Book excerpt: Excerpt from An Analysis Criminal Liability The principles and illustrations employed are mainly drawn from English Law; but I have not, of course, omitted anything which was to be found in the Corpus J uris, bearing upon my subject: and I am not without hope that I may subsequently enlarge this work by comparing some of the rules, of principle or practice, in bodies of modern continen tal law. Reserving, however, such a treatment of my subject for the future, I have at present purposely avoided the quota tion of many parallels, which will probably occur to my readers, from the Code Napoleon or similar sources. Book Illustrative Cases in Criminal Law with Analysis and Citations Classic Reprint

Download or read book Illustrative Cases in Criminal Law with Analysis and Citations Classic Reprint written by James Paige and published by . This book was released on 2015-09-27 with total page 512 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Illustrative Cases in Criminal Law With Analysis and Citations Teaching the fundamental principles of law by means of actual cases illustrative of the meaning, limitations and scope of those principles is now admitted, I think, to be the most successful method of training young men for the bar, as it is certainly the most effectual method of educating and disciplining the mind. The "case lawyer" is denounced. If by that term is meant, as is usually true, that, having a case to conduct, he goes to the reports in search of another whose facts resemble the one he has to consider, ignoring the principle of law applicable to all cases of that class, the denunciation is merited; but the lawyer who consults the authorities extensively and thoroughly for a knowledge of principles and the just limits of their application, is the one whose merits and success are sure of recognition. The "Series," of which this volume is one, is designed to present the fundamental principles of the branches of law considered, and to furnish the student with abundant citations of authority where he can learn how judges have regarded those principles and what limitations and modifications they have recognized in their application. With us, this method, with lectures, and in some branches of the law, text-books, has produced good results; and if this book can be made useful to others whose life and energy are devoted to the. cause of legal education, that fact will be an especial gratification to its author, Mr. Paige. The merits and value of this volume are entirely due to Mr. Paige, who has devoted to it much patient labor, extensive reading, and careful thought. His analysis of the subject so carefully prepared, is a helpful feature of the book. In the hands of students it is extremely valuable. Book A Treatise on the Law of Crimes Classic Reprint

Download or read book A Treatise on the Law of Crimes Classic Reprint written by William Lawrence Clark and published by Forgotten Books. This book was released on 2017-10-29 with total page 944 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from A Treatise on the Law of Crimes The scope of the original work has not been enlarged or chan ged in any manner. Neither has any attempt been made to vary the original classification except the addition of a very few, and perhaps inconsequential, sections to the sub-analysis. An effort has been made to preserve the original text so far as possible. At the same time the revisor has not hesitated to make such changes as the decisions warrant. Some considerable matter has been added by way of elucidation whenever such seemed advisable. It is believed that every criminal case decided since the is anauco of the original edition has been examined. Those mere ly cumulative have been rejected, but the aim has been to pre serve every case which serves in any manner to aid the student in understanding the principles. Few, if any, cases can be said to lay down new principles, but many adaptations of the old principle to new states of fact have been found. These illustrative, novel cases have been carefully and fully pre sented. H. B. L. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book The Criminal Responsibility of Lunatics

Download or read book The Criminal Responsibility of Lunatics written by Heinrich Oppenheimer and published by . This book was released on 2015-07-10 with total page 292 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Criminal Responsibility of Lunatics: A Study in Comparative Law, Thesis Approved for the Degree of Doctor of Laws in the University of London The feud between medical men and lawyers in all questions concerning the criminal liability of lunatics is of old standing. More than one authority on either side has tried to bring about a reconciliation between the contending parties. But their endeavours have been crowned with very little success. For though it cannot be denied that the strife and warfare has of late lost much of its former bitterness, a modus vivendi satisfactory to both parties has not been found. Discouraged by such experiences, others have thought it well-nigh impossible to bridge over the gulf which in their opinion must ever separate the two hostile camps; they think that the visual angle from which the two professions look at the problem is too different to allow of a solution acceptable to both. I do not share this pessimistic view, nor the policy of the laisser faire which is its logical outcome. If all attempts hitherto made to bring the dispute to a peaceful ending have failed, and were doomed to failure from the very outset, the reason is not far to seek. Almost all the writers who have approached the investigation in a conciliatory spirit, have sought success by forsaking the claims of their own professional brethren and blindly recognising the opponents' claims; and surely deserters do not make good peace-makers. Yet in no other way could those writers hope to reach their goal. For how is the lawyer to distinguish between fact and hypothesis in the literature of psychological medicine? Book excerpt: Excerpt from The Criminal Imbecile: An Analysis of Three Remarkable Murder Cases This book is offered to the public in the belief that the three cases herein described are typical of a large proportion of criminal cases and that the analysis and discussion at tempted will help to make clean-important points which are often misunderstood, points relative to the criminal and to the imbecile. A clear conception of the nature of the imbecile and of his relation to crime will inevitably result in a most desirable change in our criminal procedure. Download or read book Outlines of Criminal Law Classic Reprint written by Courtney Stanhope Kenny and published by Forgotten Books. This book was released on 2017-11-25 with total page 554 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Outlines of Criminal Law In preparing the book, I have aimed at making its range of topics no wider than may be grasped, upon a first perusal, even by a reader previously unfamiliar with law. But I have tried to treat each individual topic with such fulness as may serve to fix it effectually in the reader's memory. Yet the susceptibility of his memory must depend very much (as all lecturers soon discover) upon the extent to which the matter in hand arouses his interest. Fortunately the law of Crime - when once the pre liminary difficulties attendant upon the chaotic form which it still retains in England have been faced and surmounted - is a branch of jurisprudence peculiarly capable of being rendered interesting. It is Closely linked with history, with ethics, with politics, with philanthropy. My endeavour has been to make it attractive to the reader, by supplying him with enough illustrative examples to give vividness and reality to all the abstract principles of our Criminal Law and also by tracing out its connexion with the past sufficiently to explain the various historical anomalies with which it is' still encumbered; and.
