Geoengineering provides new possibilities for humans to deal with dangerous climate change and its effects, on the one hand, and creates new risks to the planet, on the other hand. Scientific uncertainties contained in such novel techniques and their impacts bring challenges to environmentalists, politicians as well as lawyers. In response to the challenges posed by geoengineering to international law, this book is aimed to identify and develop the rules and principles that control the risks arising from geoengineering activities to the environmental and human health without neglecting the contribution that geoengineering could make in preventing serious or irreversible climate change and its impacts. The author argues that, first, the employment of geoengineering should not cause significant environmental harm to the areas beyond the jurisdiction of the state of origin or the areas beyond the limits of national jurisdiction (the global commons), and the risk of causing such harm should be minimized or controlled. Second, the potential of geoengineering in contributing to preventing dangerous climate change should not be downplayed. This book examines the rules and principles that apply to geoengineering techniques under contemporary international law and proposes an international legal framework for governing geoengineering in the future.

Geo-engineering (GE) can be defined as the process through which humans voluntarily manipulate the energy input to the Earth System deploying natural climate impacting processes by means of available technologies. It is brought to the attention by the United Nations Intergovernmental Panel on Climate Change (IPCC) authors as an alternative escape-valve to counteract the effects and impacts of global warming in the Summary for Policymakers (IPCC-XXX/Doc. 10) of the IPCC AR5 WGI (2014). The IPCC 2012 meeting established criteria for assessing GE technologies: effectiveness, feasibility, scalability, sustainability, environmental risks, costs & affordability, detection & attribution. However, not explicitly addressed in the document are the legal and political aspects as well as the ethical and social implications. The challenges to regulate geo-engineering are large: it took a decade of negotiations to conclude the Law of Sea Convention and the Protection of the Atmosphere is since 2013 taken up in the program of the UN International Law Commission (ILC). This study aims at mapping the legal and political constraints related to geo-engineering within the extent of an international environmental legal framework. Thereto, all UN legal documents were screened and confronted with a series of parameters set in the definition of geo-engineering. The legal documents most pertinent to geo-engineering (i.e. the United Nation Framework Convention on Climate Change and the Convention on Biological Diversity) were evaluated on their potential ability to rule geo-engineering interventions.

The second focuses on the BIT’s content-interpretation, which is the orthodox approach to solve the fragmentation between the system of investment treaty law and the system of international climate change law. Finally, the third part tackles this fragmentation through a heterodox approach that is grounded in the direct application of climate change principles through law ascertainment. Apart from concluding that harmonization between investment treaty law and international climate change law is possible through the orthodox approach to the expropriation and the FET standards, as well as through the direct application of the climate change precautionary principle and the CBDRRC principle − heterodox approach, the book suggests that tribunals are expected soon to openly address climate change disputes in their rulings.

Book excerpt: This paper discusses large-scale technologies, which are proposed as emergency solutions for avoiding catastrophic climate change. Their use is highly controversial, notably because of risks of large-scale environmental damage and the danger of distracting from other climate policies. Some of these technologies are known as geoengineering or climate engineering. This paper examines stratospheric aerosol injection, ocean fertilisation, and artificial islands as case studies. As the analysis of the rules of international law relevant to these three technologies shows, international law takes on different and partly conflicting roles towards such technologies. Nonetheless, a strong precautionary legal core opposing risky technological endeavours can be identified. However, there is a danger of this precautionary stance of international law being diluted by research and new regulation that make emergency technologies appear as viable policy options. International law does not currently safeguard against the promise of such technologies distracting from mitigation and adaptation.
