Book excerpt: The book is a maiden voyage to compile and analyze the interpretations of ancient Indian law in modern historiography. There has been a dearth of books with historiographical approach to the study of classical Indian law, despite the fact that law has occupied a prominent place in the historical studies over the past two hundred years. Starting from British Indologist Sir William Jones, the historians owing allegiance to different schools like Imperialism, Nationalism, Marxism and Postmodernism commented fervently upon the ancient Indian law. Irrespective of their interpretive models, such comments and studies have broadened our understanding of the ancient Indian law and enriched the historiography of the same. But the comprehensive study of such vast intellectual heritage, remained a virgin territory. The followers of ancient history confined themselves to Sutra-Smriti texts, and those from Law Schools focused on post-independent codified Hindu law. In this backdrop, the present work, by studying the modern historiography of ancient Indian law, stands to be the first of its own kind. The book is historiographical in its methodology, but as and when required, primary sources have also been referred to in order to critically examine the historian's assumptions. The various interpretations have been put together in a lucid language to delineate a holistic and objective picture of various law topics such as - Marital Laws, Son-ship & Adoption, Succession & Inheritance, Women's Property Rights, International Laws, and Laws of Judicature, etc.

Large portions of the population were horribly in debt, many being forced to sell themselves or their children into slavery to pay off their debts. The laws and customs seemed to support the commercial practices that allowed lenders to charge 20%-30% interest, and the law protected the lenders and gave no recourse for the indebted. Strict justice called for the creditors to receive what they were due. But another legal concept, the emerging idea of equity, seemed to call for a different result - the use of law as a vehicle to free people from economic oppression. Debt relief edicts were instituted - "clean-slate laws" as they were known - and are of obvious relevance today as well where crushing debt is a major issue underlying social inequality"--

H v H The Constitution of India is not the last word in human wisdom, but it was certainly a glorious achievement of national consensus and national commitment. The higher Indian judiciary can be said to have broadly fulfilled its constitutional ethos. There have been aberrations, notably during the Emergency and in some cases, of overstating and unduly enlarging the scope of judicial power. More seriously, there are grave and growing problems of inefficient case management, arrears, delays, corruption and incompetence. Those issues have to be addressed urgently, effectively and comprehensively if the Indian judiciary is to emerge as a fit instrument for Rule of Law for the teeming millions in the largest democracy in the world and if the Indian judiciary is to flourish in the twenty-first century holding its head high as an institution of freedom, liberty and balance, with a commitment to the constitutional goals and aspirations of We the People of India.
