Piracy may be a marginal problem in itself, but the connections between organised piracy and wider criminal networks and corruption on land make it an element of a phenomenon that can have a weakening effect on states and a destabilising one on the regions in which it is found. Furthermore, it is also an aspect of a broader problem of disorder at sea that, exacerbated by the increasing pressure on littoral waters from growing numbers of people and organisations seeking to exploit maritime resources, encourages maritime criminality and gives insurgents and terrorists the freedom to operate. In this context, maritime terrorism, though currently only a low-level threat, has the potential to spread and become more effective in the event of political change on land. It is only by addressing the issue of generalised maritime disorder that the problems of piracy and maritime terrorism may be controlled in the long term.

Book excerpt: Unregulated or lesser regulated maritime spaces are ideal theatres of operation and mediums of transportation for terrorists, insurgents and pirates. For more than a decade, the Indian Ocean waters adjoining Somalia have been a particular locus of such activities, with pirates hijacking vessels, and Al Qaeda and Al Shabab elements travelling between Africa and the Arabian Peninsula, operating lucrative businesses and even staging deadly operations at sea. These operations and threats however, remain, by and large, understudied. Responses to the two threats have varied, highlighting the lack of cohesive regional and global institutions with the mandate and the capacity to address them. Those scholarly deliberations on Indian Ocean maritime security focus on piracy and armed robbery at sea, while their terrorist/insurgent counterparts have eluded sustained scrutiny. This volume will help close that gap by looking at both from the field in Somalia and Yemen, within broader frameworks of regional maritime security and port-state control, international maritime law and the ongoing search for maritime resources. The European, African and Middle Eastern case studies add salience to the regional and international complexity surrounding maritime security off the Horn of Africa. Each of the presentations was followed by a debate, with the 10 experts from five countries joining the group of international participants to discuss the issues raised together; the aim of the workshop being to facilitate awareness of the issues in NATO and affiliated countries. Representing a significant contribution to finding the way forward in maritime security, this book will be of interest to all those whose work involves them in countering piracy and the terrorist threat in the maritime environment.

This book drives to the heart of this proposal by reviewing in detail each phenomenon before asking how and under what circumstances pirates and maritime terrorists might combine forces. Murphy concludes that while piracy may be a marginal problem in itself, the connections between organised piracy, wider criminal networks and corruption on land on mean that it may undermine states and destabilise the regions in which it occurs. Furthermore, maritime criminality may disguise insurgent and terrorist activity and allow such actors greater freedom of manoeuvre. He contends also that many of the factors that encourage piracy and maritime terrorism overlap and moreover that these may also encourage and sustain the more generalised issue of maritime disorder that embraces a wide range of illegal activity. In this context Murphy suggests that maritime terrorism, although only a low-level threat currently, has the potential to spread and become more effective in the event of political change on land. Before this can happen, however, maritime terrorists and insurgents will have to overcome significant operational and technical problems and, above all, find a means of triggering a level of fear stemming from atrocities committed at sea similar to that resulting from attacks perpetrated on land if they are to achieve their political objectives.

Protecting the maritime infrastructure essential for this trade from terrorism is a major concern for the international community. This book originates from the NATO Advanced Research Workshop (ARW) Counter-Terrorism Lessons from Maritime Piracy and Narcotics Interdiction, held in Copenhagen, Denmark, in May 2019. Participants in the three-day workshop included policymakers, senior military officers, and academics from NATO member states, international organizations, and two partner nations: Colombia and Israel. Their extensive discussions focused on methods for protecting critical maritime infrastructure, such as ports, supplies, and personnel, from seaborne terrorist attacks. Presentations and roundtables also addressed the human and social factors that contribute to the defense against terrorism in the maritime domain. The book is divided into three sections: organized crime and narcotrafficking; maritime piracy; and terrorism, and aims to bridge the gaps between these three substantive areas of maritime security research. These have remained largely separate areas of research in the past, with the result that valuable maritime security lessons from counter-piracy and counter-narcotics operations have not been fully incorporated into counter-terrorism best practice. The book facilitates the transmission of lessons learned from counter-piracy and counter-narcotic operations to formulate recommendations for best practice and technological innovations to manage maritime terrorism, and will be of interest to all those working in the field.

Though the historical occurrence of such attacks has been limited, recognition that maritime vessels and facilities may be particularly vulnerable to terrorism has galvanized concerns. In addition, some plausible maritime attacks could have very significant consequences, in the form of mass casualties, severe property damage, and attendant disruption of commerce. Understanding the nature of maritime terrorism risk requires an investigation of threats, vulnerabilities, and consequences associated with potential attacks, as grounded both by relevant historical data and by intelligence on the capabilities and intentions of known terrorist groups. These risks also provide the context for understanding government institutions that will respond to future attacks, and particularly so with regard to the US civil justice system. In principle, civil liability operates to redistribute the harms associated with legally redressable claims, so that related costs are borne by the parties responsible for having caused them. In connection with maritime terrorism, civil liability creates that prospect that independent commercial defendants will be held responsible for damages caused by terrorist attacks. This book explores risks and U.S. civil liability rules as they may apply in the context of these types of attacks.

Related terrorist attacks on targets such as the USS Cole and MV Limburg also emphasized the vulnerability of ports, ships, containers and other maritime facilities worldwide, and dramatized a shift in terrorist focus towards soft targets and global trade. The threat of maritime terrorism is presently at a level higher than ever before. Measures to counter the growing terrorist threat to the shipping industry have been taken by the international community. The US Container Security Initiative (CSI) and the International Ship and Port Security (ISPS) Code developed by the United Nations are of particular significance. The theoretical framework for this thesis is based on the concepts of securitization and sovereignty. It focuses on this emerging area of high interest by analysing the events that have led to the global shipping industry's current preoccupation with security and the way in which unprecedented security measures have been implemented, despite differing threat perceptions and concerns over sovereignty. This study also examines some intrinsic factors within the shipping industry that make it particularly vulnerable to the threat of maritime terrorism. These include Flags of Convenience, inadequate legal accountability, evasive practices, existing criminal networks and poor regulatory environment.
