Book Public Access to Documents in the EU

Download or read book Public Access to Documents in the EU written by Leonor Rossi and published by Bloomsbury Publishing. This book was released on 2017-01-12 with total page 384 pages. Available in PDF, EPUB and Kindle. Book excerpt: All litigants before the General Court of the EU (GC), the Court of Justice of the EU (ECJ) or indeed before any EU body or agency will need to have full access to the documents held by the European Union. Though the legislation regulating the field, Regulation 1049/2001, has been in force for some time, it is a complex field for all would-be litigants. In this book the authors, both experienced practitioners in the area, clearly set out the documentation, access requirements and processes. They include a helpful glossary of terms, tables and appendices setting out the relevant legislation. This will be the seminal text for all practitioners who need to access documentation held by the EU.

Book Access to EU documents

Download or read book Access to EU documents written by Great Britain: Parliament: House of Lords: European Union Committee and published by The Stationery Office. This book was released on 2009-06-18 with total page 40 pages. Available in PDF, EPUB and Kindle. Book excerpt: Openness is an important principle on which the European Union is founded. Regulation 1049/2001 regarding public access to European Parliament, Council and Commission documents sets out a code for access to documents held by these institutions. It is the EU equivalent of the freedom of information regimes found in the UK and other states. The Commission has proposed a revision of this Regulation. This report highlights the extent to which the proposal would preclude disclosure both of documents submitted to courts in the course of litigation and documents arising in the course of investigations, even in the face of a strong public interest in disclosure. The Committee feels such an exclusion is, in principle, justified in respect of court documents where the court itself can make provision for disclosure. A controversial issue is how far confidentiality is required for formulating policy (particularly to ensure that policy makers receive frank and open advice) and for negotiating legislation. The report looks at the relevant provisions of the proposal, particularly in the light of recent judgments by the European Court of Justice, and highlights the differences in the approaches of the European Parliament and the Government. These documents should not be given absolute immunity from disclosure but should be protected subject to any overriding public interest. The Committee also concludes that the effect of the proposal to amend the rules on disclosure by the institutions of documents which they hold but which originate from Member States would significantly reduce the existing right of access.

Book Openness Transparency and Access to Documents and Information in the European Union

Download or read book Openness Transparency and Access to Documents and Information in the European Union written by and published by . This book was released on 2013 with total page 40 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Treaty of Lisbon updates the terms under which the principles of transparency and openness clarify the right of public access to documents in the European Union. This right is both a fundamental right of individuals and an institutional principle. The revision of Regulation (EC) No 1049/2001, which sets out the arrangements for this, is influenced, to a large extent, by the numerous interpretations from the Court of Justice of the European Union, particularly during the last five years. Observation of the practice followed by the EU institutions and the broad lines of the practices followed nationally indicate that EU law needs to undergo extensive revision, with the aim of both leveraging the case law experience acquired and bringing itself up to date.

Book Access to Information in the European Union

Download or read book Access to Information in the European Union written by Herke Kranenborg and published by ISBS. This book was released on 2005 with total page 146 pages. Available in PDF, EPUB and Kindle. Book excerpt: In the last 15 years, transparency has been one of the central themes in the European integration process. By providing more openness about its activities, the European Union tries to bring itself closer to its citizens. Transparency is considered one of the main methods to relieve the 'democratic deficit'. One way of increasing transparency is to grant citizens a right to access information. Another way is to actively publish information. Transparency is not an exclusive feature of European integration. On the contrary, inspiration for policies on access to information is mostly drawn from the sometimes longstanding experiences of the member states. Access to Information in the European Union provides for a detailed and useful overview of EC and member state legislation in the field of access to information, highlighting the similarities and differences between national legislation of different member states.

Book Secrecy and Openness in the EU

Download or read book Secrecy and Openness in the EU written by Tony Bunyan and published by . This book was released on 1999 with total page 110 pages. Available in PDF, EPUB and Kindle. Book excerpt: The third pillar of the European Union - Justice and Home Affairs - formalised the array of secret committees that had been established since the mid-1970s to coordinate the policies of the Member States on such issues as policing, immigration, asylum, drugs and terrorism. Yet the policies that were developed had fundamental implications for civil liberties and democratic rights. Both before and after the Maastricht Treaty the whole apparatus was outside the control of either national parliaments or the European Parliament, and was not within the jurisdiction of the European Court of Justice. However, the EU did adopt a procedure to apply for documents which opened the door for citizens to find out what had been decided. In this book Tony Bunyan analyses the emergence of this secret system and the challenges to it both through exposure and by campaigns to procure documents. Book jacket.

Book Official Secrets and Oversight in the EU

Download or read book Official Secrets and Oversight in the EU written by Vigjilenca Abazi and published by Oxford University Press. This book was released on 2019-04-09 with total page 223 pages. Available in PDF, EPUB and Kindle. Book excerpt: This monograph offers a uniquely comprehensive and in-depth legal account of official secrets in the European Union. It critically analyses their implications for oversight and fundamental rights. Based on forty interviews with practitioners and other stakeholders, it offers an understanding of the practices of official secrets and provides a critical and much-needed perspective on how parliamentary, judicial and administrative oversight institutions deal with access to classified material and the dilemma of oversight to concurrently ensure secrecy necessary for EU security policies and openness needed for democratic processes and fundamental rights. The book discerns shifts in institutional practice of oversight at the European Parliament and the Court of Justice of the European Union that disproportionately favour secrecy and the protection of classified documents while creating serious limitations to open democratic deliberations and access to justice, and delivers new insights on the EU's development as a security actor as well as its autonomy from Member States, showing how rules on official secrets were a means for the EU to gain more autonomy in external security cooperation.
