This book was released on 2017-09-17 with total page 628 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from A Treatise on the Law of Public Contracts The method by which I proceeded, wherever this was possible, was to state the general principle affecting the particular subject in hand, then to state the subsidiary principles or exceptions to the rule, and lastly to illuminate these, when possible, by appropriate illustrations. In the examination of thousands of cases I have selected these best illustrating the text and have not attempted to weigh down the footnotes by excessive citation. With very few exceptions every case cited is a public contract case. The work does not include the subject of governmental or municipal bonds. Book excerpt: Excerpt from A Treatise on the Law of Extraordinary, Industrial and Interstate Contracts Many works on contracts now before the public are classics, but they do not treat the subjects of contract of paramount importance to the welfare of the people. So, to meet this demand, among other things of vital interest, it has been the endeavor to present the industrial side of this all-important subject. In developing this work it was found that interstate contracts, of necessity, must be discussed; so it was deemed advisable to review concisely interstate contracts. The author has also cited the leading articles on like ques tions found in the legal magazines, to illustrate the views of jurists on controverted points. The author takes this opportunity to thank the profession, both lawyers and judges, for the cordial reception of his former works, and hopes that this treatise will be received in the same friendly spirit. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Addison on Contracts, Vol. 1: Being a Treatise on the Law of Contracts The excellence of the work of Mr. Addison as a legal writer is too well established to need one word of commendation from me. His treatise upon the Law of Torts is standard authority in all of our courts, and is more often cited than any other book upon the subject. This work was prepared by him with the same care as that bestowed upon Torts, and it has always been regarded by myself as the most thorough, exhaustive, and practical work upon the subject known to the profession. I have used it almost entirely dur ing my practice, and have always found it accurate, reliable, and practical. There is but little difference in the law relating to contracts as administered in the courts of England and this country, and this work will be found as useful to American as to English lawyers. Book Selected Cases on the Law of Contracts Classic Reprint

Download or read book Selected Cases on the Law of Contracts Classic Reprint written by Ernest W. Huffcut and published by Forgotten Books. This book was released on 2018-02-08 with total page 800 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Selected Cases on the Law of Contracts The arrangement of topics follows that of Sir William Anson in his Principles of the English Law of Contracts, whose general plan has served as a model for some other treatises on the subject. This case book, however, covers some topics not dealt with in his book; and some that are treated there are not included here. Two chap ters appearing in the former editions of this book, namely, Capacity of Parties, and Impairing the Obligation of Contract, are omitted in this edition, as these are topics which are commonly discussed in the courses on Persons and Constitutional Law in the usual law school curriculum. In many of the cases the statement of facts has, for the sake of brev ity, been either re-written or abridged, without calling special attention to the matter. For the same reason, the practice, now common, of omitting unnecessary portions of the Opinions, has been followed; but such omissions are always indicated. In this as in the preceding editions, the principal text consists of American cases, although English cases are represented in the notes and in the discussions in the Opinions. Book A Treatise on the Law of Agency in Contract and Tort

Download or read book A Treatise on the Law of Agency in Contract and Tort written by George L. Reinhard and published by . This book was released on 2015-07-06 with total page 774 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from A Treatise on the Law of Agency in Contract and Tort: Including Special Chapters on Attorneys at Law, Auctioneers, Bank Officers, Brokers, Factors, Insurance Agents, Traveling Salesman, Public Agents and Officers, Master and Servant There is perhaps no branch of the substantive law which is the subject of more constant and rapid development and modification, not to say change, than that which governs the relation of principal and agent; for as Dr. Wharton truly says, "Agency is the creature of usage as established by the courts, and that usage can only be settled by cumulative rulings;" and usage, which is but the result of our habits of business and our methods of dealing, is as evolutionary as is the race itself. The demand of the present-day lawyer is for the book which presents the law in plain and concise form, supported by an abundance of the most recent and best-considered authorities. It has been the purpose of the author to make a succinct and intelligible exposition of the modern law of Agency as administered in this country and in England. While he has not sought to multiply authorities, he has made the notes sufficiently full to support the text, and also, by quoting liberally from the opinions of judges, to furnish illustrations of the questions involved. It has been the author's purpose to be accurate rather than original, realizing, from his experience at the bar, on the bench, and in the class-room, that the profession wants books to aid in the search for the law as it is, and not as the author thinks it should be. He has not hesitated, however, where the cases conflict, to give his own opinion as to what is the weight of authority, or the rule resting upon the more reasonable foundation, stating the reasons for his opinion. The first ten chapters of the work present the general principles and rules of the law of Agency. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books.
