This book explores the many miscalculations, misconceptions, and blunders that have led to this failure. Looking at Hungary, the Czech Republic, and Romania, Rostas shows how policy makers in each country have mishandled already confused EU policy, from failing to define “Roma” to not having a way to evaluate their own progress. Rostas further argues that the alleged successes of these policies were actually the product of poor information and sometimes outright deception. Examining perennial topics among Roma like school segregation and political representation, the author shows how often the so-called success of Roma policies can be fallacious and simply pave the way for further problems. Rostas maintains that when the EU’s Framework for Roma program comes to an end in 2020, there must be a fundamental shift in policy for there to be any real improvement for Roma. Policy makers will have to address Roma issues not only in terms of poverty and social exclusion but also in terms of the particular nature of Romani ethnic identity. This shift requires reconceiving Roma as a “politically insular minority” and rearranging the power dynamics of local government to ensure that when the new era of Roma policy begins Roma themselves will have a voice in its formulation.

This book explores experiences with inclusion policy implementation in seven different post-socialist EU countries. It focuses particularly on two groups of people in constant danger of social exclusion: people with Roma background and people with disabilities. So far, researchers have studied these issues primarily through policy analysis, and thus not provided knowledge on what actually happens in local contexts where welfare services are produced. This book sheds light on implementation processes at different levels, both at the policy level and in local welfare production. The picture painted here is one of complex and conflicting considerations in inclusion policy implementation, between historical and cultural heritage from the communist period, and EU inclusion policy based on Western European political principles. This book will appeal to undergraduate and post-graduate students, as well as postdoctoral students in social science, disability studies, educational science, and others. The book’s central aim is to research how a societal problem can be improved upon from a legal perspective. The controversy surrounding ethnic data collection and positive action severely limits their use at the national level. Accordingly, legal and political concerns are analysed and addressed in order to demonstrate that it is possible to collect such data and to implement such measures while fully respecting international and European human rights norms, provided that certain conditions are met. Part I focuses on ethnic data collection and explores the key rules and principles that govern it, the ways in which this equality tool could be used, and how potential obstacles might be overcome. It also identifies and addresses the specific challenges that arise when collecting ethnic data on the Roma minority in Europe. In turn, Part II explores positive action and the broad range of measures covered by the concept, before analysing the applicable international and European framework. It reviews the benefits and challenges of implementing positive action for Roma, identifies best practices, and gives special consideration to inter-cultural mediation in the advancement of Roma inclusion. The book concludes with an overview of the main findings on both topics and by identifying three essential elements that must be in place, in addition to full respect for the applicable legal rules, in order to combat discrimination and achieve the inclusion of Roma in Europe by complementing existing anti-discrimination frameworks with the collection of ethnic data and the implementation of positive action schemes.
