Book The Politics of Retribution in Europe

Download or read book The Politics of Retribution in Europe written by István Deák and published by Princeton University Press. This book was released on 2009-11-06 with total page 350 pages. Available in PDF, EPUB and Kindle. Book excerpt: The presentation of Europe's immediate historical past has quite dramatically changed. Conventional depictions of occupation and collaboration in World War II, of wartime resistance and post-war renewal, provided the familiar backdrop against which the chronicle of post-war Europe has mostly been told. Within these often ritualistic presentations, it was possible to conceal the fact that not only were the majority of people in Hitler's Europe not resistance fighters but millions actively co-operated with and many millions more rather easily accommodated to Nazi rule. Moreover, after the war, those who judged former collaborators were sometimes themselves former collaborators. Many people became innocent victims of retribution, while others--among them notorious war criminals--escaped punishment. Nonetheless, the process of retribution was not useless but rather a historically unique effort to purify the continent of the many sins Europeans had committed. This book sheds light on the collective amnesia that overtook European governments and peoples regarding their own responsibility for war crimes and crimes against humanity--an amnesia that has only recently begun to dissipate as a result of often painful searching across the continent. In inspiring essays, a group of internationally renowned scholars unravels the moral and political choices facing European governments in the war's aftermath: how to punish the guilty, how to decide who was guilty of what, how to convert often unspeakable and conflicted war experiences and memories into serviceable, even uplifting accounts of national history. In short, these scholars explore how the drama of the immediate past was (and was not) successfully "overcome." Through their comparative and transnational emphasis, they also illuminate the division between eastern and western Europe, locating its origins both in the war and in post-war domestic and international affairs. Here, as in their discussion of collaborators' trials, the authors lay bare the roots of the many unresolved and painful memories clouding present-day Europe. Contributors are Brad Abrams, Martin Conway, Sarah Farmer, Luc Huyse, László Karsai, Mark Mazower, and Peter Romijn, as well as the editors. Taken separately, their essays are significant contributions to the contemporary history of several European countries. Taken together, they represent an original and pathbreaking account of a formative moment in the shaping of Europe at the dawn of a new millennium.

Book Forgiveness and Retribution

Download or read book Forgiveness and Retribution written by Margaret R. Holmgren and published by Cambridge University Press. This book was released on 2012-03-12 with total page 311 pages. Available in PDF, EPUB and Kindle. Book excerpt: Forgiveness and Retribution: Responding to Wrongdoing argues that ultimately, forgiveness is always the appropriate response to wrongdoing. In recent decades, many philosophers have claimed that unless certain conditions are met, we should resent those who have wronged us personally and that criminal offenders deserve to be punished. Conversely, Margaret Holmgren posits that we should forgive those who have ill-treated us, but only after working through a process of addressing the wrong. Holmgren then reflects on the kinds of laws and social practices a properly forgiving society would adopt.

This book was released on 2006-05-08 with total page 323 pages. Available in PDF, EPUB and Kindle. Book excerpt: The contributions in this volume offer a comprehensive analysis of transitional justice from 1945 to the present. They focus on retribution against the leaders and agents of the autocratic regime preceding the democratic transition, and on reparation to its victims. Part I contains general theoretical discussions of retribution and reparation. The essays in Part II survey transitional justice in the wake of World War II, covering Austria, Belgium, Denmark, France, Germany, Hungary, the Netherlands, and Norway. In Part III, the contributors discuss more recent transitions in Argentina, Chile, Eastern Europe, the former German Democratic Republic, and South Africa, including a chapter on the reparation of injustice in some of these transitions. The editor provides a general introduction, brief introductions to each part, and a conclusion that looks beyond regime transitions to broader issues of rectifying historical injustice.

Book Punishment and Retribution

Download or read book Punishment and Retribution written by Leo Zaibert and published by Routledge. This book was released on 2016-04-15 with total page 237 pages. Available in PDF, EPUB and Kindle. Book excerpt: Discussions of punishment typically assume that punishment is criminal punishment carried out by the State. Punishment is, however, a richer phenomenon and it occurs in many contexts. This book contains a general account of punishment which overcomes the difficulties of competing accounts. Recognizing punishment's manifoldness is valuable not merely in contributing to conceptual clarity, but in that this recognition sheds light on the complicated problem of punishment's justification. Insofar as they narrowly presuppose that punishment is criminal punishment, most apparent solutions to the tension between consequentialism and retributivism are rather unenlightening if we attempt to apply them in other contexts. Moreover, this presupposition has given rise to an unwieldy variety of accounts of retributivism which are less helpful in contexts other than criminal punishment. Treating punishment comprehensibly helps us to better understand how it differs from similar phenomena, and to carry on the discussion of its justification fruitfully.

Available in PDF, EPUB and Kindle. Book excerpt: Christoph Menke is a third-generation Frankfurt School theorist, and widely acknowledged as one of the most interesting philosophers in Germany today. His lead essay focuses on the fundamental question for legal and political philosophy: the relationship between law and violence. The first part of the essay shows why and in what precise sense the law is irreducibly violent; the second part establishes the possibility of the law becoming self-reflectively aware of its own violence. The volume contains responses by María del Rosario Acosta López, Daniel Loick, Alessandro Ferrara, Ben Morgan, Andreas Fischer-Lescano and Alexander García Düttmann. It concludes with Menke's reply to his critics.
