Book excerpt: Appointed is a recently recovered novel written by William Anderson and Walter Stowers, two of the editors of the Detroit Plaindealer, a long-running and well-regarded African American newspaper of the late nineteenth century. Drawing heavily on nineteenth-century print culture, the authors tell the story of John Saunders, a college-educated black man living and working in Detroit. Through a bizarre set of circumstances, Saunders befriends his white employer's son, Seth Stanley, and the two men form a lasting, cross-racial bond that leads them to travel together to the American South. On their journey, John shows Seth the harsh realities of American racism and instructs him in how he might take responsibility for alleviating the effects of racism in his own home and in the white world broadly. As a coauthored novel of frustrated ambition, cross-racial friendship, and the tragedy of lynching, Appointed represents a unique contribution to African American literary history. This is the first scholarly edition of Appointed, and it includes a collection of writings from the Plaindealer, the authors' short story "A Strange Freak of Fate," and an introduction that locates Appointed and its authors within the journalistic and literary currents of the United States in the late nineteenth century.

A detailed examination, long overdue, of how this feature affects the actual process of arbitration is presented in this book. The study includes a historical analysis of unilateral nominations, a critical assessment of how the unilateral appointments system currently works and an empirical study of challenges of arbitrators. The author's critical assessment addresses several issues including: - limits to the right of the parties to make unilateral appointments; - the principle of equality of the parties in the constitution of the arbitral tribunal; - arbitrators' duty to be impartial and independent; - specific problems of bias in tribunals with party-appointed members; - the question of whether a different standard of impartiality and independence in party-appointed arbitrators makes any sense; - the presumption that party-appointed arbitrators can do things that presiding arbitrators cannot; and - the question of whether it is worth keeping the system of unilateral appointments as the default method for the constitution of multiple-member tribunals, or keeping it at all. The empirical study, in which the author offers a comparative analysis of challenges of arbitrators taking into account the method of appointment of the arbitrator, reveals interesting differences and coincidences between party-appointed and non-party-appointed arbitrators. The book ends with some suggestions on how the system of unilateral appointments could be improved, namely in order to increase the trust of each party in the arbitrator appointed by the other party and to allow an accurate match between what arbitration end-users may want from party-appointed arbitrators and what they ultimately get. For both its thorough and well-informed analysis and its sound recommendations, the book is sure to be welcomed by professionals in the arbitral community worldwide, as well as by arbitration law academics.

Claiborne, the first governor of Orleans Territory, was at the hub of officials who grappled with the political, diplomatic, and administrative challenges that arose following the Louisiana Purchase in 1803. Letters both to and from Claiborne during the critical months of 1804–1805, mysteriously excluded in 1917 from Dunbar Rowland’s Official Letter Books of W. C. C. Claiborne, 1801–1816, are now made widely accessible, over half of them published here for the first time. To enhance appreciation of the letters, Jared William Bradley has furnished biographical sketches of thirty-one heretofore little-known individuals crucial to Claiborne’s correspondence, delineating their personalities and their contributions to the development of law and the establishment of American government in the French Creole society.
