In the accomplishment of that purpo, se, _ the author further stated that he had faithfully endeavored to give the law as it had been Settled by the authorities, rather than to present his own views. At the same time, he did not attempt to deny - what he supposed would be sufficiently ap parent - that he had written in full sympathy with all those restraints which the caution of the fathers had imposed upon the exercise of the powers of government, and with faith in the checks and balances 'of -our republican system, and in correct conclusions by the \g'enbral public sentiment, rather than in re liance upon a judicious, prudent, and just exercise of authority, when confided without restriction to any one man or body Of men, whether sitting in legislative capacity or judicial. In this sympathy and faith, he had written of jury trials and the other safeguards to personal liberty, of liberty of the press, and of vested rights; and he had also endeavored to point out that there are on all sides definite limitations which circumscribe the legislative authority, independent of the specific restrictions which the people impose by their State constitutions. Book excerpt: Washburn, the California Supreme Court nullified a law imposing an onerous tax only on Chinese immigrants and aimed at discouraging Chinese immigration. An 1885 lawsuit by Joseph Tape, a Chinese parent, challenging the exclusion of Chinese children from the public schools, led to an order admitting his child. An 1890 measure attempted to remove San Francisco's Chinese residents from Chinatown and ghettoize them in a less desirable part of the city - the first attempt by an American municipality to segregate its inhabitants on the basis of race. Ten years later, after the discovery of suspected cases of bubonic plague in Chinatown, an attempt was made to force the Chinese to be inoculated with an experimental antiplague vaccine. These measures, too, were challenged by the Chinese and eventually struck down in the courts.

The concept of the oceans and navigable waters as held in public trust is examined from its origins in the 17th century North Sea fisheries controversy with particular regard to the arguments by Selden and Grotius pertaining to State jurisdiction over oceans and marginal sea areas. Those arguments manifest an underlying common principle of navigational freedom reflected in the parallel public trust development of public rights to fishing and navigation as protected and preserved within the Royal Prerogative "jus publicum," The significance for the modern context is that the 1958 Geneva Conventions on the Law of the Sea, the 1982 United Nations Convention on the Law of the Sea and a myriad of other conventions now evidence an unstated but patent public trust in the communal responsibility of States within both the conventional and customary regime of the high seas, as well as in regimes for territorial seas and marginal sea areas as shared with extended coastal State jurisdictions. This book is intended to serve as a reference work for this somewhat arcane source of the Oceans Public Trust, and should prove a useful research source for those who study law of the sea.

In this thought-provoking book Gary Remer traces arguments for religious toleration back to the Renaissance, demonstrating how humanist thinkers initiated an intellectual tradition that has persisted even to our present day. Although toleration has long been recognized as an important theme in Renaissance humanist thinking, many scholars have mistakenly portrayed the humanists as proto-Englightenment rationalists and nascent liberals. Remer, however, offers the surprising conclusion that humanist thinking on toleration was actually founded on the classical tradition of rhetoric. It was the rhetorician's commitment to decorum, the ability to argue both sides of an issue, and the search for an acceptable epistemological standard in probability and consensus that grounded humanist arguments for toleration. Remer also finds that the primary humanist model for a full-fledged theory of toleration was the Ciceronian rhetorical category of sermo (conversation). The historical scope of this book is wide-ranging. Remer begins by focusing on the works of four humanists: Desiderius Erasmus, Jacobus Acontius, William Chillingworth, and Jean Bodin. Then he considers the challenge posed to the humanist defense of toleration by Thomas Hobbes and Pierre Bayle. Finally, he shows how humanist ideas have continued to influence arguments for toleration even after the passing of humanism&—from John Locke to contemporary American discussions of freedom of speech.
