This is a very important and insightful report because many of the cost assessments for these technologies in the past, which concluded they were too expensive, are no longer applicable. The Asian Century is challenging many of the traditional assumptions at the heart of Australian defence policy and strategy. The problem is that these recommendations all point in very different directions. How should we evaluate these options? Adam Lockyer tackles this question and develops a novel conceptual framework for evaluating defence strategies. It is a widely accepted view that the defence is a modern development, the first express recognition of which can be traced in England to the seminal decision of the House of Lords in Lipkin Gorman (a firm) v Karpnale Ltd. Commentators have accordingly tended to focus on post-Lipkin case law in discussing the defence and its many disputed features. This work takes a different stance, arguing that the defence is best understood by placing it within its broader historical and legal context. It explains that the foundations of the defence can be found in the related doctrines of estoppel by representation, the agent's defence of payment over and the law of rescission. The analysis applies crucial insights from those areas, together with the change of position authorities and broader considerations of policy and principle, to develop a rigorous model of the change of position defence. The work not only provides a clear and exhaustive examination of the defence, but demonstrates that, properly understood, the defence operates in a rational and justifiable manner within its broader private law context. As policymakers today evaluate the U.S. forward military presence, it is important that they understand how and why the U.S. global posture has changed in the past. Today's posture is under increasing pressure from a number of sources, including budgetary constraints, precision-guided weapons that reduce the survivability of forward bases, and host-nation opposition to a U.S. military presence. This monograph aims to describe the evolution of the U.S. global defense posture from 1783 to the present and to explain how the United States has grown from a relatively weak and insular regional power that was primarily concerned with territorial defense into the preeminent global power, with an expansive system of overseas bases and forward-deployed forces that enable it to conduct expeditionary operations around the globe. This historical overview has important implications for current policy and future efforts to develop an American military strategy, in particular the scope, size, and type of military presence overseas. As new and unpredictable threats emerge, alliance relationships are revised, and resources decline, past efforts at dealing with similar problems yield important lessons for future decisions.
