Book The International Law of Human Rights and States of Exception

Download or read book The International Law of Human Rights and States of Exception written by Anna-Lena Svensson-McCarthy and published by Martinus Nijhoff Publishers. This book was released on 1998-07-28 with total page 812 pages. Available in PDF, EPUB and Kindle. Book excerpt: This study demonstrates the extensive protection that international law provides to human rights even in the most serious of emergencies when they are particularly vulnerable. Based on a meticulous analysis of preparatory works and practice under the International Covenant on Civil and Political Rights, as well as the American and European Conventions on Human Rights, and with a special chapter on the International Labour Organisation's approach to international labour standards and emergencies, this book shows that respect for the rule of law and the concept of a democratic society are controlling parameters in any valid limitation on the enjoyment of human rights. It further shows that respect for human rights and the operation of institutions such as the Legislature and Judiciary are crucial to enabling societies to address and eventually remedy the root causes of emergency situations. The study recommends possible directions for the development of case law and suggests some practical means to help ensure that international legal requirements are in fact respected in emergencies.

Book The Admissibility of Human Rights Petitions

Download or read book The Admissibility of Human Rights Petitions written by Tom Zwart and published by Martinus Nijhoff Publishers. This book was released on 2022-06-08 with total page 264 pages. Available in PDF, EPUB and Kindle. Book excerpt: Both global and regional human rights treaties have established international institutions offering recourse if a State party fails to comply with its obligations under the treaty. Many of these institutions have jurisdiction to consider complaints brought by individuals claiming that a State party has violated the rights enumerated in the treaty. However, these same institutions appear no longer merely to confine themselves to considering individual petitions. Due to the growing number of complaints, they have become increasingly preoccupied with managing their workload. The present volume focuses attention on two international institutions, one regional (the European Commission on Human Rights), and one global (the Human Rights Committee). It thoroughly examines the admissibility conditions of both the Commission and the Court by means of their case law and discusses possible changes which might reduce this case load. Chapter 2 discusses the procedural aspects of both systems, in particular, the division of labour and the various stages of the proceedings. Chapters 3-9 explore the case law of both organs concerning admissibility conditions, and such topics as competence ratione personae (including standing, the victim requirement and State responsibility), competence ratione temporis, competence ratione materiae, inadmissibility pendente lite and the exhaustion of local remedies.

Book International Handbook of Human Rights

Download or read book International Handbook of Human Rights written by Jack Donnelley and published by Bloomsbury Publishing USA. This book was released on 1987-11-06 with total page 508 pages. Available in PDF, EPUB and Kindle. Book excerpt: This collection of essays on the current human rights climate in 19 countries includes Canada, Chile, China, Cuba, Israel, Poland, the USA, and USSR, and represents a variety of regimes, cultural traditions, and geographical areas. . . . For analysis of the facts this volume excels. A well-crafted introduction describes current debate about human rights theory and practice, traces the development of human rights instruments, and discusses problems of implementation. Strongly recommended. Library Journal The bulk of the scholarly literature on human rights deals with international law and politics. In contrast, this volume offers nineteen case studies of national human rights practices. Although international factors cannot be ignored, most human rights violations are perpetrated by states against their own citizens; the principal causes of the respect for and violation of human rights lie in national social and political structures.
