The mandates and powers of the NHRIs vary from country to country, as does their ability to deliver on these mandates. Indeed, the rapid increase in the number of NHRIs in Africa has come with a variety of substantive and operational challenges. In the face of such challenges, those who work in NHRIs need to understand the broader regional and global context in which the institutions operate and the changing nature of human rights issues. This compendium provides an overview of NHRIs in eastern and southern Africa. It is guided to a large extent by the internationally agreed-upon Principles Relating to the Status of National Institutions, referred to as the Paris Principles. These Principles are broadly accepted as the benchmark against which the legitimacy and credibility of NHRIs can be assessed. Endorsed by the United Nations General Assembly in 1993, the Paris Principles provide NHRIs with guidelines as to their competence and responsibilities, their composition and guarantees of independence and pluralism, and their methods of operation; additional principles relate to the status of commissions with quasi-jurisdictional competence. Book excerpt: National Human Rights Institutions (NHRIs), defined by the UN as bodies established to promote and protect human rights, have increased in number since the General Assembly adopted principles governing their effectiveness in 1993. The UN and others have encouraged states to set up such institutions as an indication of their commitment to human rights, and now over 20 such institutions exist in Africa and many more will follow. These institutions have taken various forms including ombudsmen, commissions, or a combination of the two. They differ in terms of how they are established; some by constitution, some by legislation and some by decree. These NHRIs have varying functions, usually both promotional and protective, such as giving advice to government, parliament, and others, making recommendations on compliance with human rights standards, awareness raising, and analysis of law and policy. Despite the considerable variations in the method of their creation, powers and composition, most of these institutions have chosen or indeed been mandated, to become involved in international and regional fora. This book examines these institutions in the African region, the way in which they use the international and regional fora, the effectiveness of their contributions and how they are able to participate.

Book excerpt: "The dawn of the multiparty dispensation in Malawi in 1994 brought about a liberal Constitution, which, among other things, created a number of independent bodies, otherwise named watchdog bodies, whose purpose was to safeguard the road to democracy with a system of checks and balances. Six institutions were particularly designated in the Constitution for this purpose, namely, the Anti-Corruption Bureau (ACB), Office of the Ombudsman (OMB), Director of Public Prosecutions (DPP), the Malawi Human Rights Commission (MHRC), the National Compensation Tribunal (NCT) and the Industrial Relations Court (IRC). Together these institutions play comprehensive and complementary roles in the democratic consolidation process. This research focuses on the OMB and the MHRC, which, respectively, originate from Chapters 10 and 11 of the Constitution of Malawi. The task of the MHRC is to safeguard a wide range of rights against violation, while the OMB is entrusted with the task of handling complaints of abuse of authority by public institutions. The research concentrates on four key areas: Institutional governance and effectiveness, Interaction with the government. Interaction with other democracy protection institutions, Interaction with the public and other non-state actors. A qualitative research approach was emphasised, with empirical data gleaned through research questions developed specifically for this purpose at a methodology workshop held by EISA in Johannesburg in February 2009"--p. xv.
