This book examines why the World Bank came to see good governance as important and evaluate what the World Bank is doing to improve the governance of its borrower countries. David Williams examines changing World Bank policy since the late 1970s to show how a concern with good governance grew out of the problems the World Bank was experiencing with structural adjustment lending, particularly in Sub-Saharan Africa. The book provides an account of the early years of the World Bank and traces the increasing acceptance of the idea of good governance within the Bank through the 1990s, while systematically relating the policies of good governance to liberalism. The author provides a detailed case study of World Bank lending to Ghana to demonstrate what the attempt to improve ‘governance’ looks like in practice. Williams assesses whether the World Bank has been successful in its attempts to improve governance, and draws out some of the implications of the argument for how we should think about sovereignty, for how we should understand the connections between liberalism and international politics. In response to constructivist scholars' concerns about politics and the organizational culture of international civil servants within international organizations, Kim Moloney uses stakeholder theory and a bureaucratic politics approach to suggest the normality of politics, policy debate, and policy evolution. The book also highlights how for 21 of those 32 years it was not external stakeholders but the international civil servants of the World Bank who most influenced, led, developed, and institutionalized this sector's agenda. In so doing, the book explains how one sector of the Bank's work rose, against the odds, from being included in just under 3% of approved projects in 1980 to 73% of all projects approved between 1991 and 2012.

Inspired by actor-network theory, relational sociologies of association, and performativity theory, this ethnographic exploration multiplies the matters of concern in our study of international law (and lawyering): the human and non-human, material and semantic, visible and evasive actants that tie together the fragile fabric of legality. In tracing these threads, this book signals important changes in the conceptual repertoire and materiality of international legal practice, as liberal ideals were gradually displaced by managerial modes of evaluation. It reveals a world teeming with life—a space where professional postures and prototypes, aesthetic styles, and technical routines are woven together in law's shifting mode of existence. This history of international law as a contingent cultural technique enriches our understanding of the discipline's disenchantment and the displacement of its traditional tropes by unexpected and unruly actors. It thereby inspires new ways of critical thinking about international law's political pathways, promises, and pathologies, as its language is inscribed in ever-evolving rationalities of rule.

Based on international legal methodology, this book addresses these two institutions in public international law, and assesses the extent to which international law provides foundations for obligations in the field of human rights. This book analyses any possible obligations related to the effect of the two institutions own programmes and projects. The core of this analysis is focused on the two institutions international legal personality, and addresses their relationship to international law as legal subjects, rather than as a collectivity of states with international legal personality. Building on the traditional sources of international law, such as customary international law, general principles of international law and treaty law, the book concludes that the two institutions are under an obligation to respect human rights in their operations. This implies that they will break their obligations if they make the human rights situation worse as a result of their programmes or projects. It also concludes that the World Bank and the IMF are not under obligations to promote or fulfil human rights, but that they may legitimately do so if they can do it within their Articles of Agreement (the treaties establishing the institutions). The book also looks at the practical implications of the obligation to respect, which involves both substantial and procedural obligations. These obligations will, even if limited in their scope, imply that the two institutions need to include human rights checks in the planning, implementation and evaluation stages of projects and programmes. The final part of the book looks at redress possibilities in situations where either of the two institutions may be in breach of their human rights obligations.

Book excerpt: Why is it so hard for international development organizations—even ones as well-resourced and influential as the World Bank—to generate and sustain change in the way things are done in those countries where they work? Despite what, in many cases, is decades of investment and effort, why do partner governments continue to engage in those traditional patterns and styles of public service management that international development organizations have sought to supplant with methods that are supposedly more accountable, efficient, and effective? This book provides an answer to these questions. However, rather than pathologizing partner governments as the source of the problem—that is, rather than maintaining the distinction between doctor (international development organizations) and patient (partner governments), wherein the patient is seen as unwilling to take their medicine (enacting "good governance" practices)—this book instead reframes the relationship. The central argument is, first, that the programs and projects of international organizations are introduced into and are constrained by multiple layers of ritual governance, that is, performative acts and cultural logics that intersect with and reinforce the political, economic, and social structures in and through which they operate. As is shown, the contextual factors that guide governance practices are largely beyond the reach of the international development organizations; the relevant logics have their roots in state ideology but also extend back to the colonial logics that continue to operate at the heart of the state apparatus. The second the central argument is that international aid organizations and the governments with which they work are engaged in a "ritual aid dance" where each actor plays a part but does not (and cannot) acknowledge the ways that it depends on the other for its own gain. This relationship can be considered a dance because each participant responds to and needs the other, and because both sides do so in ways that are carefully choreographed, with the overall trajectory or contours of the dance being more or less known to the participants. These arguments are based on research on the World Bank’s efforts over the course of several decades to encourage, through its financing, projects, and technical assistance, the implementation of social sector reform in Indonesia related to decentralization, community participation, and school-based management.
