Book excerpt: Excerpt from The Law of Patents for Inventions, 1837: Including the Remedies and Legal Proceedings in Relation to Patent Rights The subject of Patent Rights has become of great impor tance in the United States, on account of the number of persons interested in them, their influence on the progress of the useful arts, and the numerous judicial decisions relating to them. The exclusive privilege granted to inventors, by the act of 21 James I., c. 3, has, until within a few years past, been regarded with jealousy in English jurisprudence, as being a surviving branch of monopolies, all of which, excepting those for new manufac tures, were suppressed by that act. Patents have, however, been recently regarded with greater indulgence, by the English courts. In the United States they have always been fairly sustained, and patentees have been regarded with favor, as pioneers in the advancement of the productiveness of the national industry; and much light has been shed upon this branch of law by the elaborate opinions given by the most eminent judges in the national courts, particularly the late Chief Justice Marshall, and the other judges in the Supreme Court, and by Mr. Justice Washington in the Circuit Court for Pennsylvania, and Mr. Justice Livingston and Mr. Justice Thompson in that for New York. But it is no injustice to the other eminent jurists of the country to say, that this depart ment of law has been more especially indebted to the learning and talents of Mr. Justice Story, the records of whose indefati gable research and luminous expositions, will be found in many parts of this volume. At this distinguished stage of legal evolution, the existing patent statutes, together with the thousands of patent decisions which have been made by the Supreme Court, and by the lower Federal courts under its guidance, contain materials for a nearly complete and a beautifully symmet rical science of the subject. To the study of the laws thus embodied and developed, I have devoted enthusiastic efforts for twenty years; and during the last eighteen of those years, I have practiced in those laws, in fifteen of the United States. This edition of my book is a result of that experience, and of my careful revision and enlargement of the second edition, into accurate conformity with the present law. The differences between this edition and the second, are far more numerous and important than those between the second and the first. No book so old as the second edition, nor even one a year younger, can be a reliable guide through the patent laws of to-day; but it is not prob able that any development of those laws during any six years of the future, until Congress enacts a new system of patent statutes, will be nearly so extensive or important. Mr. Richards, now deceased, the original founder of' our firm, who was the author of the first edition of this booklet, was guided in his selection of the material herein by the questions most frequently propounded by clients, and endeavored to compile the law and prac tice with respect to these questions in a comprehensive, logical man ner, having in mind the necessity for brevity and conciseness. Practically all the matter contained herein is based directly upon the Revised Statutes, the Rules of Practice of the United States Patent Office and the decisions of the Courts and Commissioners of Patents. The author has purposely refrained from giving the citations of decisions and authorities, feeling that if the pamphlet were inter spersed with numerous citations, the impression might be made that it was intended for a complete treatise and many might be deterred from a reading thereof. In the progress of the division of labor, the employment of the greater part of those who live by labor, that is of the great body of the people, comes to be confined to a few very simple operations; frequently to one or two. But the under standings of the greater part of men are necessarily formed by their ordinary employments. The man Whose whole life is spent in performing a few simple Operations, of which the effects too, are perhaps, always the same, or very nearly the same, has no occasion to exert his understanding, or to exercise his invention in finding out expedients for removing difficulties, which never occur. He naturally loses, therefore, the habit of such exercise, and becomes as stupid and ignorant as it is possible for a human creature to become. The torpor of his mind renders him not only incapable of relishing or hearing a part in any rational conversation.
