Book excerpt: This paper will provide an analysis of accountability and management of contractors on the battlefield regarding current operations in the Middle East and existing policies, regulations, and instructions associated with the issue. Contractors play an ever increasing role in the sustainment of our joint forces engaged in various phases of combat operations. Contractors support every service and every US government agency represented on the battlefield today. Contractor support has steadily increased as a result of the reduction of the US government logistical forces' footprint, the advanced technology of systems fielded to operational forces, and the duration of the operations in which forces are engaged. Therefore, operational commanders must have formalized administrative and operational control measures in place to account for contractors in the battle space, the efforts and agencies they are supporting, and their movement. Contractor management on the battlefield is complicated by the size and complexity of the joint and inter-agency operations the US government is currently engaged in, as well as, the future operations in which the government will likely be involved. This paper will review the roles and quantity of contractors on today's battlefield, as well as categorize the roles and missions of the different types of contractors. Additionally, a review of the military's and US government's methods of controlling contractors will be conducted. Finally, a review of current applicable law, policy, and doctrine pertaining to contractors on the battlefield will be conducted. The paper will conclude with recommendations for future directives and practices that can facilitate better joint and inter-agency management of contractors on the battlefield. At the end of the paper, potential further research topics concerning the details of the derivative issues associated with contractors and contracting support on the battlefield will be identified.

DOD defines “contingency operations” as small, medium, or large-scale military operations, while “base” activities include operating support for installations, civilian pay, and other costs that would be incurred, regardless of contingency operations. Congress separately appropriates amounts for base and OCO activities into the same appropriation accounts and directs how funds are to be spent by designating amounts in conference reports or explanatory statements accompanying the annual appropriations acts. This report (1) describes internal controls that selected DOD components use to separately account for OCO and base amounts during budget execution and (2) identifies and examines alternatives that Congress or DOD could use to separate funding for OCO and base activities.

While commanders and Joint and Army doctrine manuals place the responsibility for contractor accountability on the human resources staff element, Department of Defense (DOD) and Army guidance and other regulations assigns the responsibility and authority to enforce contractor personnel accountability on the battlefield to the logistics community. Contractor accountability has been in the past, and will continue to be in the future, an enormous challenge to commanders at all levels. As of September 30, 2009, DOD reported there were over 242,000 DOD contract personnel in the CENTCOM theater of operations. Contract support to military forces is not a new concept and neither are contractor accountability issues. Contractor support to overseas contingency operations is a critical element to the success of the military commander's operation. The increased reliance on contractor support presents many accountability challenges to the military force. Therefore, contractor personnel accountability on the battlefield clearly lies with the human resources community.

The range, complexity, and cost of construction vary (e.g., from concrete pads for tents to brick-and-mortar barracks). DOD funds the projects through MILCON or O&M appropriations. Base commanders can use O&M to fund lower cost projects. Senate Report 113-174 includes a provision for GAO to review issues related to military construction in the CENTCOM area of responsibility in support of contingency operations in Iraq and Afghanistan. GAO evaluated, among other things, the extent to which DOD has (1) tracked the universe and cost of all contingency construction projects in support of contingency operations there, (2) developed a process to determine the appropriate level of construction for MILCON-funded contingency construction projects, and (3) developed a process for reevaluating contingency construction projects when missions change.
