Book excerpt: "Piracy in the waters off the Horn of Africa (HOA) has become a multi-million dollar venture annually for modern day pirates because vessel ownership groups continue to pay ransoms. The seizing of cargo ships and ransom demands have harmful economic impacts to companies and countries. Piracy operations directly threaten U.S. interests and citizens, as displayed during a recent kidnap for ransom action that led to the deaths of four Americans. In addition, piracy affects global trade. Despite significant multinational counter piracy efforts, which has included U.S. agencies and military forces, merchant vessels continue to be pirated regularly. Piracy off the coast of Somalia exists largely because Somalia is a failed state with little to no rule of law or domestic law enforcement capability. The economic situation of the people living in Somalia is dire. A lack of viable employment opportunities, a shortage of arable land, continuing drought, and increasing competition from other nations fishing off the coast, have all affected the standard of living. The conventional wisdom is that the solution lies ashore; meaning the establishment of good governance and economic development in Somalia, but the international community has displayed no interest to engage in nation building. This thesis will describe the challenges and ineffectiveness of current multi-national counter piracy operations and discuss how the international community can best combat piracy in the HOA region from a maritime perspective. By reviewing how states have historically responded to piracy and examining international legal approaches, the author will propose a multi-tiered coalition-based naval force solution, which uses all the traditional advantages of naval power to eliminate piracy without resorting to nation building."--Abstract.

The study examines maritime piracy incident trends over the past few years and presents an explanation for the significant reduction of incidents in East Africa and offers a new approach in constructing a crime-reducing framework applicable to piracy, as well as other crime problems. The intent is to add relevance to the pursuit of social science research crime data collection and analysis using criminological theories (frameworks) and planning techniques for developing crime interdiction strategies that are useful to security practitioners and policy makers. Emphasis is on obtaining readily available data using recognized social science methods to analyze the maritime piracy crime phenomenon for planning and developing the strategies and actions that produce desired outcomes in support of crime reduction. This approach involves identifying appropriate tasks or actions to be taken to achieve the desired effects for each objective and subobjective. It includes an evaluation process of the most salient variables in order to produce assessments that will focus on measuring those actions that have the greatest impacts for generating the most favorable conditions in the environment (desired effects) that are conducive to achieving supporting subobjectives and overall objective (i.e., maritime piracy reduction). This approach creates a framework using selected crime theory elements for examining quantitative and qualitative data for planning counterpiracy actions through a dynamic planning and assessment process.

This book originates from the NATO Advanced Research Workshop (ARW) Counter-Terrorism Lessons from Maritime Piracy and Narcotics Interdiction, held in Copenhagen, Denmark, in May 2019. Participants in the three-day workshop included policymakers, senior military officers, and academics from NATO member states, international organizations, and two partner nations: Colombia and Israel. Their extensive discussions focused on methods for protecting critical maritime infrastructure, such as ports, supplies, and personnel, from seaborne terrorist attacks. Presentations and roundtables also addressed the human and social factors that contribute to the defense against terrorism in the maritime domain. The book is divided into three sections: organized crime and narcotrafficking; maritime piracy; and terrorism, and aims to bridge the gaps between these three substantive areas of maritime security research. These have remained largely separate areas of research in the past, with the result that valuable maritime security lessons from counter-piracy and counter-narcotics operations have not been fully incorporated into counter-terrorism best practice. The book facilitates the transmission of lessons learned from counter-piracy and counter-narcotic operations to formulate recommendations for best practice and technological innovations to manage maritime terrorism, and will be of interest to all those working in the field.

It remains a serious impediment to international maritime trade and a significant risk to seafarers. Bringing a criminological perspective to the subject, this book presents an analysis of Somali piracy by means of Routine Activity Theory and regulatory pluralism. Based on data from a range of sources, including published documents and in-depth interviews with representatives of industry, government, and international organisations, the study concludes that no one institution or policy will suffice to control Somali piracy. Accordingly, a number of different actors and institutions have a role to play in reducing the supply of motivated offenders, the vulnerability of prospective victims, and in enhancing guardianship. The book envisages a holistic counter-piracy program based on a pluralistic regulatory model that is sustainable within the region, and managed by the region, providing the best opportunity for both the immediate future, and for long-term success. Centuries ago, the British East India Company used a private navy against piracy in the same waters with much success. Yet since then, international law has evolved to more tightly regulate the use of force by civilians, and to afford greater protections to suspected pirates. Thus, the development of what are in effect private warships has presented numerous legal and regulatory problems. How can the companies that operate these vessels be effectively licensed? Under what circumstances should they be allowed to use lethal force? This book explains how regulators in industry and government have attempted to answer such questions, and highlights the remaining areas of uncertainty. It also addresses the economic factors that drive the struggle between pirates and anti-piracy forces. Of equal concern are operational considerations such as defensive tactics, logistics, and rules of engagement. The region faces an array of security challenges, both traditional and non-traditional. These include security of SLOCs, the problem of piracy, the possibility of renewed terrorism at and from the sea and the pervasive smuggling of people, narcotics and arms. The narrative of regional maritime security is also characterized by oscillating economic growth, growing military presence and a rapidly deteriorating ecological balance in the Indian Ocean. A stand-out feature of the IOR is the lack of correspondence between nations on issues concerning ‘security’. While using the high seas for trade, transportation of energy, major powers have tended to neglect the impact of the economic activities on the sea itself. In contrast, smaller regional countries and island states with developing economies have, at best, been able to use only those resources of the sea which are vital to their survival. As the challenges rise, the need to factor in and secure effective management of the Indian Ocean has turned into a compelling imperative. While governments and authorities grapple with complex issues trying to forge a coherent maritime policy, there is a growing recognition that unless solutions are found quickly, lives, livelihoods, and in some cases the very future of local populations could be at risk. This book contains a comprehensive overview of perspectives of some of the stakeholders in the Indian Ocean Region.
