The Common Oceans ABNJ Program (2014-2019) was implemented by FAO as a concerted effort to bring various stakeholders to work together to manage and conserve the world’s common oceans. The project “Strengthening global capacity to effectively manage ABNJ”, one component of the Common Oceans ABNJ Program, addressed cross-sectoral coordination and dialogue among the separate ongoing processes - a key gap that limited effective ecosystem-based management of ABNJ. The project supported participation and knowledge sharing amongst decision makers in cross-sectoral governance of ABNJ. Limitations to the project design, budget and accountability should be addressed to foster corrective action for phase two of the ABNJ Program.

The Program catalysed important transformational changes and practices in governance, and operational aspects of fisheries and their impact on biodiversity. There is encouraging evidence that these are being mainstreamed by key institutional actors and early trends of positive impact point to improvement in fish stocks health and in bycatch mitigation, starting by the quality and quantity of the information available. However, the Program lacked a proper programmatic approach and missed opportunities to foster synergies among projects and capitalize on knowledge management.

This book analyses the essential components an ILBI will require to effectively conserve and sustainably use BBNJ, focusing on marine genetic resources, areabased management tools, environmental impact assessments, capacity-building and marine technology transfer. It investigates potential areas of compromise, as the success of an ILBI will rely upon the support of a powerful bloc of maritime States, principally the United States, the United Kingdom, Russia, the Netherlands, France and Japan. The participation of major maritime powers will be critical as it is their nationals, corporations and flag vessels that have the financial and technical wherewithal to undertake activities beyond national jurisdiction. This bloc of States has historically been the strongest proponent of the Grotian doctrine of ‘freedom of the seas’ as it aligns with their predominant interest to preserve navigational freedom for their merchant and military fleets. Accordingly, this book assesses the extent to which the Grotian doctrine continues to exert influence on the development of the law of the sea and the development of an ILBI. Providing a comprehensive overview of this important development in international law, this book will be of interest to students, lecturers and academics of law of the sea, international environmental law and biodiversity law.

To showcase existing knowledge, practices and innovative research for sustainable deep-sea fisheries management and biodiversity conservation in the ABNJ, the Food and Agriculture Organization of the United Nations (FAO), in collaboration with UN Environment World Conservation Monitoring Centre (UNEP-WCMC) and the SponGES Project consortium, organized a meeting – the ABNJ Deep Sea Meeting 2019 – that took place on 7-9 May 2019, at FAO Headquarters in Rome, Italy. Over 40 participants, including representatives from partner organizations and other stakeholders from multiple sectors within the ABNJ, attended the three-day meeting. While significant progress has been made in the management of deep-sea fisheries and in the protection of vulnerable marine ecosystems, the ABNJ still faces threats from climate change, ocean acidification, biodiversity loss, and pollution. Building on the achievements of the Common Oceans ABNJ Deep Sea Projects and the SponGES Project, the participants were invited to give presentations on key topics and discuss emerging issues concerning ABNJ governance and deep-sea research, monitoring and management.

Book excerpt: Increasing exploitation of resources in marine areas beyond national jurisdiction (ABNJ), combined with concerns over potential legal and policy gaps, are driving interest in enhancing the institutional and regulatory framework for conservation and sustainable use of biodiversity in ABNJ. Such approaches are being examined primarily in the context of ongoing deliberations at the global level for a new international instrument for biodiversity in ABNJ, in which relative consensus has emerged for regional-scale approaches, collaboration among sectoral authorities, and the use of area-based management tools, such as marine protected areas (MPAs). Such approaches are discussed very generally, both in the deliberations and the literature, with little focus on means to enable effective application of cross-sectoral area-based management at the regional level in ABNJ. In light of the differing capacities and characteristics among regions, is it important to further examine the enabling factors and capacities required for the successful development and implementation of such approaches. ☐ In an effort to address this gap, this dissertation focuses on identifying and characterizing the conditions for (i) successful development and (ii) effective implementation of cross-sectoral, area-based management tools, such as MPAs, at the regional scale in ABNJ. These findings can provide critical insights for States and international organizations interested in pursuing and/or facilitating such approaches or in need of guidance as to where to focus their efforts and political capital, including institutionalization of the approach, capacity development, and facilitation of multilateral collaboration at the regional scale. It will also inform the ongoing negotiations on a legally-binding international instrument for ABNJ, as the conditions, capacities, and approaches for effective cross-sectoral management are key aspects to address when considering how such an agreement may be implemented. ☐ The first study examines efforts to advance cross-sectoral, area-based management at the regional level in ABNJ in the North-East Atlantic and the Sargasso Sea in order to identify and characterize enabling conditions for the development of such initiatives. Through the application of a framework composed of regional characterization and regime formation attributes, the analysis elucidates the conditions under which such initiatives have emerged and evolved. The study examines factors such as regional identity, interdependence, and regional institutional character, and how these influence the form and evolution of the approach taken to engender cross-sectoral ABNJ management collaboration. It identifies two relatively distinct types of approaches, the institutional approach and the coalition approach, and discusses how these emanated from distinct regional characteristics. It applies lessons and observations to a region where a major regional initiative has not yet taken hold, the Western Indian Ocean. It identifies unique challenges that arise in developing regions, and how global and regional institutions can provide support in addressing these challenges. The study then highlights challenges that arise in regional-scale ABNJ management collaboration, and discusses the role that a global instrument could play in facilitating the attainment of global standards of conservation and sustainable use by regional ABNJ management regimes and access to the tools and support needed to do so. ☐ The second study examines national-level capacity needs for implementation of a regional MPA located in ABNJ. Through a theory of change approach, the study analyzes the capacities required to operationalize the enabling factors for implementation (e.g., political support, legal basis, science and information management, enforcement) using experiences in MPA implementation within exclusive economic zones (EEZs) and implementation of sectoral area-based management tools in ABNJ. It characterizes capacity needs that are unique to ABNJ management and that require dedicated ABNJ capacity development, as well as capacity needs that are the same as those required for EEZ management. It also stresses the role of international organizations and non-flag States in mitigating costs of ABNJ management to individual States, and stresses the need to link capacity to exploit and benefit from ABNJ resources with the capacity to manage the impacts of these activities. The study also highlights the need to develop a joint mechanism among various global and regional processes focused on either a individual managed areas or networks of managed areas in a region as a means to address capacity needs at different levels for area-based management in ABNJ. ☐ Finally, the dissertation highlights common themes and challenges across the two studies, including the potential for cross-sectoral approaches to alter the dynamics of regional collaboration due to differing State memberships to various types of conventions and the potentially differing motivations of Coastal States and non-Coastal States. It also stresses the need for a future global instrument for ABNJ to ensure a balance between priorities for resource use and needs for conservation, recognizing that much of the interest in ABNJ is for equitable access to its resources, in addition to conservation. It presents recommendations for the means by which a new global instrument for ABNJ could address some of the challenges identified in the study, including by providing global standards for risk aversion and principles for management across regions, while also providing different regions with the necessary flexibility to undertake collaboration and management in line with their unique circumstances and enabling mechanisms that already enjoy political support and existing capacities to support more cross-sectoral approaches to management in ABNJ.

Book excerpt: Areas beyond national jurisdiction (ABNJ) are managed and governed by a patchwork of laws and organizations. Even though these areas constitute 64% of the ocean surface and are vitally important for food, trade, and the environment, only 1.18% of these areas are protected in a marine protected area (MPA). States are currently negotiating a new Implementing Agreement under the United Nations Convention on the Law of the Sea to better manage and conserve ABNJ. This dissertation explores the conservation and management of ABNJ and examines capacity for the conservation and management of ABNJ, the effectiveness of ABNJ MPAs, and the role of non-States in the designation of ABNJ MPAs. Results show capacity could be enhanced by increasing opportunities for training and education, increasing coordination and cooperation, developing a clearinghouse mechanism, and increasing priorities and awareness for ABNJ. While governance of ABNJ MPAs is strong, MPAs could be more effective though increased focus on management and through increased protections of vital areas and ecosystems not as represented in current MPAs. Non-States, specifically non-governmental organizations, have influenced the creation of MPAs in ABNJ and could continue to influence ABNJ MPAs through increasing awareness of the public and policy/decision-makers, pushing States to act on MPAs, and monitoring or conducting research. The January 2020 draft text of the new Implementing Agreement addresses many of these concerns, but States must embrace these concepts and act quickly to effectively conserve and manage ABNJ.

The ABNJ Deep-Sea project, one component of the Common Oceans ABNJ Program, was of great assistance to newly-formed regional fisheries management organization and arrangements (RFMO/As), as well as some long-standing regional fisheries. The project showed positive results in safeguarding vulnerable marine ecosystems, strengthening monitoring, control and surveillance to combat illegal, unreported and unregulated fishing, mitigating bycatch mortality trends, and building awareness of cross-sectoral aspects in effective governance of ABNJ. Through its cooperation with RFMOs, the project has, to some extent, contributed to minimize the negative impacts of bycatch. Results achieved should be capitalized on and upscaled in a second phase.

Four promising areas of activity for ‘Blue Growth’ have been identified at European Union policy level including Aquaculture; Renewable Energy (offshore wind, wave and tide); Seabed Mining; and Blue Biotechnology. Work has started to raise the technological and investment readiness levels (TRLs and IRLs) of these prospective industries drawing on the experience of established maritime industries such as Offshore Oil and Gas; Shipping; Fisheries and Tourism. An accord has to be struck between policy makers and regulators on the one hand, anxious to direct research and business incentives in effective and efficient directions, and developers, investors and businesses on the other, anxious to reduce the risks of such potentially profitable but innovative investments.The EU H2020 MARIBE (Marine Investment for the Blue Economy) funded project was designed to identify the key technical and non-technical challenges facing maritime industries and to place them into the social and economic context of the coastal and ocean economy. MARIBE went on to examine with companies, real projects for the combination of marine industry sectors into multi-use platforms (MUPs). The purpose of this book is to publish the detailed analysis of each prospective and established maritime business sector. Sector experts working to a common template explain what these industries are, how they work, their prospects to create wealth and employment, and where they currently stand in terms of innovation, trends and their lifecycle. The book goes on to describe progress with the changing regulatory and planning regimes in the European Sea Basins including the Caribbean where there are significant European interests.
