Partiendo de la idea que el negocio aleatorio es solo una species, del más amplio fenómeno aleatorio, la investigación apunta, en primer lugar, a delinear las características de la categoría del contrato aleatorio, para luego proporcionar, donde exista, la noción jurídica de alea. La doble perspectiva – alea y contrato aleatorio – no subsiste solo para verificar si la presencia del alea constituye un requisito esencial del supuesto aleatorio, cuya carencia debe ser sancionada con la nulidad, sino también para establecer las normas que regulan la relación aleatoria. De hecho, parte de la doctrina considera la exclusión de los mecanismos regulatorios de la justicia contractual como rasgo esencial del contrato aleatorio, inaugurando una perspectiva de investigación diferente y más amplia: delinear las características propias del evento aleatorio con respecto a meros sucesos sobrevenidos, que inciden y alteran el equilibrio contractual. En ausencia de una definición positiva del contrato aleatorio, el intérprete, a fin de trazar los elementos esenciales, debe partir de la exégesis de la única disposición que regula un convenio expresamente calificado como aleatorio por el legislador: art. 1472, inc. 1º del Codice civile, en materia de emptio spei. Así, después de haber delimitado en positivo el contrato aleatorio, parece más sencillo demostrar que el alea es un fenómeno mucho más amplio e idóneo para describir una pluralidad casos diferentes, comúnmente llamadas aleatorias, debido a la heterogeneidad de los intereses en juego.

Book excerpt: This study examines the use of one category of prefabricated language (restricted lexical collocations) in native and non-native academic English in the social sciences, in an attempt to throw light on a neglected aspect of learner competence. It first surveys the existing theoretical viewpoints on word combinations and then reviews experimental research into the psycholinguistic processing of prefabricated language, which suggest that the role of conventional expressions is to facilitate fluent production and rapid comprehension. A computer-based corpus of native academic writing is analysed to discover to what extent and how such collocations are used in formal written English. Conventionality of style, it is suggested, aids precision of expression, clearly a quality highly valued in academic argument. A corpus of non-native writing is then subjected to a similar analysis. While the collocational errors learners make do not on the whole seriously destroy intelligibility, they can lead to a lack of precision and obscure the clarity of expression required in academic communication. Pedagogical implications are then considered, and it is seen that for the most part published teaching materials have failed to recognize the nature of collocations in general and offer little help. The final part of the study examines the treatment of restricted collocations in both general and phraseological dictionaries for learners. These are evaluated on their selection and presentation of collocations shown by the preceding research to be problematic for advanced learners. The conclusion suggests that, for such learners, who are mostly studying the language independently, good reference works are needed in the form of specialist collocational dictionaries. The results of this research help to establish principles for the design of such dictionaries.

The main focus of The Legal Order is the notion of institution, which Romano considers to be both the core and distinguishing feature of law. After criticising accounts of the nature of law centred on notions of rule, coercion or authority, he offers a compelling conception, not merely of law as an institution, but of the institution as ‘the first, original and essential manifestation of law’. Romano advances a definition of a legal institution as any group who share rules within a bounded context: for example, a family, a firm, a factory, a prison, an association, a church, an illegal organisation, a state, the community of states, and so on. Therefore, this understanding of legal institutionalism at the same time provides a ground-breaking theory of legal pluralism whereby ‘there are as many legal orders as institutions’. The acme of a jurisprudential current long overlooked in the Anglophone environment (Romano’s work is highly regarded in France, Germany, Spain and South America, as well as in Italy), The Legal Order not only proposes what Carl Schmitt described as a ‘very significant theory’.
