Book Foreign Investment and the Environment in International Law

Download or read book Foreign Investment and the Environment in International Law written by Jorge E. Viñuales and published by Cambridge University Press. This book was released on 2012-09-13 with total page 479 pages. Available in PDF, EPUB and Kindle. Book excerpt: Conflicts between foreign investment law and environmental law are becoming increasingly frequent. On the one hand, the rise of environmental regulation poses significant challenges to foreign investors in several industries. On the other, the surge in investment arbitration proceedings is making States aware of the important litigation risks that may result from the adoption of environmental regulation. This study of the relationship between these two areas of law adopts both a policy and a practical perspective. It identifies the major challenges facing States, foreign investors and their legal advisers as a result of the potential friction between investment law and environmental law and provides a detailed analysis of all the major legal issues on the basis of a comprehensive study of the jurisprudence from investment tribunals, human rights courts and bodies, the ICJ, the WTO, the ITLOS, the CJEU and other adjudication mechanisms.

It fulfils its title in being contemporaneous, but more than that it also provides a subtle critique of how many international environmental lawyers have approached their subject. . . this book will be an essential read for anyone interested in the subject. British Yearbook of International Law This book presents an interesting, scholarly read. . . an invaluable reference asset, to law students, researchers, policy makers and non-state actors with interest in environmental regulation and governance. Priscilla Schwartz, Journal of Environmental Law This is a thoughtful and well-researched study of current issues in international environmental law. Malgosia Fitzmaurice s collection of essays is a welcome addition to the literature in this rapidly developing area of the law: it provides perspective on the environmental law issues discussed, but always against the background of the broader concepts and principles of general international law. James Crawford, University of Cambridge, UK The central aim of this insightful book is to illuminate how many concepts in international environmental law such as the precautionary principle and sustainable development are taken for granted. These problematic issues are very much still evolving and subject to heated debate between scholars as well as between states. The author explores these controversies viewing them as a positive development within a field that is in a constant state of flux. Areas discussed include the convergence of human rights with environmental issues and the quest for the human right to a clean environment. The book also clearly demonstrates that international environmental law cannot be analysed in isolation since it greatly influences the development of general international law. Taking full account of the most recent decisions of international courts and tribunals as well as the most up-to-date scholarly analysis, Contemporary Issues in International Environmental Law is a timely and important resource for legal scholars, under- and post-graduates and practitioners alike.

Book Yearbook of International Environmental Law

Download or read book Yearbook of International Environmental Law written by Gunther Handl and published by Aspen Publishers. This book was released on 1992 with total page 800 pages. Available in PDF, EPUB and Kindle. Book excerpt: As concern for the global environment continues to intensify, evolving international environmental policy and law have become the focus of increased attention by scholars, legal practitioners and governmental as well as non-governmental decision-makers. Although several specialized journals and 'news' services have emerged in response to this phenomenon, there is yet no publication that systematically analyzes developments in this rapidly expanding new discipline of `international environmental law'. The Yearbook of International Law, now in its second Volume (1991), closes this gap by providing an authorative as well as comprehensive review of internationally significant legal development, in a format that makes information easily accessible. In a unique and expanding `Year in Review' section, short reports written by recognized international experts summarize year-by-year trends in discreet subject areas that represent the whole spectrum of international environmental legal issues. Additionally, international significant legal developments in key countries or regions and international governmental as well as non-governmental organizations are being reviewed. the very substantial documents section has been increased with a large number of documents now also available on discette. This service together with an international legal bibiliography, organized by subject matter, enhance the value of the Yearbook as a primary source for research and general reference. Volume 2 of the Yearbook includes a number of theoretical articles that provide critical assessment of international trade rules and environmental protection, implementing sustainability in developing countries, and promoting compliance with international environmental standards. In short, this package of features puts the new Yearbook at the cutting edge of monitoring and evaluating developments in international environmental law.
