Available in PDF, EPUB and Kindle. Book excerpt: In 1968 a theory of social equity was developed and put forward as the "third pillar for public administration, with the same status as economy and efficiency as values or principles to which public administration should adhere. Considerable progress has been made in social equity in the past 20 years. Theoretically, the works ofRawls and Rae and associates provide a language and a road map for understanding the complexity of the subject. The courts were especially supportive of principles of social equity in the later years of Chief Justice Earl Warren and during the years of Chief Justice Warren Burger. The present period, marked by the leadership of William Rehnquist, evidences a significant drawing back from the earlier commitment to equity. The decisions of state courts, based upon state constitutions and the common law, hold considerable promise for advancing social equity principles. Scholarly research demonstrates the belief of the American people in fairness, justice, and equality and their recognition of the complexity of the subject and their ambivalence toward competing claims for equality. Research on public administration finds that bureaucratic decision rules and the processes of policy implementation tend to favor principles of social equity.

Download or read book When Race Counts written by John Edwards and published by Routledge. This book was released on 2005-06-29 with total page 270 pages. Available in PDF, EPUB and Kindle. Book excerpt: When Race Counts investigates the use of race-conscious practices in social policy in Britain and America. It questions the distinction between affirmative action and preferential treatment, and evaluates the effectiveness of a range of education and employment policies designed to counteract both unintended and direct discrimination against ethnic minorities. The book uses both empirical and moral analyses to examine the controversial dilemma of whether and in what circumstances preferential treatment may be used as a means of improving the condition of minority groups. John Edwards looks at justifications for overriding the merit principle, particularly in employment, and shows who bears the costs of such a policy, and where the benefits lie. He argues that the merit principle is in itself so flawed that to override it would cause no great damange to justice. He then sets out the requirements of an acceptable policy of minority preference tailored to the disadvantages of specific minority groups.

Download or read book Elusive Equality written by Susan Gluck Mezey and published by Lynne Rienner Publishers. This book was released on 2003 with total page 336 pages. Available in PDF, EPUB and Kindle. Book excerpt: All men may be created equal in the United States - but more than 30 years after Congress proposed the Equal Rights Amendment, can the same be said for women? Elusive Equality offers a clear understanding of how government institutions - the executive branch, Congress, and state legislatures, as well as the federal courts - affect the legal status of women. Surveying the judicial and public policy issues central to the identification - and protection - of women's rights, Susan Mezey traces the developing legal parameters of gender equality. From early court rulings that prohibited employment discrimination and sexual harassment through today's decisions on reproductive rights and same-sex relationships, Mezey analyzes the broader political context within which critical judicial decisions have been made.
