Its object is to draw a correct and faithful picture of pioneer times in California, and thus expose the misstatements of itinerant lecturers and thoughtless or vicious writers, who seem to delight in wholesale misrepresentation of the habits and character of the first American settlers of this coast. The time has come when this matter should be discussed and set right; for the pioneers are fast passing away, and in a few short years not one will be left to contradict and expose the slanderous charges now constantly put forth against them. In the picture I have drawn, I have sought to avoid claiming for the pioneers one virtue not fairly theirs; nor have I attempted to conceal their errors. When speaking of individuals, I have tried to avoid undue praise or unjust censure. How far I have succeeded in making my picture a truthful representation, I leave my fellow pioneers to judge. The destinies of the great young States of the Pacific are fast passing into the hands of the children of the pioneers, and we, the parents, cheerfully resign our trust, feeling sure that the amor patriae with them is most heartfelt, and, burning brightly, will be "the pillar of fire by night and the cloud by day" to guide them onward, and ensure a great future to the States of their birth. In resigning our leadership, it ought to be our ambition that our children should honor our memory, and feel proud that they are the children of California and Oregon pioneers. It is this ambition that has prompted the writing of this volume. It is directly addressed to our young people; but I hope it will be found attractive and interesting to every American citizen, and especially so to all our pioneers, who, day by day, as the shades of evening fall on their path, and their numbers lessen, grow nearer and nearer to each other, and more and more attached to all the recollections of the days when, as a band of brothers they, with cheerful hearts, faced every danger, side by side, and aroused into life this whole Pacific Coast. If my fellow pioneers find that I have performed the task I assigned myself but indifferently, I hope they will at least credit a good intention and an earnest endeavor to the author. That distinguished individual himself was in his element, and in a most intense state of perspiration and excitement at the same time. About dark, we were startled by the loudest hurras, which arose at the sight of an army of India-rubber coats, (the rain was falling in riversfull, ) each one enshrouding a Rich Barian, which was rapidly descending the hill. This troop was headed by the "General," who - lucky man that he is - waved on high, instead of a banner, a live lantern, actually composed of tin and window-glass, and evidently intended by its maker to act in no capacity but that of a lantern! The "General" is the largest and tallest and - with one exception, I think - the oldest man upon the river. He is about fifty, I should fancy, and wears a snow-white beard of such immense dimensions, in both length and thickness, that any elderly Turk would expire with envy, at the mere sight of it. Don't imagine that he is a reveler; by no means; the gay crowd followed him, for the same reason that the king followed Madame Blaize, "because he went before." At nine o'clock in the evening, they had an oyster and champagne supper in the Humboldt, which was very gay with toasts, songs, speeches, etc. I believe that the company danced all night; at any rate, they were dancing when I went to sleep, and they were dancing when I woke the next morning. The revel was kept up in this mad way for three days, growing wilder every hour. Some never slept at all during that time. On the fourth day, they got past dancing, and, lying in drunken heaps about the bar-room, commenced a most unearthly howling; - some barked like dogs, some roared like bulls, and others hissed like serpents and geese. Many were too far gone to imitate anything but their own animalized selves. The scene, from the description I have had of it, must have been a complete illustration of the fable of Circe and her fearful transformations. Some of these bacchanals were among the most respectable and respected men upon the river. Many of them had resided here for more than a year, and had never been seen intoxicated before. It seemed as if they were seized with a reckless mania for pouring down liquor, which, as I said above, everything conspired to foster and increase. Of course, there were some who kept themselves aloof from these excesses; but they were few, and were not allowed to enjoy their sobriety in peace. Since our last, the whole matter has been submitted to the consideration of the Board after having been elaborately argued by counsel of eminence. Under these circumstances, it would not perhaps be proper to go into an examination of the laws which govern the case. The briefs of the council on each side have been published, well crowded with citations of authorities. The brief of Horace Hawes Esq., shows evidence of a patient investigation and untiring industry that have left nothing to chance. Yet there is little new to the bar or bench in these briefs; and there is in Mr. H.'s, an assumption of ignorance on the part of the Board and of the bar in general, which is anything but complimentary. It might have been assumed without any very grave error, that the Board had stumbled upon at least the alphabet of the Spanish law; and that the opposing counsel, in the coarse of their investigations, had heard of a book called Leyes de las Indias. However, for the reasons stated, we shall not discuss the law; in fact, in our view, all the law, that is necessary to decide this case, can be found without difficulty - is known to all lawyers - and admits of no discussion. It is astonishing, that men who ought to know the facts, and also swear that they do know them, should contradict each other so flatly.
