Book excerpt: When state voters passed the California Marriage Protection Act (Proposition 8) in 2008, it restricted the definition of marriage to a legal union between a man and a woman. The act's passage further agitated an already roiling national debate about whether American notions of family could or should expand to include, for example, same-sex marriage, unmarried cohabitation, and gay adoption. But how do Americans really define family? The first study to explore this largely overlooked question, Counted Out examines currents in public opinion to assess their policy implications and predict how Americans' definitions of family may change in the future. Counted Out broadens the scope of previous studies by moving beyond efforts to understand how Americans view their own families to examine the way Americans characterize the concept of family in general. The book reports on and analyzes the results of the authors' Constructing the Family Surveys (2003 and 2006), which asked more than 1,500 people to explain their stances on a broad range of issues, including gay marriage and adoption, single parenthood, the influence of biological and social factors in child development, religious ideology, and the legal rights of unmarried partners. Not surprisingly, the authors find that the standard bearer for public conceptions of family continues to be a married, heterosexual couple with children. More than half of Americans also consider same-sex couples with children as family, and from 2003 to 2006 the percentages of those who believe so increased significantly—up 6 percent for lesbian couples and 5 percent for gay couples. The presence of children in any living arrangement meets with a notable degree of public approval. Less than 30 percent of Americans view heterosexual cohabitating couples without children as family, while similar couples with children count as family for nearly 80 percent. Counted Out shows that for most Americans, however, the boundaries around what they define as family are becoming more malleable with time. Counted Out demonstrates that American definitions of family are becoming more expansive. Who counts as family has far-reaching implications for policy, including health insurance coverage, end-of-life decisions, estate rights, and child custody. Public opinion matters. Gaps such as these can be seen in the complex relations between the state and religion in Israel and Turkey, and more specifically in their policies on marriage. This line of investigation is interesting both theoretically and empirically, as despite their poles apart policies, Israel and Turkey share a similar pattern of institutional dynamics. Existing explanations for this phenomenon suggested either civil society-based arguments or intra-institutional dynamics, as reasons for the maintenance of such gaps. This book enriches our understanding of policy dynamics in democratic systems by introducing a third line of argument, one that emphasizes the effective role state institutions play in maintaining such arrangements for long periods, often against the public will.

George Beam argues that all survey research instruments, all types of asking-including polls, face-to-face interviews, and focus groups-produce unreliable and potentially inaccurate results. Because those who rely on survey research only see answers to questions, it is impossible for them, or anyone else, to evaluate the results. They cannot know if the answers correspond to respondents' actual behaviors (objective phenomena) or to their true beliefs and opinions (subjective phenomena). Reliable information can only be acquired by observation, experimentation, multiple sources of data, formal model building and testing, document analysis, and comparison. It does so against the background of local governments in majority Muslim regions across Indonesia promoting and passing regulations that mandate forms of social or economic behaviour seen to be compatible with Islam. The book situates the political construction of Islamic behaviour in West Sumatra, and in Indonesia more generally, within an historical context in which rulers have in some way engaged with aspects of Islamic practice since the Islamic kingdom era. The book shows that while formal local Islamic regulations of this kind constitute a new development, their introduction has been a product of the same kinds of interactions between international, national and local elements that have characterised the relationship between Islam and politics through the course of Indonesian history. The book challenges the scholarly tendency to over-emphasise local political concerns when explaining this phenomenon, arguing that it is necessary to forefront the complex relationship between local politics and developments in the wider Islamic world. To illustrate the relationship between transnational and local Islam, the book uses detailed case studies of four domains of regulation: Islamic finance, zakat, education and behaviour and dress, in a number of local government areas within the province.
