Book excerpt: The implementation of the Marine Living Resources Act 18 of 1998 which governs fisheries management in South Africa is guided by a series of objectives. Chief amongst these are the need to ensure resource sustainability, promote economic growth and achieve equity in the fishing industry. Striking a balance among these competing imperatives is a necessary but also monumental task, one which South Africa has arguably failed to achieve to date. In particular, as far the equity objective is concerned, a group of fishers, including both subsistence and artisanal fishers, have continued to be marginalised and overlooked in the fishing rights allocation process. The Policy for the Small-Scale Fisheries Sector in South Africa aims to provide recognition and redress to this sector of the fishing industry. It seeks to achieve this objective by adopting a community-based, co-management approach. The Policy accordingly envisages that fishing rights will be allocated to small-scale fishing communities and that these communities will become involved in managing fisheries together with government. This contribution reviews and critically analyses the scope of application of the Small-Scale Policy and the management approach adopted by the Policy, with a view to assessing its potential to achieve the objective of providing redress to the formerly marginalised groups of fishers. This analysis takes place against the backdrop of the significant resource constraints in the fisheries arena and the country's vision for its future economic development as described in the National Development Plan.

It can be anticipated that implementing the SSF Guidelines, whether at local, national, or regional levels, will be challenging. This will require policy intervention and innovation, along with contributions of civil society organizations and academia. Despite their importance, the region’s coastal and marine resources have been neither fully appreciated nor fully utilized. They are only now being recognized as being key to Africa’s potential prosperity. As the region grows, it has, in general, not taken adequate safeguards to protect these valuable resources. That is partly because some of the problems (pollution, for example) are regional and know no borders. All too often, short-term gains are made at the expense of the long term (overfishing, for example). However, national laws and institutional frameworks are necessary for good governance and can operate to support the implementation of national policy and international commitments, including on climate change. Indeed, Target 16.3 of the Sustainable Development Goals calls for the promotion of the rule of law, and the assurance of equal access to justice for all. This is both an important stand-alone goal and an enabling goal for the realization of the transformative 2030 Agenda for Sustainable Development‎. Furthermore, the Food and Agriculture Organization of the United Nations (FAO) sees appropriately designed, informed and responsive national legal and institutional frameworks as key to supporting the implementation of countries’ commitments under the 2015 Paris Agreement, as well as their Nationally Determined Contribution in the food, agriculture and natural resources sectors. Climate change presents multiple challenges and it cannot be addressed effectively in silos. Attention must be paid not only to specific agriculture sectors, but also to governance areas that are interconnected with agriculture, such as public spending and investment, social protection and rural development. Efforts should be coordinated with the engagement of civil society, including the legal profession, vulnerable groups and the private sector.This Study addresses the principal expressions of the food and agriculture sector (crops and livestock agriculture, forestry and fisheries), looking at the critical cross-cutting issues and their integration into agriculture law. It provides a comprehensive overview of the legal and institutional issues to consider when working towards preparing the agriculture sector for the challenges of climate change.
