Book excerpt: Following the successful global trade talks at the fourth World Trade Organisation (WTO) Ministerial Conference held in Doha in 2001, the fifth WTO Ministerial Conference was held at Cancun in Mexico in 2003. The conference, which opened with the aim of reducing trade barriers and strengthening the international trading system, was stalled due to major differences between the developing countries and the developed countries on several issues, ending the conference in deadlock. While developed and developing countries blamed each other for the failure of the conference, others blamed the WTO. For the next conference, to be held in Hong Kong in 2005, to be successful, both the developed and the developing countries have to contribute their share of the effort. The case study promotes an understanding of the role of the Ministerial Conferences in improving global trade, the differing preferences of developed and developing countries on several issues of global trade and the impact of the success or failure of the conference in arriving at a consensus on the various aspects of an international trading system. The case also offers scope for discussion on the validity of each group's preferences on the pending issues for negotiations, and also the required efforts by each group for the progress of international trade.

Political and academic attention has been focused either on global institutions like the IMF, the World Bank, the WTO and UN organisations, or on regional blocs like the EU or NAFTA. As negotiations take place in different international arenas, these arenas themselves take on added strategic significance, with agendas pursued and switched from one arena to another, should one route be blocked. While dominant actors have sought to use arena switching to their advantage, subordinate actors have begun to reactivate alternative arenas of negotiation in order to pursue their different agendas. This book employs a multi-level and multi-arena perspective to analyze global rule-making in international trade. It explains why actors - both state and non-state actors - prefer particular arenas. It also addresses the question of which institutional designs serve the aims of specific groups best and how the rules of the different arenas are related.

As a result, there is a need for a global trade framework applicable to such digitally-delivered content products. Yet, digital trade is currently not explicitly recognised by the trade rules and obligations of the World Trade Organization (WTO). This study provides a complete analysis of the related challenges in the ongoing WTO Doha Negotiations to remedy this state of affairs. It elaborates on the required measures in the multilateral negotiations to achieve market access for digital content and examines the obstacles that lie on the path to reach consensus between the United States and the European Communities. Negotiation parameters analysed include the current US and EC regulatory approach to audiovisual and information society services and the evolution of their applicable trade policy jurisdiction. Finally, this examination takes stock of how the Doha Negotiations and parallel US-driven preferential trade agreement have so far contributed to securing free trade in digital content. As new technologies are an increasingly prominent source of trade dispute, this book is an assessment of how WTO Members can maintain the relevance of the multilateral trade framework in a changing technological and economic environment.
