Anand, Professor at the Jawaharlal University of New Delhi, points out in the introduction of his course that the principle of sovereign equality of States refers to two twin principles which are accepted as unimpeachable norms of modern international law which cannot be questioned: the principles of equality and of sovereignty of States. Taking this as his starting point, the author first discusses the sovereignty of States in an interdependent world. He then examines the principle of equality of States in an unequal world from a historical perspective. Finally, Professor Anand tackles the questions of equality of States in a hierarchical world order, and mini-States and equality of rights. La Méthode de la Référence à l'Ordre juridique compétent en Droit international privé, Paolo Picone Paolo Picone, Professor at the University of Naples, notes in the introduction to his course that contemporary international law, such as it evolved during the 19th century, developed different methods of coordination. One method has nevertheless been neglected, which consist in choosing not the applicable law, but the competent legal system. After discussing the crisis in private international law, the author examines the method of coordination of legal systems based on the applicable law, followed by one that is based on reference to the @@@competent legal system. @@@He describes the functioning of the latter method in the case of the creation of legal situations in the @@@for, and in the case of recognition of foreign legal situations in the for. Professor Picone finishes his course by investigating the use of this method in solving the problem of preliminary matters in private international law, the method's area of application and its future prospects.

The reports were written for the XIVth Congress of the International Academy of Comparative Law which was held in 1994 in Athens, Greece. As narcotics trafficking exploded in the 1980s, it was realized that money laundering had become a threat to the entire integrity of the financial system. The international trend to regard money laundering as a serious threat to the stability of democracy and the rule of law found expression in the adoption of the 1988 United Nations Drugs Convention. Gradually, the international community diverged from its traditional, narrow approach whereby only the laundering of drug proceeds was considered a threat. In order to combat money laundering efficiently, it soon became clear that criminal law was not sufficient and that it was necessary for banks and other financial institutions to co-operate with law enforcement agencies. The banking community is now obliged to report suspicious transactions, which they often regard as going beyond their role as bankers. The issue of bank secrecy has played an important role in the discussion between law enforcement agencies and the banking community. Both the Council of Europe Convention on Laundering Search, Seizure and Confiscation of the Proceeds from Crime and the UN Drugs Convention require that bank secrecy should not be an obstacle to international co-operation. At the national level the seizure of bank records should not be hindered by bank secrecy.

Book excerpt: In his hugely influential book Discipline and Punish, Foucault used the example of Jeremy Bentham's Panopticon prison as a means of representing the transition from the early modern monarchy to the late modern capitalist state. In the former, power is visibly exerted, for instance by the destruction of the body of the criminal, while in the latter power becomes invisible and focuses on the mind of the subject, in order to identify, marginalize, and 'treat' those who are regarded as incapable of participating in, or unwilling to submit to, the disciplines of production. The Panopticon links the worlds of Bentham and Foucault scholars yet they are often at cross-purposes; with Bentham scholars lamenting the ways in which Foucault is perceived to have misunderstood panopticon, and Foucauldians apparently unaware of the complexities of Bentham's thought. This book combines an appreciation of Bentham's broader project with an engagement of Foucault's insights on economic government to go beyond the received reading of panopticism as a dark disciplinary technology of power. Scholars here offer new ways of understanding the Panopticon projects through a wide variety of topics including Bentham's plural Panopticons and their elaboration of schemes of 'panoptic Utopia', the 'inverted Panopticon', 'panoptic governance', 'political panopticism' and 'legal panopticism'. French studies on the Panopticon are groundbreaking and this book brings this research to an English-speaking audience for the first time.
