Book excerpt: Excerpt from A Practical Treatise on the Law of Slavery The court observed that the term mulatto, as used in this state, was vague, and signified, in general, a person of mixed white and negro blood, in whatever proportions it might be mingled. The various distinctions which have obtained in the French and Spanish American colonies has not been adopted in this state. Harper J in delivering the opinion of the court, observed, that it seemed to be an error in the judge's charge to the jury, in stating, that a mulatto was the offspring of parents, one of whom was white, and the other black, and that he was disposed to think, that where the White blood predominated, the disqualifica tion ought not to attach. According to this instruction, we understand, that the child of a quadroon and a mulatto, according to the distinction in Louisiana, must be accounted white. Yet, I suppose, that even in Louisiana such a person would be called a mulatto It is certainly true, as laid down by the presiding judge, that every admixture of African blood with the European, or white, is not to be referred to the degraded class. It would be dan gerous and cruel to subject to this disqualification a person hearing all the features of a white, on account of some remote admixture of negro blood nor has the term mulatto, or person of color, I believe. From the cumbrous weapon, useful only in a narrow field, to which Coke and Gilbert were accustomed, it has, in more than one half of the United States, been fashioned into the ready instrument for the adjustment of all disputes, in regard to the ownership of personal property. In some of the states, Pennsylvania for instance, this improvement has been the result of time, operating upon early colonial customs, occasionally assisted by judicial legislation. In other states, indeed in most of the northern and western states, the law has been codified, and the improvements which experience suggested, introduced; the frame work of the action remaining unchanged. Determined at my outset in life to write a book, I was delighted when I hit upon the subject now before the reader - the Law of Vendors and. Purchasers. The title promised well, and many portions of the law had not previously been embodied in any treatise. Modern law treatises were indeed few at that period. When this work was announced for publication. Nearly the universal opinion was that it would be a failure, as the subjects to be considered were too multifarious for one treatise. Nothing dismayed, I laboured diligently, and, with the aid of Lincoln's Inn Library, in which a considerable portion of the book was written - for my own shelves were but scantily furnished I at length finished the work in its original shape. My courage then failed me. The expense of publication was certain; and success, I thought, more than doubtful; and it was not without some difficulty that I could be persuaded to refrain from committing the manuscript to the flames, and to join with a bookseller in incurring the risk of pub lishing it at half profit and loss, as it is termed. As soon as the book was printed, another bookseller bought my interest in the Edition, and thus relieved me from my obligations. The amount I received as the price of the Edition was small.
