These trends have been especially pronounced in the European Union. The 2019 World Development Report will study how the nature of work is changing as a result of advances in technology today. Technological progress disrupts existing systems. A new social contract is needed to smooth the transition and guard against rising inequality. Significant investments in human capital throughout a person’s lifecycle are vital to this effort. If workers are to stay competitive against machines they need to train or retool existing skills. A social protection system that includes a minimum basic level of protection for workers and citizens can complement new forms of employment. Improved private sector policies to encourage startup activity and competition can help countries compete in the digital age. Governments also need to ensure that firms pay their fair share of taxes, in part to fund this new social contract. The 2019 World Development Report presents an analysis of these issues based upon the available evidence.

La prima parte dell’opera è dedicata all’istituto dell’appalto come tipica figura contrattuale prevista dal nostro codice civile. La trattazione dell’istituto è stata affrontata dagli anche l’evoluzione dell’appalto nella prassi applicativa derivante, tra l’altro, dalle implicazioni interdisciplinari, specie in materia giuslavoristica. Sono trattati nello specifico: i tratti distintivi dell’appalto rispetto ad altre figure contrattuali simili; le principali differenze tra appalto d’opera e appalto di servizi; i temi della legge applicabile negli appalti che presentano profili di internazionalità e la disciplina dell’appalto di beni di consumo; la fase di esecuzione del contratto; il regime sostanziale delle responsabilità che insorgono dalla stipulazione ed esecuzione del contratto d’appalto, considerando anche i rapporti con i consumatori e la disciplina che tutela gli acquirenti degli immobili da costruire; le cause di legittimo scioglimento del vincolo contrattuale (comprese quelle situazioni influenzate dall’apertura di procedure concorsuali); gli strumenti processuali, inclusi quelli di natura cautelare e urgente, a cui le parti del contratto possono fare ricorso; la fattispecie del subappalto e le peculiarità della relativa disciplina. In particolare, ci si sofferma su: inquadramento delle ragioni di emersione del fenomeno, anche mediante una descrizione delle diverse tipologie riscontrabili nella prassi; esposizione delle forme negoziali con cui possono essere disciplinati tali rapporti, gli elementi soggettivi e oggettivi caratteristici, gli strumenti di tutela contrattuale più diffusi dei diritti delle parti contraenti (ivi compresi quelli legati alla privacy); tre figure, di particolare diffusione e complessità anche per la natura dell’attività esternalizzata, rappresentate dall’outsourcing informatico, dai contratti di O&M (operation and maintenance), ricorrenti nel settore delle energie rinnovabili, e da quei rapporti con i quali banche e operatori soggetti a discipline regolamentari affidano a imprese terze determinati servizi specializzati nella loro attività. While the peak of their influence within and beyond Europe has been thoroughly examined by historians, the way in which merchants from the Italian peninsula reacted and adapted themselves to the emergence of greater commercial and financial powers is mostly overlooked. This collection, based on a vast variety of primary sources, seeks to explore the persisting presence of Florentine, Genoese and Milanese intermediaries in some key hubs of the Spanish monarchy (such as Seville, Cadiz, Madrid and Naples) as well as in eighteenth-century Lisbon. The resilience of powerless merchant nations from the Italian Peninsula in the face of increasing competition in long distance trade is deconstructed by analyzing the merchants’ relational dimension and the formal institutional resources they found in the host societies.
