Han pasado diez años desde que Naciones Unidas bautizara al 2003 como el Año Internacional del Agua Dulce, y aunque no se sabe muy bien si tal dedicación ha servido en realidad para algo, sí es cierto que al menos se habló del tema, de su problemática específica, de la conservación de ríos y acuíferos, de las posibilidades de desarrollo, de los que tienen de sobra y a los que les falta. El agua dulce es un recurso realmente en peligro, sobre todo en determinados puntos calientes del planeta. Durante el último siglo se ha venido doblando el consumo de agua potable cada veinte años debido al crecimiento demográfico, pero sobre todo a los excesos de consumo de los países desarrollados. Más allá del derecho de los Estados al aprovechamiento de los recursos hídricos del Planeta, sobre una base de equidad y con una orientación de desarrollo sostenible, emerge hoy el derecho al agua de los ciudadanos del mundo como un derecho humano esencial vinculado al propio derecho a la vida.

Book excerpt: Latin America has been a complex laboratory for the development of international investment law. While some governments and non-state actors have remained true to the Latin American tradition of resistance towards the international investment law regime, other governments and actors have sought to accommodate said regime in the region. Consequently, a profusion of theories and doctrines, too often embedded in clashing narratives, has emerged. In Latin America, the practice of international investment law is the vivid amalgamation of the practice of governments sometimes resisting and sometimes welcoming mainstream approaches; the practice of lawyers assisting foreign investors from outside and within the region; and the practice of civil society, indigenous peoples and other actors in their struggle for human rights and sustainable development. Latin America and international investment law describes the complex roles that governments have played vis-à-vis foreign investors and investments; the refreshing but clashing forces that international organizations, corporations, civil society, and indigenous peoples have brought to the field; and the contribution that Latin America has made to the development of the theory and practice of international investment law, notably in fields in which the Latin American experience has been traumatic: human rights and sustainable development. Latin American scholars have been contributing to the theory of international investment law for over a century; resting on the shoulders of true giants, this volume aims at pushing this contribution a little further.

The research analyses the main sources of law and jurisprudence of each examined context, to understand the legal basis for the recognition of the human right to water, considering both the necessary protection of environmental aspects, as well as social and economic ones, fundamental for its full realisation. The analysis of normative and jurisprudential sources is supported by the examination of the most relevant doctrine.

The quest for the Sustainable City has until recently focused on the efficient use of resources with the application of technical advances giving rise to the definition of SMART Cities. The economic model emphasised however is still “linear” in the sense that the design and consumption follows the pattern of extraction of natural resources, manufacturing, product usage and waste disposal. The continuous growth of urban population has recently given rise to the emergence of a new model which responds better to the challenges of natural resource depletion as well as waste management. This model has been called the “circular economy”. The circular economy is a recent concept based on the reuse of what up to now has been considered wastes, reintroducing them into the productive cycle. The objective of the circular economy is to reduce consumption and achieve savings in terms of raw materials, water and energy, thus contributing to the preservation of resources in order to reach sustainable development. One of the most important of these resources is water which is becoming a scarce commodity in an ever expanding world whose population demands a better standard of living. Water is required for agricultural purposes as well as by industry, in addition to its use by the general population. The recycling of water is an essential component of the circular economy. There is no possibility for the success of a long term economic policy without addressing the problems of natural resources and environmental pollution, which will affect the reuse of materials and products. The current market economy based on a linear model from resource extraction, manufacturing, consumption and waste disposal, has not proved a long term suitable solution, in spite of the substantial efforts made in reducing its environmental impacts. This is largely due to the continuous population growth, in a society that demands high standards of living, thus requiring an ever increasing share of natural resources.
