Those who use volumes one and two are reminded that two more volumes will, in due time, appear treating of the different legal actions or remedies now in use, and that many matters which might have been presented in these volumes are reserved for presentation in them. Many, perhaps most matters, might be presented with equal appropriateness in the general chapter to which they relate, or in the chapter dealing with the particular action or remedy to which they are also related. If therefore they are not found in these volumes, the reader is besought to trust the revisers' statement that they are reserved for the other volumes. It certainly is their intention to include in the entire work all the principles and rules of practice and every important case applying to them. Another feature of the present edition is the addition of a very large number of forms. Besides those in volumes one and two, many more will appear in the two concluding volumes; in short, this edition will aim to give all the forms deemed most useful to the legal practitioner. But some things may be presumed. From the facts stated. Thus, if the case states the satisfaction of a mortgage, it will be presumed that the debt was extinguished.$5 Of course, the court cannot go outside of them in forming a decision.86 It is just as important that all the facts out of which the question arose should be stated, otherwise the court can render no decision.37 Should, therefore, the parties neglect to ascertain the sum for which the judgment is to be ren dered, the court ought not to proceed until the case is perfected. Troubat and wil liam W. Haly, two distinguished and learned members Of the Phila delphia Bar, was presented to the Profession in the year 1825, in one thin octave volume; a second volume appeared in 1829. It immedi ately took high rank as a professional text-book; and probably no gentleman has since been admitted to our Bar, who has not drawn from its pages his first knowledge Of the intricacies of Practice. In 1837, the same learned gentlemen favored the profession with a second edition, in two volumes. Shortly after the publication of this edition, Mr. Troubat retired from active practice, and Mr. Haly, at the time of his sudden and fearful death, on the 27th of December 1851, in the destructive fire, at Sixth and Chestnut streets, in the City of Phila delphia, had made great progress in the preparation of a third edition. The materials collected by Mr. Haly were placed in the hands of Dr. Francis wharton, the well-known legal writer, and by him the third edition was prepared for the press. This edition was enriched by the insertion of the manuscript notes of decisions of the present Chief Justice sharswood, then President Judge Of the District Court of Philadelphia. These valuable cases have been retained in the present edition, with the exception of a small number, which have been subsequently overruled, or rendered obsolete by legislation. Dr. Wharton'8 edition was published in 1853. The fourth edition, which appeared in the year 1867, was edited by the late asa I. Fish, Esq. A violent fire was raging a few steps from his home, and when he was last seen he was endeavoring to assist the tenant of a shop on the lower floor of the burning building to remove a portion of his goods. Immediately afterwards the rafters fell in, and when, in a few hours, the ruins were cleared away, the memorials that remained were enough only to justify the belief that his death must have been as instant as it was unwarned. He was a man of excellent professional acquire ments, of kindly manners, and of an open and genial temper, which never failed him in life, and which threw around his last melancholy hour a grace which will print his memory the more deeply in the breasts not only of his professional brethren, but of the hundreds who have drawn and may yet draw from this work their first acquaintance with the practice of the Pennsylvania Law. Perhaps the best monument that could be erected to his memory is the volumes which his first labors aided to construct, and his last efforts retouched.
