits of deterring or thwarting terrorist and criminal acts against passenger aircraft outweighed the inherent risks associated with arming pilots. However, opponents of policy allowing pilots to be armed with lethal weapons argued that such a program's safety risks and monetary costs significantly outweighed these potential benefits. Risks cited included potential distraction to the flight crew, dangers that a weapon discharge could pose to the aircraft or its occupants, and security concerns associated with carrying firearms in secured areas of the aviation system. Proponents countered that these risks could be effectively mitigated, but recognized that these are important issues to be addressed for successful implementation of the policy to arm pilots. With enactment of this legislation, focus on the issue of arming pilots has turned to implementation of the Federal Flight Deck Officer Program. These implementation issues fall into four broad categories: 1) pilot selection and screening; 2) equipment (i.e., firearms and ammunition and the risks they may pose to aircraft and passengers); 3) training; and 4) operational procedures. This report describes several implementation issues within each of these areas that may require continued legislative oversight and possible clarification regarding the intent of the legislation. The TSA has fully implemented the program over the last year. However, continued concerns voiced by pilot groups over the implementation of the program include: the extensive background checks required of applicants; the requirement to transport issued firearms in lock boxes; and the inconvenient location of training facilities. These issues, along with the possibility of using private contractors to provide recurrent training for deputized pilots may be the topics of continued congressional oversight. This report will not be updated.

Book excerpt: Since the terrorist attacks on September 11, 2001, legislation has been enacted to enhance the nation's approach to aviation security. Specifically, the Aviation and Transportation Security Act created the Transportation Security Administration (TSA) and, among other actions, federalized passenger and baggage screening staff at airports and authorized the arming of commercial pilots, subject to the approval of the Under Secretary of Transportation for Security and other conditions. On May 21, 2002, the Under Secretary testified that he would not approve the arming of commercial pilots because he believed they must focus exclusively on flying the aircraft. However, the question of arming pilots remains open because H.R. 4635, introduced on May 1, 2002, would require TSA to establish a program to arm pilots within 90 days of the bill's enactment. On June 19, 2002, the House Transportation and Infrastructure's Subcommittee on Aviation passed an amended version of H.R. 4635 to limit the maximum number of pilots participating in this pilot program to 2 percent of the total number of pilots employed by air carriers and require that TSA address a number of procedural issues before beginning the selection, training, and deputizing of pilots. In addition, four other bills, introduced before the Aviation and Transportation Security Act's enactment, include proposals to carry weapons.

Book excerpt: This dissertation examined the attitudes of airline pilots with respect to the Federal Flight Deck Officer (FFDO) Program. Title XIV of the Homeland Security Act (Arming Pilots Against Terrorism) developed the FFDO Program in response to the terrorist attacks that occurred on September 11, 2011. It became apparent in the post-911 environment that airline cockpits needed to be protected to prevent future hijackings that could result in airliners again being used as missiles, and the FFDO Program would provide this protection. An evaluation of the FFDO Program by the U.S. Office of Management and Budget (OMB) found the Program results were unsatisfactory. Because the FFDOs were all volunteers, it was essential for their attitudes to be considered in implementing Program processes, procedures, and protocols. This qualitative grounded theory study attempted to identify factors which affected pilot attitudes towards the FFDO Program, and suggested strategies to improve rates of pilot participation. Participants were selected from four groups of volunteers (pilots and copilots with prior military service, and pilots and copilots from civilian backgrounds) and consisted of 25 pilots who responded to requests for participation posted on the Internet and through word-of-mouth (snowball) recruitment. Airline experience for the participants ranged from 2 years to 34 years, with an average of 20 years, and 13 of these participants were FFDOs. As overwhelming majority (92%) of the participants felt that FFDO Program is effective. Only 52% of the respondents viewed the FFDO screening and selection process as either Good or Excellent, and 48% had a negative opinion of the management of FFDO Program. The weapons transportation protocol and the locking holster each elicited a 52% negative response, and 68% of the respondents were adamantly against the current requirement that FFDOs pay for their own room and board while attending training. This study is a contribution to further understanding of pilot attitudes toward the FFDO Program. Improvements to the weapons transportation and carriage protocols, management of the FFDO Program, and FFDO expense reimbursement were recommended. Further research should consist of a quantitative study composed of questions formatted on a Likert scale, to enable researchers to assess opinions and relative convictions of these opinions of a large airplane pilot sample.
