Book excerpt: The aim of this paper is to assess the impact of selected financial regulations on the share of private financing in higher education institutions (HEIs). The regulations increasing the stability of financing should be preferred by countries reducing the stable part of budgetary funds because their use can mitigate lower amount of available public funds and increase the private-source-financing at the expense of public-source financing. When universities have the right to utilize their property and freely dispose their assets, we can expect lower diversification and more public-origin financing. The predictions are based on the model tightly related to the portfolio theory of Markowitz, where risk-averse management of HEIs minimize the variance of the amount of available funds. These hypotheses are verified econometrically on data from 17 EU countries - members of OECD. The analysis covers the generalized linear model which explains the impact of selected financial regulations on the private financing of tertiary level education. The components of financial regulations are distinguished upon the investigation of primary legislation acts. Precisely, on the basis of the legal comparative study, we identify four financial regulations whose prevalence can spur the diversification of universities' financing and indirectly improve their financial stability. The estimation results suggest that three components are significant and explain the share of private funding in higher education sector. It should be stressed that two of them positively affect the share of non-public financing, and one is positive but slightly insignificant.

Book excerpt: The federal government's substantial fiscal investment in higher education recognizes that postsecondary education is a linchpin in the nation's social and economic strength. Through that support, the government helps ensure that colleges and universities continue to contribute broadly to the fabric of American society. To ensure prudent stewardship of federal support for higher education, the Department of Education is charged with developing procedures to carry out laws passed by Congress in regard to higher education and with overseeing institutional compliance. Institutions of higher learning recognize the important role regulations play in the oversight of federal investments. Over time, oversight of higher education by the Department of Education has expanded and evolved in ways that undermine the ability of colleges and universities to serve students and accomplish their missions. The compliance problem is exacerbated by the sheer volume of mandates—approximately 2,000 pages of text—and the reality that the Department of Education issues official guidance to amend or clarify its rules at a rate of more than one document per work day. As a result, colleges and universities find themselves enmeshed in a jungle of red tape, facing rules that are often confusing and difficult to comply with. They must allocate resources to compliance that would be better applied to student education, safety, and innovation in instructional delivery. Clearly, a better approach is needed. In 2013, a bipartisan group of U.S. Senators recognized that the pending reauthorization of the Higher Education Act (HEA) creates an opportunity to consider these issues in depth. They established a task force of college and university presidents and chancellors to study federal regulation of higher education broadly and identify potential improvements. Looking at the landscape of regulation of colleges and universities writ large, the Task Force on Federal Regulation of Higher Education identified a number of challenges that are particularly problematic. As described in Section II of this report, we concluded that many rules are unnecessarily voluminous and too often ambiguous, and that the cost of compliance has become unreasonable. Moreover, many regulations are unrelated to education, student safety, or stewardship of federal funds—and others can be a barrier to college access and innovation in education. Based on extensive discussions, consultations with experts, and site visits to campuses, the Task Force identified specific regulations that are of major concern to higher education institutions. Section III details those concerns, which include problematic financial responsibility standards, confusion and inconsistency in reporting requirements for campus crime, overreach in authorization of distance education programs, inefficient rules concerning verification of financial aid eligibility, counterproductive micromanagement of the accreditation process, and policies that result in consumers being inundated with information of questionable value.The Task Force also reviewed the processes by which higher education regulations are developed and implemented, and offers several specific ideas for improvement. Section IV outlines recommendations that include asking the Government Accountability Office to review the Department of Education's methodology for estimating institutional costs of compliance with regulations; the creation of clear “safe harbors” for institutional compliance; the recognition of “good faith” efforts to comply; and several proposals for better practices by the Department.

Book excerpt: In the "Higher Education Opportunity Act" of 2008, Congress charged the Advisory Committee on Student Financial Assistance with conducting a review and analysis of regulations affecting higher education to determine the extent to which regulations are overly burdensome and need to be streamlined, improved, or eliminated. Specifically, Congress suggested the Advisory Committee determine which regulations are "duplicative, no longer necessary, inconsistent with other federal regulations, or overly burdensome." Pursuant to this legislative mandate, the Advisory Committee took the following steps: (1) convened two review panels of individuals with relevant experience and knowledge to review the regulations under the "Higher Education Act" (HEA) and make recommendations for streamlining, improvement, or elimination; (2) developed and maintained a website to provide information on HEA regulations, including an area for the community to offer recommendations of regulations in need of streamlining; (3) held two public hearings designed to identify the most burdensome aspects of individual regulations and the overall regulatory system, as well as proposed improvements; (4) designed and conducted an anonymous and confidential web-based survey, which generated over 2,000 responses, to assess the higher education community's perceptions of regulatory burden; (5) specified a set of community-driven perceived problems and proposed solutions for both the individual regulations cited in the study and the overall system of regulation; and (6) validated the perceived problems and proposed solutions with over 100 volunteers from the higher education community. In addition, the Committee conducted numerous meetings, conference calls, and presentations throughout the study to solicit feedback and suggestions on regulatory burden. While extensive, these approaches have limitations, which are outlined in the Conclusions and Recommendations section (pages 47-49). The overarching finding is that the higher education community perceives the regulations under the HEA to be unnecessarily burdensome. More important, the majority view is that the specific regulations cited in the study can be improved without adverse effects on program integrity or student success. This view includes, as well, a strong sense that certain components of the overall, one-size-fits-all system of regulation under the HEA require improvement. Perhaps most important, the majority opinion is that improvements to individual regulations and the system will not only lower regulatory burden without adverse effects, but generate savings that can be used to expand student access and persistence. Based on these findings, the following recommendations are made--one legislative and one regulatory: (1) Congress should direct the Secretary of Education to convene at least two review panels of higher education representatives to provide advice and recommendations on the 15 regulations cited in this report and on the feasibility of alternative approaches to the current system of regulation, including the provision of regulatory relief based on performance indicators. Such panels should be incorporated as routine collaboration during retrospective reviews of regulations; and (2) The Secretary of Education should conduct an immediate review of the 15 regulations cited in this report, including an analysis of the feasibility of implementing the proposed solutions and identifying any adverse effects on program integrity, student success, and cost of compliance. The Advisory Committee strongly supports Executive Order 13563 of January 18, 2011, which states that regulatory systems must be based on the best available science, allow for public participation, and use the most innovative and least burdensome tools for achieving regulatory ends. Applying this philosophy and approach to the regulations under the HEA promises rewards for both institutions and students. By shifting public spending away from teaching grants and towards repayable tuition loans, the government believes higher education will receive the funding it needs whilst making savings on public expenditure. The reforms aim to deliver a more responsive higher education sector in which funding follows the decisions of learners and successful institutions are freed to thrive. Also, creating an environment in which there is a new focus on the student experience and the quality of teaching and in which further education colleges and other alternative providers are encouraged to offer a diverse range of higher education provision. The Government, through the Office for Fair Access (OFFA), will be introducing a National Scholarship Programme and will also increase maintenance grants and loans for nearly all students. New Technology Innovation Centres will also be rolled out followed by publication of an innovation and research strategy, exploring the roles of knowledge creation, business investment, skills and training.
