Book excerpt: El volumen se ocupa de la transposición de la directiva comunitaria 99/44/CE en el ordenamiento italiano y, en forma especial, se analiza el concepto de conformidad derivado de la Convención de Viena y su aplicación en la directiva sobre las garantías en la venta a los consumidores. Es tratado el ámbito de aplicación de la directiva, limitada a las ventas entre consumidores y profesionales, así como en el ámbito objetivo. Se resaltan las diferencias entre la regulación contenida en el código civil italiano y en el código de consumo, que entró en vigor en el 2005, y es analizada la obligación de conformidad del bien al contrato, en la óptica de la responsabilidad del vendedor. También se analiza los remedios que el consumidor puede accionar en caso de defecto de conformidad, con particular atención al sistema jerárquico introducido con la transposición de la directiva y el remedio del resarcimiento de los daños, este último regulado por las normas del código civil italiano. Finalmente, son estudiadas la acción de regreso, el término de garantías que es es fijado a los dos años de la entrega del bien y la diferencia entre garantía legal de conformidad debida por el vendedor y la garantía convencional agregada que puede ser emitida por el vendedor, sino también por el productor o por otro sujeto y que no tiene límites de tiempo definidos por ley, siendo dejadas a la discrecionalidad del sujeto que la concede.-- Contracubierta.

Is this the outcome of divine planning or simply of the laws of physics? Ancient Greeks and Romans famously disagreed on whether the cosmos was the product of design or accident. In this book, David Sedley examines this question and illuminates new historical perspectives on the pantheon of thinkers who laid the foundations of Western philosophy and science. Versions of what we call the "creationist" option were widely favored by the major thinkers of classical antiquity, including Plato, whose ideas on the subject prepared the ground for Aristotle's celebrated teleology.
