By providing more openness about its activities, the European Union tries to bring itself closer to its citizens. Transparency is considered one of the main methods to relieve the 'democratic deficit'. One way of increasing transparency is to grant citizens a right to access information. Another way is to actively publish information. Transparency is not an exclusive feature of European integration. On the contrary, inspiration for policies on access to information is mostly drawn from the sometimes longstanding experiences of the member states. Access to Information in the European Union provides for a detailed and useful overview of EC and member state legislation in the field of access to information, highlighting the similarities and differences between national legislation of different member states.

Data protection violations arise principally from internet-based activities, direct marketing and video surveillance, perpetrated by, for example, government bodies or financial and health institutions, research by the European Union Fundamental Rights Agency (FRA) shows. Those victimised seek redress primarily to ensure that similar violations do not recur. This FRA socio-legal project, which offers an analysis of the 28 EU Member States' data protection regimes and of interviews with relevant parties in 16 Member States, highlights the challenges people face when seeking such remedies. It finds that only a few are aware of their right to data protection and that there is a lack of legal expertise in the field. Those who do file complaints typically address their national data protection authorities, but these often suffer from a lack of resources and powers. The findings provide evidence to inform and contribute to the European Union's efforts to comprehensively reform and enhance the EU's data protection regime. -- EU Bookshop.

These are simple questions to ask, and the right to do so is enshrined in law, but getting answers to these questions was met by a raft of strategies which effectively denied citizens their rights. The book documents in rich ethnographic detail the manner in which these discourses of denial played out in the ten countries involved, and explores in depth the implications for policy and regulatory reform.

Columbia Law professor Anu Bradford argues the opposite in her important new book The Brussels Effect: the EU remains an influential superpower that shapes the world in its image. By promulgating regulations that shape the international business environment, elevating standards worldwide, and leading to a notable Europeanization of many important aspects of global commerce, the EU has managed to shape policy in areas such as data privacy, consumer health and safety, environmental protection, antitrust, and online hate speech. And in contrast to how superpowers wield their global influence, the Brussels Effect - a phrase first coined by Bradford in 2012- absolves the EU from playing a direct role in imposing standards, as market forces alone are often sufficient as multinational companies voluntarily extend the EU rule to govern their global operations. The Brussels Effect shows how the EU has acquired such power, why multinational companies use EU standards as global standards, and why the EU's role as the world's regulator is likely to outlive its gradual economic decline, extending the EU's influence long into the future.

Regulation 1049/2001 regarding public access to European Parliament, Council and Commission documents sets out a code for access to documents held by these institutions. It is the EU equivalent of the freedom of information regimes found in the UK and other states. The Commission has proposed a revision of this Regulation. This report highlights the extent to which the proposal would preclude disclosure both of documents submitted to courts in the course of litigation and documents arising in the course of investigations, even in the face of a strong public interest in disclosure. The Committee feels such an exclusion is, in principle, justified in respect of court documents where the court itself can make provision for disclosure. A controversial issue is how far confidentiality is required for formulating policy (particularly to ensure that policy makers receive frank and open advice) and for negotiating legislation. The report looks at the relevant provisions of the proposal, particularly in the light of recent judgments by the European Court of Justice, and highlights the differences in the approaches of the European Parliament and the Government. These documents should not be given absolute immunity from disclosure but should be protected subject to any overriding public interest. The Committee also concludes that the effect of the proposal to amend the rules on disclosure by the institutions of documents which they hold but which originate from Member States would significantly reduce the existing right of access.
