Available in PDF, EPUB and Kindle. Book excerpt: Hospital Liability Law explores the area of law known generally as "hospital liability," the duties and responsibilities a hospital owes to its patients, and the theories under which a hospital may be held liable, including negligence; lack of informed consent and/or informed refusal; unauthorized treatment which may lead to a cause of action for battery; breach of privacy for the unauthorized release of a patient's medical record; and breach of contract. This almanac also discusses the responsibility of the hospital for the actions of its employees, including physicians, residents, interns, nurses, hospitals, mental health professionals, anesthesiologists, and other persons who provide medical care. This almanac examines the elements necessary to prove the various theories of liability that support a prima facie hospital malpractice claim, the defenses to such claims, the litigation procedures unique to medical malpractice, the responsible parties and apportionment of liability, and the damages recoverable. The Appendix provides applicable statutes, resource directories, and other pertinent information and data. The Glossary contains definitions of many of the terms used throughout the almanac.

Book excerpt: Georgia Legal Research is the first book of its kind devoted to the resources and strategies needed to research Georgia state law. Taking a process-oriented approach, the book explains research in Georgia cases, statutes, legislative history, constitutional law, and administrative law and legal ethics research. Additional chapters describe the research process, secondary sources and practical guides, online research and citators. Appendices include legal citation rules, bibliography of legal research texts, and a list of Georgia practice materials. Georgia Legal Research was designed specifically for teaching legal research to first-year law students. Others who will find it helpful include practitioners, paralegals, librarians, college students, and even laypeople. It is clearly written, making even complex ideas accessible. Outlines of the research process and short excerpts from Georgia resources make the book easy to use. Web addresses point researchers to the many sources for finding free Georgia legal material online. Concise explanations of resources needed for researching federal law and the law of other states are provided throughout. Thus, Georgia Legal Research can be used as a stand-alone text or in conjunction with a research text concentrating on federal law. This book is part of the Legal Research Series, edited by Suzanne E. Rowe, Director of Legal Research and Writing, University of Oregon School of Law.

Download or read book The American Law of Slavery 1810 1860 written by Mark Tushnet and published by Princeton University Press. This book was released on 2019-02-19 with total page 273 pages. Available in PDF, EPUB and Kindle. Book excerpt: In an examination of Southern slave law between 1810 and 1860, Mark Tushnet reveals a structured dichotomy between slave labor systems and bourgeois systems of production. Whereas the former rest on the total dominion of the master over the slave and necessitate a concern for the slave's humanity, the latter rest of the purchase by the capitalist of a worker's labor power only and are concerned primarily with economic interest. Focusing on a wide range of issues that include contract and accident law as well as criminal law and the law of manumission, he shows how Southern slave law had to respond to the competing pressures of humanity and interest. Beginning with a critical evaluation of slave law, the author develops the conceptual framework for his own perspective on the legal system, drawing on the works of Marx and Weber. He then examines four appellate court cases decided in three different states, from civil-law Louisiana to commonlaw North Carolina, at widely separated times, from 1818 to 1858. Professor Tushnet finds that the cases display a continuing but never wholly successful attempt at distinguish between law and sentiment as modes of regulating social interactions involving slaves. Also, the cases show that the primary method of accommodating law and sentiment was an attempt to use rigid categories to confine the law of slavery to what was thought its proper sphere. Mark Tushnet is Professor of Law at the University of Wisconsin. Originally published in 1981. Download or read book Florida Legal Research written by Suzanne E. Rowe and published by . This book was released on 1998 with total page 238 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book bridges the gap between typical legal research texts and the needs of beginning legal researchers for concise explanations of the sources they will use early in their careers. A unique feature of this book is its emphasis on the sources a Florida attorney would use to do state and federal research. Many research texts, in contrast, emphasize federal materials and include illustrations taken from a variety of federal and state jurisdictions. The book is not, however, a bibliography of Florida sources. Instead, it combines an overview of essential primary and secondary sources with an introduction to research methods that will enable a novice researcher to move beyond the sources described in the text. Moreover, its emphasis on developing a research process and analyzing the results of legal research makes it appropriate even tot those who might not be practicing or working in Florida.
