Book excerpt: Excerpt from An Examination of the Law of Personal Rights: To Discover the Principles of the Law, as Ascertained From the Practical Rules of the Law, and Harmonized With the Nature of Social Relations That man has a social nature is a proposition fundamental to a proper understanding of the place in nature that is occupied by the law. The demonstration of this proposition belongs to general philosophy rather than to legal science; but the question, from its close relation to the philosophy of the law, can not be altogether ignored. Society, more or less permanent, exists among the lower animals as well as among the human species, affording a wide range of proofs that social tendencies are an important and necessary part of the order of nature. That such a tendency should not exist in the most primitive state in which we can conceive mankind to have lived, but that it should have arisen simply as a product of mature experience, contradicts the principle that has firmly fastened itself upon the minds of reflecting men, that experience can have no greater force than that of formulating that which must be conceived as existing prior to any experience whatever. When we speak of a tendency, we mean more than a practice or habit, and no less than that from which all practices and habits must have their origin. Without doubt, tendencies of a particular character are produced in association with habits formed; but they are referable to some general tendency that lies back of all habits.
