Book Multilateral Regulation of Investment

Download or read book Multilateral Regulation of Investment written by E. Nieuwenhuys and published by Kluwer Law International B.V.. This book was released on 2001-06-13 with total page 254 pages. Available in PDF, EPUB and Kindle. Book excerpt: In the wake of the notable failure of the OECD draft Multilateral Agreement on Investment (MAI), it has become clear that any attempt to regulate investment at the global level must pay serious attention to the position of developing countries. This remarkable collection of essays sheds penetrating light on this and other legal, political, and economic issues affecting the intense international debate on this important subject. The result of a symposium sponsored in April 1999 by the E.M. Meijers Institute of Legal Studies at Leiden University, Multilateral Regulation of Investment presents the incisive views of nine outstanding authorities, both academics and practitioners, in disciplines related to investment and development. Among the essential criteria proposed for a successful global regulatory framework for investment are the following: involvement at the national level of all sectors of the economy in drafting a national position; involvement from the start of multilateral negotiations of both developing and developed countries; transparency of negotiations; balance between investment protection and the right to regulate; and respect for core labour standards and human rights. The authors agree in seeing the objectives of the multilateral regulation of investment, both direct and portfolio, as not only reducing risk but also enhancing trust between investors and states, as host states must be sure that foreign investors will genuinely contribute to sustainable development and the well-being of their populations.

Book Globalisation and the Rule of Law

Download or read book Globalisation and the Rule of Law written by Spencer Zifcak and published by Routledge. This book was released on 2004-08-02 with total page 262 pages. Available in PDF, EPUB and Kindle. Book excerpt: Globalisation and the Rule of Law reassesses the idea of the 'rule of law' within the present complex and increasingly internationalized environment. There have been many books studying the phenomenon of globalization and its economic, social or cultural consequences. This book, however, is the first to relate globalization exclusively to law. It examines the impact of globalization upon the rule of law, a fundamental value within liberal democratic sovereign states. The book opens with three chapters discussing the theory of the rule of law and its necessary reconceptualization in a global environment. Then, in three sections considering global trade, security and human rights, it proposes new ways of thinking about global law and its application in new and existing institutions of global governance. Contributors include top-flight academics, politicians and judges, making this book significant and relevant in both jurisprudential theory and political practice.

Book The Politics of Personal Law in South Asia

Download or read book The Politics of Personal Law in South Asia written by Partha S. Ghosh and published by Routledge. This book was released on 2012-05-23 with total page 353 pages. Available in PDF, EPUB and Kindle. Book excerpt: It is a political study of the controversy surrounding the issue of the uniform civil code vis-à-vis personal laws from a South Asian perspective. At the centre of the debate is whether there should be a centralized view of the legal system in a given society or a decentralized view, both horizontally and vertically. This issue is entangled within the threads of identity politics, minority rights, women’s rights, national integration, global Islamic politics and universal human rights. Champions of each category view it through their own prisms, making the debate extremely complex, especially in politically and socially plural South Asia. So, this book attempts to harmonize the threads of the debate to provide a holistic political analysis.

Download or read book The Politics of Religion in South and Southeast Asia written by Ishtiaq Ahmed and published by Routledge. This book was released on 2011-05-04 with total page 338 pages. Available in PDF, EPUB and Kindle. Book excerpt: The notion of a ‘politics of religion’ refers to the increasing role that religion plays in the politics of the contemporary world. This book presents comparative country case studies on the politics of religion in South and South Asia, including India, Pakistan and Indonesia. The politics of religion calls into question the relevance of modernist notions of secularism and democracy, with the emphasis instead on going back to indigenous roots in search of authentic ideologies and models of state and nation building. Within the context of the individual countries, chapters focus on the consequences that politics of religion has on inclusive nation-building, democracy and the rights of individuals, minorities and women. The book makes a contribution to both the theoretical and conceptual literature on the politics of religion as well as shed light on the implications and ramifications of the politics of religion on contemporary South Asian and South East Asian countries. It is of interest to students and scholars of South and South East Asian Studies, as well as Comparative Politics.

Book Law Religion and Tradition

    Book Details:
  • Author : Jessica Giles
  • Publisher : Springer
  • Release : 2018-09-27
  • ISBN : 3319967495
  • Pages : 203 pages

Download or read book Law Religion and Tradition written by Jessica Giles and published by Springer. This book was released on 2018-09-27 with total page 203 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book explores different theories of law, religion, and tradition, from both a secular and a religious perspective. It reflects on how tradition and change can affect religious and secular legal reasoning, identifying the patterns of legal evolution within religious and secular traditions. It is often taken for granted that, even in law, change corresponds and correlates to progress – that things ought to be changed and they will necessarily get better. There is no doubt that legal changes over the centuries have made it possible to enhance the protection of individual rights and to somewhat contain the possibility of tyranny and despotism. But progress is not everything in law: stability and certainty lie at the core of the rule of law. Similarly, religions and religious laws could not survive without traditions; and yet, they still evolve, and their evolution is often intermingled with secular law. The book asks (and in some ways answers) the questions: What is the role of tradition within religions and religious laws? What is the impact of religious traditions on secular laws, and vice-versa? How are the elements of tradition to be identified? Are they the same within the secular and the religious realm? Do secular law and religious law follow comparable patterns of change? Do their levels of resilience differ significantly? How does the history of religion and law affect changes within religious traditions and legal systems? The overall focus of the book addresses the extent to which tradition plays a role in shaping and re-shaping secular and religious laws, as well as their mutual boundaries.

Book Division or Destroy

Download or read book Division or Destroy written by Biplop Kumar and published by BFC Publications. This book was released on 2022-04-30 with total page 322 pages. Available in PDF, EPUB and Kindle. Book excerpt: I wanted to gist of different writers in the globe and my own experiences in different places regarding social dogma, in various aspect and appeal to repeal the text which are wrong in the present situation of the world order. There is nothing wrong to say that everything in this world is changing nothing is fixed and nothing is immoveable in this universe. We have seen in the name of religion, 30 lakhs people killed in 1971 in Bangladesh freedom wars. More than 2 lakhs women or girls raped, and this was declared by then Shaik Mujib PM of that country. I don’t think British has killed so many people in their nearly 200 years being administrators. Few days back Shaikh Hassina PM of Bangladesh has asked fundamentalist that God is there to punish if anyone do any sin and those who believe in God should, must not take weapons in their own hand to punish anybody in the name of God. If they do so that means they have no faith in God.
