Book excerpt: In this paper, Michael Schmitt explores the legality of the attacks against Al Qaeda and the Taliban under the "jus ad bellum," that component of international law that governs when a State may resort to force as an instrument of national policy. Although States have conducted military counterterrorist operations in the past, the scale and scope of Operation Enduring Freedom may signal a sea change in strategies to defend against terrorism. This paper explores the normative limit on counterterrorist operations. Specifically, under what circumstances can a victim State react forcibly to an act of terrorism? Against whom? When? With what degree of severity? And for how long? The author contends that the attacks against Al Qaeda were legitimate exercises of the rights of individual and collective defense. They were necessary and proportional, and once the Taliban refused to comply with U.S. and United Nations demands to turn over the terrorists located in Afghanistan, it was legally appropriate for coalition forces to enter the country for the purpose of ending the ongoing Al Qaeda terrorist campaign. However, the attacks on the Taliban were less well grounded in traditional understandings of international law. Although the Taliban were clearly in violation of their legal obligation not to allow their territory to be used as a terrorist sanctuary, the author suggests that the degree and nature of the relationship between the Taliban and Al Qaeda may not have been such that the September 11 attacks could be attributed to the Taliban, thereby disallowing strikes against them in self-defense under traditional understandings of international law. Were the attacks, therefore, illegal? Not necessarily. Over the past half-century the international community's understanding of the international law governing the use of force by States has been continuously evolving. The author presents criteria likely to drive future assessments of the legality of counterterrorist operatio7.

Following the 9/11 terrorist attacks, however, popular wisdom dictated that terrorist organizations and radical fanatics could not be deterred—and governments shifted their attention to combating terrorism rather than deterring it. This book challenges that prevailing assumption and offers insight as to when and where terrorism can be deterred. It first identifies how and where theories of deterrence apply to counterterrorism, highlighting how traditional and less-traditional notions of deterrence can be applied to evolving terrorist threats. It then applies these theoretical propositions to real-world threats to establish the role deterrence has within a dynamic counterterrorism strategy—and to identify how metrics can be created for measuring the success of terrorism deterrence strategies. The Nation has formulated a strategy for combating terrorism that places the U.S. Military in a significant role. Perhaps the most significant role for the military in this effort will be globally operationalizing the application of military power to achieve the strategic objective to defeat transnational terrorism. The challenge for the United States application of military power lies in leveraging a regionally based operational command and control structure against a globally distributed threat. This monograph proposes that the existing organization, delineated responsibilities, and commensurate procedures of the operational military system of the United States, must adapt to meet the necessities of the world environment and defeat the threat of transnational terrorism. To better understand the operational challenges confronted in the Global War on Terror, a commensurate level analysis of the adversaries is necessary. The operational analysis uses the doctrinal elements of operational design to guide the examination of the adversaries. Furthermore, the analysis uses the third element of operational design as a measure of effectiveness for the command and control structure of the operational military in addressing the global threat of transnational terrorism.

Book excerpt: In the aftermath of the terrorist attacks on the World Trade Center Towers and the Pentagon The United States conducted combat operations in Iraq and Afghanistan. The U.S. government declared the major combat operations a success and important steps in the war on terrorism. Although it is true that the Taliban and Al Qaeda have been routed, the two groups have reorganized, adapted and are continuing to fight. Al Qaeda's operations were disrupted, yet the organization remains a viable transnational threat. Success in the war on terrorism is, therefore, more than the sum of battles and engagements. To define success in the war on terrorism, measures of success must be determined to achieve the strategic goals. Terrorism is not a unique phenomenon. It is merely a tactic of political violence to achieve a political end. An examination of past insurgencies reveals terrorism as a tactic to produce affects against the ruling government or the populace. Defining success in the war on terrorism requires an understanding of both the insurgent and terrorist operational environment in order to determine success criteria. Dr. Max G. Manwaring developed a theory on counterinsurgencies through an examination of 43 post World War II insurgencies. Manwaring's paradigm provides a model, which is applicable to measuring success in the war on terrorism. While the model is a useful tool for defining success, it requires a thorough understanding of the terrorist and insurgent operational environment. Through examination of two case studies, the Philippines, 1948-1954 and Colombia, 1966 to present, the research assessed the Manwaring paradigm. The comparison revealed the complex operational environment and suggested other relevant factors, not addressed by Dr. Manwaring, for defining success in the war on terrorism. Those factors a systems approach to analyzing insurgencies and terrorist organizations and consideration of political primacy in the use of military and interagency capabilities. There is a significant body of knowledge on insurgencies and terrorism that can be applied to combating terrorism. There is a pressing need for the institutional military to educate the force on insurgency and terrorism. Insurgent and terrorist organizations are complex adaptive systems, which require a holistic campaign plan to defeat. Introducing systems thinking into the military education system will provide planners with the conceptual framework to analyze and develop coherent operational plans to achieve the strategic objectives in the war on terrorism.

Terrorism has evolved as a preferred tactic for ideological extremists around the world, directly or indirectly affecting millions of people. In addition to increasing law enforcement capabilities for counterterrorism (CT), the United States (US), like many nations, developed specialized, but limited, military CT capabilities. In joint doctrine, CT was simply defined as operations that include the offensive measures taken to prevent, deter, preempt, and respond to terrorism. In addition to any diplomatic and law enforcement actions, the US Government (USG) typically viewed CT missions as special operations by covert, clandestine, or low visibility means. CT is one of the core tasks of the US special operations forces (SOF), and their role and additive capability is to conduct offensive measures within Department of Defense's (DOD's) overall combating terrorism (CbT) efforts. Some significant policy and strategy adjustments were required because terrorism has evolved from a tactic of inducing fear in select populations/areas to a transnational threat of strategic proportion. After September 11, 2001, the US, along with multinational partners, embarked on what was characterized as a “global war on terrorism (GWOT).” That war has proven the need for expanded CT capabilities and a broader role for the US military in unified action against terrorism. That increasing role for conventional forces (CF), the need for truly unified action, and an increased emphasis on an indirect approach has led to developing this doctrine with a new definition for CT. The Department of State (DOS) was given the lead in developing policy action plans that employ both incentives and disincentives to end state sponsorship of terrorism. This publication has been prepared under the direction of the Chairman of the Joint Chiefs of Staff. It sets forth joint doctrine to govern the activities and performance of the Armed Forces of the United States in joint operations and provides the doctrinal basis for interagency coordination and for US military involvement in multinational operations. It provides military guidance for the exercise of authority by combatant commanders and other joint force commanders (JFCs) and prescribes joint doctrine for operations, education, and training. It provides military guidance for use by the Armed Forces in preparing their appropriate plans. It is not the intent of this publication to restrict the authority of the JFC from organizing the force and executing the mission in a manner the JFC deems most appropriate to ensure unity of effort in the accomplishment of the overall objective. Joint doctrine established in this publication applies to the Joint Staff, commanders of combatant commands, subunified commands, joint task forces, subordinate components of these commands, and the Services. The guidance in this publication is authoritative; as such, this doctrine will be followed except when, in the judgment of the commander, exceptional circumstances dictate otherwise. If conflicts arise between the contents of this publication and the contents of Service publications, this publication will take precedence unless the Chairman of the Joint Chiefs of Staff, normally in coordination with the other members of the Joint Chiefs of Staff, has provided more current and specific guidance. Commanders of forces operating as part of a multinational (alliance or coalition) military command should follow multinational doctrine and procedures ratified by the United States. For doctrine and procedures not ratified by the United States, commanders should evaluate and follow the multinational command's doctrine and procedures, where applicable and consistent with US law, regulations, and doctrine.
