Book excerpt: There is much current controversy over whether the rights to seeds or plant genetic resources should be owned by the private sector or be common property. This book addresses the legal and policy aspects of the multilateral seed management regime. First, it studies in detail the International Treaty on Plant Genetic Resources for Food and Agriculture (the Treaty) in order to understand and identify its dysfunctions. Second, it proposes solutions - using recent developments of the "theory of the commons" - to improve the collective seed management system of the Treaty, a necessary condition for its member states to reach the overall food security and sustainable agriculture goals. Redesigning the Global Seed Commons provides a significant contribution to the current political and academic debates on agrobiodiversity law and governance, and on food security and food sovereignty, by analyzing key issues under the Treaty that affect the design and implementation of regulatory instruments managing seeds as a commons. It also examines the practical, legal, political and economic problems encountered in the attempt to implement these obligations in contemporary settings. In particular, it considers how to improve the Treaty implementation by proposing ways for Contracting Parties to better reach the Treaty’s objectives taking a holistic view of the human-seed ecosystem. Following the tenth anniversary of the functioning the Treaty’s multilateral system of access and benefit-sharing, which is currently under review by its Contracting Parties, this book is well-timed to examine recent developments in the field and guide the current review process to design a truly Global Seed Commons.

Book excerpt: Community seed banks first appeared towards the end of the 1980s, established with the support of international and national non-governmental organizations. This book is the first to provide a global review of their development and includes a wide range of case studies. Countries that pioneered various types of community seed banks include Bangladesh, Brazil, Ethiopia, India, Nepal, Nicaragua, the Philippines and Zimbabwe. In the North, a particular type of community seed bank emerged known as a seed-savers network. Such networks were first established in Australia, Canada, the UK and the USA before spreading to other countries. Over time, the number and diversity of seed banks has grown. In Nepal, for example, there are now more than 100 self-described community seed banks whose functions range from pure conservation to commercial seed production. In Brazil, community seed banks operate in various regions of the country. Surprisingly, despite 25 years of history and the rapid growth in number, organizational diversity and geographical coverage of community seed banks, recognition of their roles and contributions has remained scanty. The book reviews their history, evolution, experiences, successes and failures (and reasons why), challenges and prospects. It fills a significant gap in the literature on agricultural biodiversity and conservation, and their contribution to food sovereignty and security.

Book excerpt: This program is focused on the development of appropriate technologies for countries which are extremely agrobiodiverse but have limited economic resources. Its function is to develop and transfer technology and provide the appropriate training for technical personnel from those Latin American countries signatories to the Treaty. The warm reception given to the tools and methodologies developed under the auspices of the CAPFITOGEN program in 2013, has meant that some countries targeted by the program have organized national workshops on their own initiative, financed by the most interested parties. At the same time, there has been interest from other countries and regions not initially targeted by the program, which have been asking for tools and transfer and training activities. Thus the program CAPFITOGEN is primed to function not only as a generator and facilitator of appropriate technology, but also as a model of transfer in itself. One of its most innovative aspects is the way in which it seeks to involve people who have developed scientific methodologies. They are invited to develop the tools provided by the program based on their methodologies and to carry out the technical training and transfer activities themselves. This model means that the program beneficiaries are guaranteed direct access to the scientists and developers in order to answer queries or discuss cases. At the same time, the scientists themselves benefit directly from the experiences and issues tackled by the technical experts from the national programs, an outcome with a positive impact on future investigations with a more focused application and better suited to meet real needs.

The Report draws on 92 reports from FAO member countries and five specially commissioned thematic background studies. The reporting countries are responsible for 96 percent of global aquaculture production. Finally, needs and challenges are assessed in the context of the findings from the data collected from the countries. Book excerpt: Demonstrating the shortcomings of current policy and legal approaches to access and benefit-sharing (ABS) in the Convention on Biological Diversity (CBD), this book recognizes that genetic resources are widely distributed across countries and that bilateral contracts undermine fairness and equity. The book offers a practical and feasible regulatory alternative to ensure the goal of fairness and equity is effectively and efficiently met. Through a legal analysis that also incorporates historic, economic and sociological perspectives, the book argues that genetic resources are not tangible resources but information. It shows that the existing preference for bilateralism and contracts reflects resistance on the part of many of the stakeholders involved in the CBD process to recognize them as such. ABS issues respond very well to the economics of information, yet as the author explains, these have been either sidelined or overlooked. At a time when the Nagoya Protocol on ABS has renewed interest in feasible policy options, the author provides a constructive and provocative critique. The institutional, policy and regulatory framework constitute "bounded openness" under which fairness and equity emerge.
