It discusses Belgian companies who are currently engaged in establishing one or have developed 'functionally equivalent' structures. The remaining companies are confronted with serious obstacles to establishing a European Works Council, principally: (i) a lack of knowledge about them, (ii) weak and time-consuming national-level information and consultation processes, and (iii) a low perceived added value of transnational information and consultation. It evaluates what needs to be done in order to increase the number of EWCs and what trade unions need to do in order to raise awareness on the importance of EWCs at European level.

Book excerpt: European works councils will have to be established in companies and groups of companies of a significant overall size and with a significant presence in at least two different Member States. It is clear that the number of affected companies, undertakings or establishments and certainly the overall number of affected workers is very high. European works councils are therefore an important phenomenon in European industrial relations. Practitioners and academics the world over need a handy instrument providing easy access to information regarding the European Directive and its significance and implementation in Member States of both the EC and the EEA. This book provides such a tool with regards to Belgium. The national legislation of Member States remains of the utmost importance, even though the establishment of a European works council within a given Community-scale undertaking or group as such is not governed by national, in this case Belgian, law. The involvement of Belgian employees in the transnational information and consultation process will, to a large extent, be subject to Belgian law in those European works councils that are established in companies or groups with subsidiary establishments in Belgium. In those cases, for example, Belgian law determines who will represent the Belgian employees in the negotiations of the Special Negotiating Body, and Belgian law determines the protection of the employee representatives in terms of wages and dismissal, etc.In light of all this, a combined study of both the European Directive and the Belgian implementing legislative measures is warranted.

Because of the need for greater involvement of workers in changing production systems, as well as frustration with existing structures of workplace regulation, the search has begun for new ways of providing a voice for workers outside the traditional collective bargaining relationship. Works councils—institutionalized bodies for representative communication between an employer and employees in a single workplace—are rare in the Anglo-American world, but are well-established in other industrialized countries. The contributors to this volume survey the history, structure, and functions of works councils in the Netherlands, Germany, France, Spain, Sweden, Italy, Poland, Canada, and the United States. Special attention is paid to the relations between works councils and unions and collective bargaining, works councils and management, and the role and interest of governments in works councils. On the basis of extensive comparative data from other Western countries, the book demonstrates powerfully that well-designed works councils may be more effective than labor unions at solving management-labor problems.

Book excerpt: This title was first published in 2002: Negotiated Europeanisation is the final study in a three-volume series on European Works Councils by an international research group. The first two studies have already been published by Ashgate. The current study is rooted in an analysis of the establishment of EWCs under Articles 5 and 6 of the 1994 EWC Directive. This is now a mandatory procedure and completes the development of EWCs from bodies set up purely by voluntary negotiation to bodies set up within a binding statutory procedure. The study is based on cases of five (named) major European firms in a variety of industrial sectors. As well as a detailed consideration of how negotiations using the mandatory procedure took place, there are more general reflections on the 'quality' of the actors involved, the negotiating process and the outcomes. As well as their analytical value, these observations offer a number of practical pointers on the establishment of information and consultation arrangements internationally. The study also asks why EWCs have been set up in only one third of eligible companies and why the pace of establishing new EWCs slowed after the mandatory procedure came into force in September 1996. This part of the study is based upon a pan-European questionnaire and offers the first empirical findings on this issue. European Works Councils exemplify a new mode of regulation at the European level, not only within industrial relations but in the field of European integration more widely conceived - Europe as a multi-level system of governance within a framework of devolved subsidiarity. This study is of both academic and practical interest, particularly in view of the continuing process of change in this area, exemplified in new Directives on the European Company Statute and information and consultation at national level.

As the crisis in Europe came to be largely interpreted as a crisis of competitiveness, wages were seen as the core adjustment variable for ‘internal devaluation’, the claim being that competitiveness could be restored through a reduction of labour costs. This book proposes an alternative view according to which wage developments need to be strengthened through a Europe-wide coordinated reconstruction of collective bargaining as a precondition for more sustainable and more inclusive growth in Europe. It contains major research findings from the CAWIE2 – Collectively Agreed Wages in Europe – project, conducted in 2014–2015 for the purpose of discussing and debating the currently dominant policy perspectives on collectively-bargained wage systems under the new European economic governance.

The year 2016 will see the formal conclusion of a new evaluation procedure designed to ascertain whether the improvements of 2009 have had any impact on the EWC's conditions of operation and whether any further amendements should be considered. This book assesses in detail the ways in which key improvements brought about by the 2009 EWC Recast Directive have been implemented in national legislation. The authors of the book have looked into the national transposition legislation of the 31 countries of the European Economic Area. The findings are very relevant for EU policy-making and for practitioners to deal with differing national legislative regimes.

The principle of legality protects the citizen against the arbitrary use of power, or, more precisely, it demands a legal basis (which itself must be of a certain standard) to legitimize State action. Is legality under siege in Europe? The authors contributing to this provocative and important book answer this question in the affirmative. Twenty-one outstanding European legal scholars expose a spectrum of ways in which the traditional legality principle is under pressure because of the creation of new legal orders, including that of the EU, and the interaction between these new orders and that of the State, combined with such factors as expertise driven governance, difficulties of international organizations to meet their objectives due to a lack of adequate powers, and lack of parliamentary control. The question of whether the main functions of legality - legitimating, attributing and regulating the exercise of public authority - are still fulfilled in the context of the overlapping, interacting, and mutually dependent legal orders of the EU, the ECHR, and the Member States is at the background of all the essays in this volume.
