Excerpt: ...Act, 1897 (60 & 61 Vict. c. 37), provides: Sec. 1.--(1) If in any employment to which this Act applies personal injury by accident arising out of and in the course of the employment is caused to a workman, his employer shall, subject as hereinafter mentioned, be liable to pay compensation in accordance with the first schedule to this Act. Sec. 7.--(1) This Act shall apply only to employment by the undertakers, as hereinafter defined... on, in, or about any building which exceeds thirty feet in height, and is either being constructed or repaired by means of a scaffolding, or being demolished.... The County Court Judge found that the arrangement in question was a " scaffolding" within the meaning of the Act. He further found that, apart from the whitewashing and distempering, none of the other works comprised in the estimate and additional work were in progress at the time of the accident, and that no scaffolding was being used for their execution; and that the-scaffolding was being used only for the purpose of whitewashing and distempering walls and ceilings, and for the preparation of the walls and ceilings in the ordinary way for that purpose. The County Court Judge held, upon the authority of Wood v. Walsh (1899 1 W. C. C. 68), that the building was not "being repaired" within the meaning of sec. 7 (1) of the Act, and made his award in favour of the respondents. The applicants having appealed, the hearing of the appeal was adjourned until after the decision of the appeal to the House of Lords in Hoddinott v. Newton, Chambers, J? Co. (ante, p. 74). Ruegg, K.C., and Morton Brown for the appellants: When this case was decided by the County Court Judge he considered himself bound, by the decision of this Court in...

Book excerpt: Excerpt from Reports of Cases Under the Workmen's Compensation Act: Determined by Committees of Arbitration, the Industrial Accident Board and the Supreme Judicial Court, July 1, 1912, to June 30, 1913, Inclusive Striking References to Act by Supreme Court. The court makes many striking references to the Workmen's Compensa tion Act in the course of the several decisions rendered. For the accomplishment of the purposes of the statute, a simple method is furnished operating without delay or unnecessary formality. In one aspect a case under the act resembles an action at law, for it seeks ultimately the payment of money. Payments, however, in most instances are by instalments. In another aspect, it is akin to the specific performance of a con tract, designed to cover the whole range of misfortunes likely to arise in the course of employment in a. State with many and diversified industries. (gould case below.) In another deci sion, in the Gillen case, the court refers to the broad scope of the act and its comprehensive dealing with the whole subject, and states that where words are used in one part of a statute in a definite sense it may be presumed, in the absence of a. Plain intent to the contrary, that they are used in the same sense in other places in the same act. In the mcnicol case below the court says injuries are excluded which cannot fairly be traced to the employment as a contributing proximate cause, and, that the provisions of the English act as to the dependents entitled to payments are wholly different from those of our own act. The court states that the act should be interpreted broadly in harmony with its main aim of pro viding support for those dependent upon a deceased employee in the course of its decision in the Coakley case, below. In the Pigeon case below the court declares that the Workmen's Compensation Act in its practical operation affects large num bers of people, and that its declared purpose is the humane one of preventing industrial accidents and providing payments for employees injured in the course of employment. The word court may be given a signification liberal enough to ih elude the committee of arbitration and Industrial Accident Board as instituted by the act, and under all the circumstances should be given such construction. Book excerpt: Excerpt from Report of Cases Under the Workmen's Compensation Act: Determined on Appeal by the Supreme Judicial Court, Jan. 1, 1921, to Dec. 31, 1921, Inclusive If there is any evidence or if it can be rationally inferred that the employee fell into the elevator well while in the course of his employment, either because the doors were open or he accidentally fell against them and pushed them open, then the finding of the Industrial Accident Board must stand; but if there is no evidence to support the finding of the Board, or if on the whole evidence and drawing every reasonable inference it can only be conjectured in what manner and from what cause he met his death, so that the mind is left in suspense and doubt, and where one conclusion is as rational as the other, then the cause of death is matter of mere Speculation, and it has not been Shown that the injury arose out of and in the course of his employment.
