Download or read book A Guide to Shipbuilding Contracts written by Albert Lazarus and published by . This book was released on 2021-04-16 with total page 106 pages. Available in PDF, EPUB and Kindle. Book excerpt: Having been involved in the shipping industry for more than 20 years in different roles, I have been wanting to publish a book on the complex subject of ship building contract. My association with Norwegian shipping companies who constantly upgraded their fleet of ships made the subject all the more interesting with first hand experience at various shipyards. The thought of the development taking place around the Indian coast and the Government of India focus on developing the maritime sector prompted me to write this book. This book guides on the various aspects of a ship building contract.

Book The Law of Shipbuilding Contracts

Download or read book The Law of Shipbuilding Contracts written by Simon Curtis and published by Taylor & Francis. This book was released on 2020-04-29 with total page 610 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Law of Shipbuilding Contracts examines the principles of English contract law as these apply to shipbuilding. The leading text on shipbuilding and marine construction, widely used by the global maritime community, this new edition is updated to account for the "long tail" effects of the global economic crisis on the sector. The authors provide expert analysis on the key shipbuilding contract forms, including sections dealing with agreements ancillary to the shipbuilding contract and ship conversion contracts, together with — for the first time — contracts for the construction of offshore oil and gas vessels and units. The new edition has been comprehensively updated, including commentary on recent High Court decisions on shipbuilding contracts and, in particular, associated refund guarantees. The contractual and legal consequences of global economic turbulence and the resultant increase in the number and size of disputes in the shipbuilding sector are discussed, alongside coverage of other contemporary regulatory and legal issues resulting from environmental pressures and the trend for "cleaner", more efficient tonnage. A comprehensive and authoritative resource, this book is essential reading for buyers and charterers of newbuilding tonnage, shipbuilders and offshore construction yards, shipbrokers, banks and other finance providers, lawyers and insurers working in the maritime and offshore oil and gas sectors, as well as students of maritime law.

Book The Law of Shipbuilding Contracts

Download or read book The Law of Shipbuilding Contracts written by Simon Curtis and published by CRC Press. This book was released on 2014-04-03 with total page 494 pages. Available in PDF, EPUB and Kindle. Book excerpt: This is the leading text on shipbuilding and marine construction, already widely used on a global basis by shipowners, shipbuilders and their commercial and legal advisers. It is now ten years since the last edition and much has changed in the world of shipbuilding since then, particularly in the period since 2008 which has seen numerous attempts by owners to renegotiate the prices and/or delivery dates of tonnage and an enormous increase in the level of “vessel rejection” and cancellation disputes. The Law of Shipbuilding Contracts examines the principles of English contract law as these apply to shipbuilding. This edition comments in detail upon the Shipbuilders’ Association of Japan Form but now contrasts this with the NEWBUILDCON from BIMCO in 2007 and the China Maritime Arbitration Commission Forms from 2011 where these are significantly different. It also includes sections dealing with agreements ancillary to the shipbuilding contract and conversion contracts. Overview of book: Since the last edition in 2002, China has become a major global exporter of newbuildings and new BIMCO shipbuilding contract form has been published. Although retaining the original format of commentary on the Japanese (SAJ) standard form shipbuilding contract, the new edition contrasts this with the BIMCO form and the recently published China Maritime Arbitration Commission (CMAC) form in order to provide a broad ranging analysis of this complex subject. The book details the principles of English contract law as these apply to international shipbuilding. It will, as in the previous editions, also include sections dealing with the guarantees and other agreements which support the shipbuilding contract and with ship conversion contracts Essential reading for: - Purchasers and charterers of newbuilding tonnage - Shipbuilders and offshore construction yards - Lawyers and insurers working in the maritime and offshore oil and gas sectors - Banks and other finance providers

Book excerpt: Ship Sale and Purchase is an essential working guide for anyone involved in the business of making ship sale contracts and also in the resolution of related disputes. It continues to be of great practical use, highlighting typical problems and tensions between the parties to ship sale contracts, as well as best practice. This sixth edition contains a clause-by-clause commentary on SALEFORM 2012, the latest edition of the highly successful Memorandum of Agreement for the Sale and Purchase of Ships, issued by BIMCO and the Norwegian Shipbrokers Association. Key differences with the previous SALEFORM are described in order to help all involved get up to speed. Recent case law is evaluated to highlight contractual issues that have arisen in recent years and a comprehensive description of the many ways in which the standard form provisions may be modified to suit the particular requirements of each transaction. It provides complete coverage on the subject by including a practical overview of two other ship sale contracts, the current (1999) edition of Nipponsale and the first edition (2011) of the Singapore Ship Sale Form.

Book The National Shipbuilding Research Program Guide to International Approval Processes for Commercial Ship Construction

Download or read book The National Shipbuilding Research Program Guide to International Approval Processes for Commercial Ship Construction written by and published by . This book was released on 1997 with total page 276 pages. Available in PDF, EPUB and Kindle. Book excerpt: You're on a business trip and, in a local store, you see a lamp that will look great in your den. You buy the lamp but not the light bulb, since you have many. On returning home, you screw a 40W bulb into the lamp, plug the lamp into the wall socket and turn it on. It works perfectly; you are indebted to National Standards. National Standards not only ensure that lamps work, our shoes fit, and this paper fits the photocopier, they also ensure that ships are built in the most cost effective way possible. National standards become a method of communication, so that a part's specification can be relayed between any vendor, to any engineer in any shipyard with the knowledge that the part is available, functional, and is competitive. NSNRP 6-94-1, Word Class U.S. Shipbuilding Standards was dedicated to establishing the framework for developing a set of U.S. National Standards that could compete with those from Japan, Korea, Western Europe and other World Class commercial shipbuilding countries. The aim of the project was not to create a new National Standards body but to assist those standards bodies, already established in the U.S., in publishing standards that are truly World Class. Definition: For the purposes of this report, the expression World Class means that a shipyard is capable of designing a VLCC (say) in 10 months and completing ship construction in 18 months from contract award realizing a profit in the process.

Book Design and Analysis of United States Navy Shipbuilding Contract Architecture

Download or read book Design and Analysis of United States Navy Shipbuilding Contract Architecture written by and published by . This book was released on 2015 with total page 95 pages. Available in PDF, EPUB and Kindle. Book excerpt: Contracting for US Navy ship procurement is complex due several factors such as budgetary and political concerns, sole or near sole source environments, and long lead-time construction. In the current climate of shrinking budgets, it is especially important to set programs up for financial success. One potential area for cost management improvement in acquisition programs is with the initial contract and incentive structure. If shipbuilding contracts could be described in engineering architectural terms, then perhaps that architecture could provide better clarity of contract options. Further, if contracting can be described as an engineering architecture, then perhaps that architecture could be optimized for a given result. These are the central questions of this thesis. To answer them, interviews were conducted with several experienced individuals from both industry and the government. Additionally, past shipbuilding contracts in both the US and Canada were examined. These insights were then used to form a contract architecture concept in accordance with the Tradespace engineering paradigm. From the concept definition came the design vector definition which included variables such as shareline definition, incentives, and contracted profit percentage. The tradespace was then populated by manipulating the design vector parameters. The Palisade tool [at]Risk was used to conduct the design vector manipulation and tradespace population. [at]Risk is an excel plug in that allows uncertain variables to be defined by probability distributions. The tradespace of contract outcomes was then evaluated against utilities such as cost, profit, and risk. Although the factors affecting the contracting environment are complex, and not all are modeled, quantitative modeling allows the architect to roughly evaluate different approaches, vice just basing the contract on past models. It also gives the government the ability to check whether shipbuilder furnished predicted costs are reasonable for a given contract structure.
