Book excerpt: Given the impact that successive court rulings have had on the organisation of the sports movement in the past 15 years, the autonomy of non-governmental sports organisations has become a highly topical concern in Europe. It is also closely related to the issue of governance, the subject of previous Council of Europe studies. The Enlarged Partial Agreement on Sport (EPAS) decided to explore the concept of autonomy in greater depth by studying the conceptual, political, legal, economic and psycho-sociological aspects of the subject. This study was carried out at the request of the EPAS by the Swiss Graduate School of Public Administration (IDHEAP) on the basis of a questionnaire sent to public authorities in charge of sport and to national and international umbrella sports organisations. In addition to an analysis of the data obtained, documents produced by public authorities and sports organisations on this emerging issue are presented. This study contributes to a better understanding of the concept of autonomy and offers a clear picture of the issues involved.

Book excerpt: Medical devices that are deemed to have a moderate risk to patients generally cannot go on the market until they are cleared through the FDA 510(k) process. In recent years, individuals and organizations have expressed concern that the 510(k) process is neither making safe and effective devices available to patients nor promoting innovation in the medical-device industry. Several high-profile mass-media reports and consumer-protection groups have profiled recognized or potential problems with medical devices cleared through the 510(k) clearance process. The medical-device industry and some patients have asserted that the process has become too burdensome and is delaying or stalling the entry of important new medical devices to the market. At the request of the FDA, the Institute of Medicine (IOM) examined the 510(k) process. Medical Devices and the Public's Health examines the current 510(k) clearance process and whether it optimally protects patients and promotes innovation in support of public health. It also identifies legislative, regulatory, or administrative changes that will achieve the goals of the 510(k) clearance process. Medical Devices and the Public's Health recommends that the U.S. Food and Drug Administration gather the information needed to develop a new regulatory framework to replace the 35-year-old 510(k) clearance process for medical devices. According to the report, the FDA's finite resources are best invested in developing an integrated premarket and postmarket regulatory framework.

It also shows how systemic circumstances and the interests of powerful states, either belonging to the EU (France, Germany, and Poland) or having a significant say in European security architecture (the US), establish opportunities and constraints for the small states to shape European strategic autonomy. In particular, the study focuses on the diverging interests of the Baltic states (Estonia, Latvia, and Lithuania), Belgium, Denmark, Greece, Hungary, and the Netherlands. It demonstrates that, in most cases, European strategic autonomy is perceived not as an alternative to NATO but as a supplementary element that could facilitate the development of national military capabilities, indigenous defence industries and resilience to non-military threats. Ultimately, the book suggests that national approaches towards European strategic autonomy mainly stem from pragmatic national security and foreign policy considerations, while largely ignoring grand strategic ideas. This book will be of much interest to students of European politics, security studies, and international relations. Book excerpt: This Review sets out to propose a structure for the funding arrangements for the whole spectrum of health research, with the objective of obtaining the maximum benefit from research success and, where possible, eliminating duplication of effort. The Review found, however, that the UK is at risk of failing to reap the full economic, health and social benefits that the UK's public investment in health research should generate. There is no overarching UK health research strategy to ensure UK health priorities are considered through all types of research and there are two key gaps in the translation of health research: (i) translating ideas from basic and clinical research into the development of new products and approaches to treatment of disease and illness; (ii) implementing those new products and approaches into clinical practice.The Review also found that the wider funding arrangements for supporting translation of ideas from conception to practice could be more coherent or comprehensive and, where arrangements exist, they do not function well. The Review identified cultural, institutional and financial barriers to translating research into practice in the publicly funded research arena. But it also found that, in the private sector, the pharmaceuticals industry is facing increasing challenges in translating research into health and economic benefit. The Review has sought to make recommendations that will increase the translation of R&D into health and economic benefit for the UK, both in the public and private sectors. The Review recommends that the Government should seek to achieve better coordination of health research and more coherent funding arrangements to support translation by establishing an Office for Strategic Coordination of Health Research (OSCHR).

These stories do more than recount adventures of children living away from home. They tell an American story of family and national identity. In narratives from the seventeenth to the early twentieth century, adoption functions as narrative event and trope that describes the American migratory experience, the impact of Calvinist faith, and the growth of democratic individualism. The roots of literary adoption appear in the discourse of Puritan settlers, who ambivalently took leave of their birth parent country and portrayed themselves as abandoned children. Believing they were chosen children of God, they also prayed for spiritual adoption and emulated God's grace by extending adoption to others. Nineteenth-century adoption literature develops from this notion of adoption as salvation and from simultaneous attachments to the Old World and the New. In domestic fiction of the mid-nineteenth century, adoption also reflects a focus on nurture in childrearing, increased mobility in the nation, and middle-class concerns over immigration and urbanization, assuaged when the orphan finds a proper, loving home. Adoption signals fresh starts and the opportunity for success without genealogical constraints, especially for white males, but inflected by gender and racial biases, it often entails dependency for girls and children of color. A complex signifier of difference, adoption gives voice to sometimes contradictory calls to origins and fresh beginning; to feelings of worthiness and unworthiness. In writings from Cotton Mather to Edith Wharton, it both replicates and offers an alternative to the genealogical norm, evoking ambivalence as it shapes national mythologies.

At the core of this controversy stands the temporal dimension of self-defence: when and for how long can a state defend itself against an armed attack? Can it resort to armed force before such an attack occurs? Is anticipatory action covered by the rules of self-defence or should it be treated as a different concept? This book examines whether anticipatory action in self-defence is part of customary international law and, if so, under what conditions. The pre-Charter concept of anticipatory action is demarcated and then assessed against post-Charter state practice. Several instances of self-defence – both anticipatory and remedial – are examined to elucidate the rules governing the temporal dimension of the right. The Six-Day War (1967), the Israeli bombing of an Iraqi reactor (1981), the US invasion of Iraq (2003) and other instances of state practice are given thorough attention.
