Book Social Economic and Environmental Policy Complementarity in the South African Mining Sector

Download or read book Social Economic and Environmental Policy Complementarity in the South African Mining Sector written by Sophie Plagerson and published by . This book was released on 2018 with total page pages. Available in PDF, EPUB and Kindle. Book excerpt: This paper considers the complementarity of social, economic and environmental policy in South Africa, using the mining sector as a case study. The mining sector has been chosen due to its unique position as a backbone of the South African economy, its historical significance and impact on social conditions, and its key role in shaping social policy. The paper considers policy complementarity as critical for social, economic and environmental development in order to achieve optimal redistributive outcomes, and develops an analytical framework for assessing policy complementarity through the dimensions of "autonomy", "alignment" and "adjustment". The paper assesses the policy complementarity of pre- and post-apartheid policy mandates; and the intersections between policy actors from the state, the mining industry, labour and civil society. This analysis finds that intersectoral policy connections are necessary, but not sufficient, for the achievement of optimal redistributive outcomes. While South Africa benefits from a robust intersectoral post-apartheid legislative and policy framework, and progress has been made in several areas, significant challenges remain as evidenced by the slow pace of legislative reform, institutionalized political corruption, low levels of trust between stakeholders, differing perspectives on the meaning of "transformation" and who is responsible for its attainment, and internal divisions in the labour sector. The paper concludes that three factors are of particular importance in promoting policy complementarity: the presence of multilateral platforms to accommodate dialogue and negotiation between stakeholders to develop the social pacts required for sustainable development; the retention of sectoral expertise within state structures to enable the effective intersectoral implementation of policy; and that policy be enshrined in legislation, protected and enforced by a strong court system.

Book Africa s Mineral Fortune

Download or read book Africa s Mineral Fortune written by Saleem H. Ali and published by Routledge. This book was released on 2018-08-20 with total page 310 pages. Available in PDF, EPUB and Kindle. Book excerpt: For too long Africa's mineral fortune has been lamented as a resource curse that has led to conflict rather than development for much of the continent. Yet times are changing and the opportunities to bring technical expertise on modern mining alongside appropriate governance mechanisms for social development are becoming more accessible in Africa. This book synthesizes perspectives from multiple disciplines to address Africa’s development goals in relation to its mineral resources. The authors cover ways of addressing a range of policy challenges, environmental concerns, and public health impacts and also consider the role of globalization within the extractive industries. Academic research is coupled with key field vignettes from practitioners exemplifying case studies throughout. The book summarizes the challenges of natural resource governance, suggesting ways in which mining can be more effectively managed in Africa. By providing an analytical framework it highlights the essential intersection between natural and social sciences, central to efficient and effective harnessing of the potential for minerals and mining to be a contributor to positive development in Africa. It will be of interest to policy makers, industry professionals, and researchers in the extractive industries, as well as to the broader development community.

Book Mining Africa Law Environment Society and Politics in Historical and Multidisciplinary Perspectives

Download or read book Mining Africa Law Environment Society and Politics in Historical and Multidisciplinary Perspectives written by Artwell Nhemachena and published by African Books Collective. This book was released on 2017-05-01 with total page 394 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is a pacesetter in matters of mining and the environment in Africa from multidisciplinary and spatio-temporal perspectives. The book approaches mining from the perspectives of law, politics, archaeology, anthropology, African studies, geography, human ecology, sociology, history, economics and development. It interrogates mining and environment from the perspectives of customary law as well as from the perspectives of Euro-modern laws. In this sense, the book straddles precolonial, colonial and postcolonial mining and environmental perspectives. In all this, it maintains a Pan-Africanist perspective that also speaks to contemporary debates on African Renaissance and to the unity of Africa. From scrutinising the lived realities of African miners who are often insensitively and unjustly addressed as illegal miners, the book also interrogates transnational mining corporations; matters of corporate social responsibility as well as matters of tax evasions by transnational corporations whose commitment to accountability to African governments is questioned. With both theoretical chapters and chapter based on empirical studies on mining and the environment across the African continent, the book provides a much needed holistic, one stop shop for scholars, activists, researchers and policy makers who need a comprehensive treatise on African mining and the environment. The book comes at the right time when matters of African mining and environment are increasingly coming to the fore in the light of discourses about the new 21st century scramble for African resources, in which big transnational corporations and nations are jostling to suck Africa dry in their race to control planetary resources. It is a book that speaks to contemporary broader issues of (de-)coloniality and transformation of African minds and African environmental resources.

Book Assessment of the Environmental Regulatory Framework of the Mining Sector

Download or read book Assessment of the Environmental Regulatory Framework of the Mining Sector written by Weltbank and published by . This book was released on 2012 with total page pages. Available in PDF, EPUB and Kindle. Book excerpt: In Nigeria, up to now mining activities have systematically escaped environmental control. In 1989, the Government of Nigeria issue the document "national policy on the environment", which was revised in 1999 in response to the advances in knowledge and the need of integrating development issues concerning all sectors of the economy. The new environmental policy goals followed the sustained development principles of conserving and using natural resources for the benefit of present and future generations, and ensure an adequate environmental quality for good health and well being of the population. Recognizing the sectoral potential to cause serious environmental degradation, strategies regarding the implementation of policy directives in mining development included mandatory preventive environmental impact assessment (EIA), minimization of environmental damages and risks, prescription of regulation and standards specific for mining wastes, and promotion of legal small-scale mining activities. None of them has yet been fully put into practice. Although the EIA decree has been in force since 1992, only a year ago a mining project has prepared an EIA study and applied for an environmental certificate. Development of environmental regulations, mining effluent and waste management standards have just been included as an activity of the SMMR Project, following the provisions of the Nigerian Minerals and Mining Law recently approved (February 2007).

Book Towards a One Environmental System in the Extractive Industries in South Africa

Download or read book Towards a One Environmental System in the Extractive Industries in South Africa written by Ntika Frans Maake and published by . This book was released on 2019 with total page pages. Available in PDF, EPUB and Kindle. Book excerpt: The One Environmental System (OES) is an agreement in terms of S 50 A (2) of NEMA and S 163 of NWA, between the Ministers in the DEA, DMR and DWS with respect to mining. It stated that NEMA is the principal Act in terms of which all the environment related aspects would be regulated; and the DMR will be the Competent Authority to issue environmental authorisations relating to all the mining activities and that DEA will be the appeal authority in relation to these authorisations. These departments agreed to synchronise and fix their periods for the approval of mining licenses to 300 days and that should there be an appeal it should disposed of within 90 days. It was introduced to eliminate the duplication of processes that were fragmented between the three departments as required by the relevant provisions of NEMA, MPRDA and NWA. DEA announced the 0́−8 December 20140́+, as its implementation date, whereas the Act, which introduced it (NEMLAA Act 25 of 2014), commenced on 2 September 2014. This contradiction regarding the implementation date of the OES has the unintended consequences of hindering the effective implementation of the OES Agreement in the mining industry; and is incongruous with the rule of law, and consequently the IIBP. These contradictions exacerbate the preposterous situation anent to legal and policy uncertainty in the extractive industry, hence SA is ranking low on the Fraiser Institute Annual Survey for Mining Companies on the Policy Perception Index and Investment Attractive Index. The DMR should urgently promulgate into law the MPRD Bill of 2013 into in order to improve legal certainty because mining is quintessence and backbone of the South African economy. SA¿̐ưs total value of known mineral reserves is estimated at approximately R20.3-trillion; and it is the world¿̐ưs fifth largest mining sector in terms of GDP value. The improvement of the approval process for an EA is congruent to the ambit of sustainable development, which was advocated by the apex court in the famous Fuel Retailers Association case, which promoted the adherence to S (24) of the Constitution. The successful implementation of the OES will amongst others achieve Environmental Justice to the mining induced communities who are exposed to unhealthy and hazardous environments because of the mining activities and consequently, their rights to a healthy environment are violated. The ultimate aim of this study is to contribute towards improving legal and policy certainty in the industry, because there is a correlation between the two and low inflow of Foreign Direct Investments in the SA mining sector. This study recommends that the presidency should ameliorate this situation by directly accessing the apex court in terms of S (167) (6) of the Constitution to seek an order to declare invalid and set aside the NEMALA regarding the OES¿̐ưS date of implementation. The CC will exercise its powers in terms of S 172 (1) (b) of the Constitution and grant the presidency an order to rectify the anomaly by promulgating the relevant regulations and then properly amend NEMLAA to rectify the implementation date of the OES. President Ramapohosa will be emulating his predecessor and icon Madiba, who acted accordingly regarding the date of implementation of the South African Medicines and Medical Devices Regulatory Authority Act, 132 of 1998. By so doing, the president will be putting into actions his Presidential slogan of 0́−Thuma mina/ Send me.0́+ The study will recommend that the DEA and not the DMR should be the competent authority to approve the EA in the mining industry. This is due to the patent evidence of competency and capacity deficit at DMR to deal with intricate environmental related issues. It will conclude by professing a further study regarding the introduction of Strategic Environmental Authorisations for the mining industry as well as an OES National Policy and Act.

Book The Balancing of Interests in Environmental Law in Africa

Download or read book The Balancing of Interests in Environmental Law in Africa written by Willemien Du Plessis and published by PULP. This book was released on 2011 with total page 698 pages. Available in PDF, EPUB and Kindle. Book excerpt: "Now that economic development is starting to pick up in many countries in Africa, the question arises how such development can be balanced with the need for adequate environmental protection. This crucial issue, inherent in the notion of sustainable development, is addressed in this innovative and path-breaking volume. For the first time, academics from seventeen African countries have joined forces to analyse the way in which economic and environmental interests are balanced in their legal systems. The authors all use a common framework to improve the comparability of the country studies. The different country-related chapters do not only provide insights into the formally applicable legal rules (law in the books), but given that the book brings together academics aware of the practice in Africa, they also describe the way in which environmental policy functions in practice (law in action). Many case studies, with conceptual analyses are provided of pollution incidents and the way in which administrative agencies or courts have on those occasions balanced the interests between the economy, society and the environment. A critical comparative analysis by the editors points at tendencies towards convergence and points of divergence between the African countries. Suggestions for policy reform are also formulated, showing African countries how they can benefit from experiences in the US and Europe. This thought provoking volume is a must for anyone (academic, policymaker or practitioner) interested in sustainable development generally and in Africa in particular."--P. [4] of cover.

Book Routledge Handbook of Natural Resource Governance in Africa

Download or read book Routledge Handbook of Natural Resource Governance in Africa written by Hany Besada and published by Taylor & Francis. This book was released on 2024-03-13 with total page 352 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Routledge Handbook of Natural Resource Governance in Africa provides a comprehensive analysis of African natural resource governance, stretching across the continent, and encompassing water, land, extractive resources, and mining. Africa’s natural resources are not only crucial for the continent from an economic, environmental, and political perspective, but they are also of significant geopolitical importance, with direct implication for meeting the global challenges outlined in the Sustainable Development Goals. Whether an abundance of natural resources proves to be a curse or a blessing depends on the nature, extent, and outcome of the effort and experience of an individual country in governing and managing such assets. It is with this in mind that this ground-breaking handbook brings together experts from across the field of natural resource development to reflect on the varied regime types and paradigms within the continent’s natural resource sectors, the specific challenges they face, and their role within global value chains. The book first considers governance for sustainable development and discourses of land and development financing, before going on to investigate the regulatory and policy impacts, and socioeconomic implications of natural resource management. Finally, the Handbook situates the African continent within the emerging global energy transition; examining trends in South-South cooperation, and new frontiers for the harnessing of critical tools in a sustainable future for natural resource governance and management. Overall, the Handbook’s in-depth analysis provides a unique blend of realism and optimism, highlighting the importance of building a new sustainable African resource narrative for shared prosperity. The handbook will be an essential read for researchers and policy makers with an interest in sustainable development and natural resource governance in Africa.
