It then analyzes the emergence, survival and fall of democracies and dictatorships in Latin America since 1900. Scott Mainwaring and Aníbal Pérez-Liñán argue for a theoretical approach situated between long-term structural and cultural explanations and short-term explanations that look at the decisions of specific leaders. They focus on the political preferences of powerful actors - the degree to which they embrace democracy as an intrinsically desirable end and their policy radicalism - to explain regime outcomes. They also demonstrate that transnational forces and influences are crucial to understand regional waves of democratization. Based on extensive research into the political histories of all twenty Latin American countries, this book offers the first extended analysis of regime emergence, survival and failure for all of Latin America over a long period of time.

Restorative justice is an innovative, participatory and inclusive reaction to crime that permits victims and offenders to engage in a communication process about the consequences of the offence. It looks to the future, actively involving parties to find, agree and implement ways to repair the harm. Restoring Harm analyses the restoration process from a psychosocial point of view and discusses the role of victim–offender mediation within such a process. It brings together literature from the fields of restorative justice, victimology and psychology, and shares original findings from victims who were interviewed in Belgium and Spain. This book not only offers descriptive findings but also provides a theoretical and comprehensive model that elucidates several possibilities for why victim–offender mediation may or may not play a role in victims’ processes of emotional restoration. These studies – undertaken by internationally renowned scholars and practitioners – examine the role of courts and similar bodies in administering the laws that pertain to the entitlements of marginalized communities, and address individuals' and organisations' access to institutions of justice: primarily, but not exclusively, courts. They raise broad questions about the commitment of the state to law and human rights as the principal framework for policy and executive authority, as well as the impetus to law reform through litigation. Offering insights into the difficulties of enforcing, and indeed of the will to enforce, the law, this book thus engages fundamental questions about value of engagement with the formal legal system for marginalized communities.

The main purpose of the Colloquium was to commemorate the publication in 1958 of the books La nouvelle rhétorique: Traité de l’argumentation, and The Uses of Arguments, by, respectively, C. Perelman/L. Olbrechts-Tyteca, and S. Toulmin. But another important goal was to take stock of the state of rhetoric and argumentation theory at the beginning of a new century. It was a unique event, without parallel in Portugal and worldwide - considering its theme and its aims -, which gathered some of the World’s most renowned rhetoric and argumentation theorists: Alan Gross, Douglas Walton, Erik Krabbe, Frans V. Eemeren, F. Snoeck Henkemans, Guy Haarscher, John Anthony Blair, Marianne Doury, Oswald Ducrot, Ruth Amossy. The book includes a variety of very important contributions to rhetoric and argumentation theory, ranging from those that naturally fall within the subject matter, to the areas of philosophy, linguistics, communication theory, education theory and law theory. The “art”, as it was called in the Medieval curricula, is no longer a discipline amongst others and has became, according to the view of some specialists and largely owing to Perelman and Toulmin influences, a “new paradigm” of rationality for our age, which auspiciously encompasses all fields of knowledge and culture. That is the case for nations that have never enjoyed a liberal political society, for nations that have advanced towards and then retreated from political liberalism, for nations that have recently shifted from authoritarian to liberal political systems, and for mature democracies facing terrorism and domestic conflict. This book tests for the contemporary world the proposition that lawyers are active agents in the construction of liberal political regimes. It examines the efficacy of a framework that postulates that legal professions not only orient themselves to a market for their services but can frequently be seen in the forefront of actors seeking to institutionalise political liberalism. On the basis of some 16 case studies from across the world, the authors present a theoretical link between lawyers and political liberalism having wide-ranging application over radically diverse situations in Asia and the Middle East, North and South America, and Europe. They argue that it is not the politics of lawyers alone but the politics of a 'legal complex' of legally trained occupations, centred on lawyers and judges, that drives advances or retreats from political liberalism, that political liberalism itself is everywhere in play, in countries with established democracies and those without liberal politics and that it is now clear that the legal arena is a central field of struggle over the shape of political power. The case studies presented here provide powerful evidence that the nexus of bar and bench in transitions towards or away from political liberalism is a force which has universal application.
