Download or read book Code Wars written by Rebecca Giblin and published by Edward Elgar Publishing. This book was released on 2011-01-01 with total page 273 pages. Available in PDF, EPUB and Kindle. Book excerpt: 'With a combination of acute observation, close analysis and clear-headed honesty, Rebecca Giblin leads the reader to share her conclusion that there is no legislative, judicial, commercial or technical panacea for copyright infringement which P2P software facilitates, but that even now it is not too late to improve the manner in which the rights-owning and distribution sectors address the challenges that P2P poses.' Jeremy Phillips, Olswang, and Intellectual Property Institute, UK Code Wars recounts the legal and technological history of the first decade of the P2P file sharing era, focusing on the innovative and anarchic ways in which P2P technologies evolved in response to decisions reached by courts with regard to their predecessors. With reference to US, UK, Canadian and Australian secondary liability regimes, this insightful book develops a compelling new theory to explain why a decade of ostensibly successful litigation failed to reduce the number, variety or availability of P2P file sharing applications and highlights ways the law might need to change if it is to have any meaningful effect in future. A genuine interdisciplinary study, spanning both the law and information technology fields, this book will appeal to intellectual property and technology academics and researchers internationally. Historians and sociologists studying this fascinating period, as well as undergraduate and graduate students who are working on research projects in related fields, will also find this book a stimulating read.

Book The Logic of Congressional Action

Download or read book The Logic of Congressional Action written by R. Douglas Arnold and published by Yale University Press. This book was released on 1990-01-01 with total page 298 pages. Available in PDF, EPUB and Kindle. Book excerpt: Congress regularly enacts laws that benefit particular groups or localities while imposing costs on everyone else. Sometimes, however, Congress breaks free of such parochial concerns and enacts bills that serve the general public, not just special interest groups. In this important and original book, R. Douglas Arnold offers a theory that explains not only why special interests frequently triumph but also why the general public sometimes wins. By showing how legislative leaders build coalitions for both types of programs, he illuminates recent legislative decisions in such areas as economic, tax, and energy policy. Arnold's theory of policy making rests on a reinterpretation of the relationship between legislators' actions and their constituents' policy preferences. Most scholars explore the impact that citizens' existing policy preferences have on legislators' decisions. They ignore citizens who have no opinions because they assume that uninformed citizens cannot possibly affect legislators' choices. Arnold examines the influence of citizens' potential preferences, however, and argues that legislators also respond to these preferences in order to avoid future electoral problems. He shows how legislators estimate the political consequences of their voting decisions, taking into account both the existing preferences of attentive citizens and the potential preferences of inattentive citizens. He then analyzes how coalition leaders manipulate the legislative situation in order to make it attractive for legislators to support a general interest bill.

Book excerpt: For nearly four years, Arvind Subramanian stood at the centre of economic policymaking in India. Through the communication of big ideas and the publication of accessible Economic Surveys, he gained a reputation as an innovator. Through honest pronouncements that avoided spin, he became a figure of public trust. What does it entail to serve at the helm of the world's fastest-growing economy, where decision-making affects a population of more than a billion people? In Of Counsel: The Challenges of the Modi-Jaitley Economy, Arvind Subramanian provides an inside account of his rollercoaster journey as the chief economic advisor to the Government of India from 2014-18, succeeding Raghuram Rajan as captain of the ship. With an illustrious cast of characters, Subramanian's part-memoir, part-analytical writings candidly reveal the numerous triumphs and challenges of policymaking at the zenith, while appraising India's economic potential, health and future through comprehensive research and original hypotheses. Charged with the task to restructure an insecure and fragile economy, Subramanian's trusteeship has seen the country through one of the most hotly contested and turbulent periods of economic governance and policymaking in recent decades-from the controversial recall of 85 per cent of circulated currency during demonetization to a complete overhaul in taxation with the introduction of the GST. Subramanian also addresses the overleveraging of public-sector banks, the fraught links between the state and private sector ('stigmatized capitalism'), the changing relationship between the state and the individual, and the ever-pervasive, life-threatening issues surrounding climate change. Recognized as one of the Top 100 Global Thinkers according to Foreign Policy magazine, Arvind Subramanian's Of Counsel: The Challenges of the Modi-Jaitley Economy is a deep-dive into the man, the moments, the measures and the means.

Book Frivolous Lawsuits and Frivolous Defenses

Download or read book Frivolous Lawsuits and Frivolous Defenses written by Warren Freedman and published by Praeger Pub Text. This book was released on 1987 with total page 157 pages. Available in PDF, EPUB and Kindle. Book excerpt: Frivolous lawsuits and defenses are not frivolous matters. Many regard them as the root cause of the back-ups and malfunctions in the American judicial system. The effects of these suits have general public impact since courts are tax-supported and excessive settlements reach the consumer in the form of higher insurance premiums. Written by a practicing attorney, the book carefully defines frivolous or unjustifiable litigation, and then goes on to discuss such topics as medical and dental malpractice, abuse of process, malicious prosecution, wrongful civil proceedings, false arrest and/or imprisonment, and retaliatory action. The attorney's role in class actions suits is also covered. There are ample citations of case law which illustrate specific points and areas of frivolity. Finally, the book presents remedies and sanctions which are available to discourage these wasteful and harassing actions, many of which are supported by the American Bar Association.
