CHAPTER XVm THE RISE OF RAILROAD AND CORPORATION LAW It is a commonplace to remark that the effect of railroads upon the history of the United States has been profound. As Judge John F. Dillon has well said: "Marshall's judgments and our lines of railways and telegraph have done more than any other visible agencies in making and keeping us one united nation." It is, however, because of the notably marked influence which railroads and the doctrines of law growing out of the problems presented by them, have had upon the development of the American Bar and upon the legal history of the country, that a separate chapter may properly be devoted to this distinctive feature of the middle of the Nineteenth Century. The years 1830 to 1860 witnessed the creation and practical establishment of the law of railroads. The great Middlesex Canal Corporation, chartered in 1793, had been in successful operation in Massachusetts for many years. In 1825 came the completion of the Erie Canal in New York and the beginning of the Delaware and Hudson Canal in New Jersey. In the same year, 1825, however, Governor Levi Lincoln of Massachusetts in his message approving a canal from Boston to the Connecticut River suggested that he had "been assured that another mode, by railways, had been approved of in England," and, he added, "how far they would be affected by our severe frosts cannot be conjectured yet." He also stated that whether they were better than canals remained to be determined. on appeal by the Supreme Court of the United States in 1837.1 For twenty years before the actual operation of railroads, clear-visioned men had prophesied the certain success of this form of the application of steam power. Book The American Bar Association

Download or read book The American Bar Association written by James C. Carter and published by Forgotten Books. This book was released on 2019-01-17 with total page 34 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The American Bar Association: The Ideal and the Actual in the Law, the Annual Address Delivered by James C. Carter at the Thirteenth Annual Meeting, August 21, 1890 But, notwithstanding the extravagant manifestations of the ideal tendency, it is a highly useful attribute of our nature. It constitutes the true nobility of the individual man, and its activity marks a spiritual and progressive, as distinguished from a sensual and sliding, age. It is necessary indeed that it be stimulated, or restrained, according to the field of activity in which it operates, and the subject upon which it may be em ployed. The poet, the painter, the sculptor, the musical com poser may give it a free rein, but the statesman, the moralist, the jurist, must check and moderate it, and blend it with an exercise of those other faculties which deal with the world of matter and life, rather than with the realm of ideas. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Bench and Bar as Makers of the American Republic In discussing my subject I propose to refer briefly to the history of nations in order to indicate the influence which fundamental law necessarily has upon the permanence of nations. I shall argue that, to ensure permanence, a nation must be founded upon justice to the individual, liberty to every citizen and obedience to the law of God; and I shall indicate the part which Bench and Bar have taken in the formation and development of our national institutions. Centuries measure the lives of nations, as years measure the lives of men, and we must search the centuries to ascertain the conditions which have contributed to the downfall of nations no longer existent.
