Das Internet erlaubt einen unmittelbaren Kontakt des Produzenten und des Rezipienten von Wissen und lasst so die Rolle von Informationsmittlern in neuem Licht erscheinen. Diese Veranderungen stellen vor allem fur die Schutzrechte eine Herausforderung dar, die wie das Patent der Innovationsforderung oder wie das Urheberrecht der Forderung der kulturellen Vielfalt dienen. Der vorliegende Band enthalt die Vortrage, die am 22. und 23. Mai 2009 auf einer Tagung an der Universitat Bayreuth zu diesem Thema gehalten wurden. Die Beitrage behandeln die Veranderungen der Innovationslandschaft aus interdisziplinarer Sicht, die Verbreitung von Wissen in der Informationsgesellschaft und die aktuellen Herausforderungen fur das Patent- und Urheberrecht. In einem Bericht werden die Ergebnisse der Podiumsdiskussion zum Thema aOpen Access zusammengefasst.

Die konventionelle Sicht geht davon aus, dass durch die alleinigen Verwertungsrechte eines innovativen Produktes Anreize geschaffen werden, neue innovative Produkte zu schaffen, und somit der Wohlstand einer Gesellschaft gefördert wird. Die dadurch entstehende Beschränkung des Wettbewerbs gilt als notwendiges Übel eines langfristigen Expansionsprozesses. So können diese Schutzmaßnahmen auf der einen Seite Anreize und Erleichterungen schaffen, um neue Märkte zu erschließen, aber auch neue Innovationen hemmen und durch eine befristete Monopolstellung Ineffizienzen hervorrufen. Im Besonderen gilt dies für Märkte, in denen sehr schnell neue Innovationen auf vorherigen Innovationen aufbauen wie z.B. in der Softwareindustrie. Die zunehmende Nutzung des Internets hat den Schutz geistigen Eigentums vor neue Herausforderungen gestellt. Denn digitalisierte Produkte wie Bücher, Software oder Musik, die im Internet publiziert werden, können ohne Qualitätsverlust kopiert werden. Da das Kopieren häufig anonym und mit geringem Kostenaufwand möglich ist, haben Urheber, und im Besonderen die Verwertungsindustrie, Druck auf den Gesetzgeber ausgeübt, die Gesetzte den sich ändernden Umständen anzupassen. So werden zunehmend Aufwendungen betrieben, bestehende Produkte technisch und gesetzlich vor Wettbewerbern zu schützen, anstatt diese Anstrengungen in die Weiterentwicklung zu investieren. Dies wird in der Ökonomie als rent-seeking1 bezeichnet. Gegenwärtig mehren sich die kritischen Stimmen, die den Trend zum stärkeren2 Schutz geistigen Eigentums für ökonomisch schädlich halten. Gerade ein hoch interaktives und dynamisches Umfeld wie das Internet zeigt Charakteristika, dass der Schutz geistigen Eigentums dem eigentlichen Ziel - Förderung der Innovationskraft einer Volkswirtschaft - entgegenwirkt und die Gefahr von Fehlanreizen verstärkt. Dies zeigt sich nicht nur in den durch die befristeten Monopole entstehenden Wohlfahrtsverlusten, sondern auch in verschiedenen Blockadestrategien vieler Rechteinhaber. Ziel dieser Arbeit ist es, zu analysieren, ob nicht auch ohne staatliche Intervention alleine der Vorsprung, den der erste Benutzer einer Innovation besitzt, genügt, private und unternehmerische Investitionen in Forschung und Entwicklung bzw. in Kreativität zu belohnen und dadurch langfristig höherer Wohlstand einer Gesellschaft [...]

In this respect, the various efforts that have been made in the past to come to harmonization of this area of law and the reasons that they were only partially successful are reviewed. In addition, the International and European regulations that refer to unfair competition, like, e.g., the Paris Convention, the TRIPs and the recent 2004 Unfair Commercial Practices Directive are discussed. Also an overview is given of the unfair competition laws in the United Kingdom, Germany and the Netherlands with respect to the 'problem-areas' of slavish imitation, misleading advertising, denigrating one's competitor, trade secrets and finally, misappropriation of valuable trade assets.
